GOVERNOR OF THE STATE BANK OF VIETNAM
Pursuant to the Law on the State Bank of Vietnam 1997 and the Law Amending and Supplementing Certain Provisions of the Law on the State Bank of Vietnam 2003;
Pursuant to the Law on Credit Institutions 1997 and the Law Amending and Supplementing Certain Provisions of the Law on Credit Institutions 2004;
Pursuant to Decree No. 52/2003/NĐ-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the State Bank of Vietnam;
Upon the proposal of the Director of the Trading Department,
DECISION:
Article 1. Amend and supplement certain provisions of the Central Depository Regulation issued together with Decision No. 1022/2004/QĐ-NHNN dated August 17, 2004 of the Governor of the State Bank of Vietnam as follows:
1. Add Article 4a as follows:
"Article 4a. Depositary Fees for Valuable DocumentsThe depositor of valuable documents must pay depositary fees. The level of depositary fees shall be determined by the State Bank of Vietnam."
2. Clause 2 of Article 20 is amended and supplemented as follows:
"2. Accounting and Finance Department:
a) Guide accounting entries for the depositary of valuable documents and depositary fees in accordance with this Regulation;
b) Guide procedures for opening and closing accounts for valuable documents;
c) Develop appropriate levels of depositary fees for valuable documents for each period to submit to the Governor for issuance."
Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
Article 3. The Head of the Office, the Director of the Trading Department, the Director of the Accounting and Finance Department, the Director of the Securities and Stock Exchange Department, the Heads of relevant units under the State Bank of Vietnam, the Governors of the State Bank of Vietnam branches in provinces and centrally-administered cities, the Chairmen of the Management Boards, and the General Directors (Directors) of credit institutions are responsible for implementing this Decision./.
