Pursuant to Clause 1, Article 3 of Decision No. 394/QĐ-TTg dated March 13, 2006 of the Prime Minister on Encouraging Investment in New Construction and Expansion of Slaughterhouses, Preservation and Processing Facilities for Livestock and Poultry, and Concentrated Industrial Poultry Farms which are eligible for investment support, the Ministry of Agriculture and Rural Development hereby provides guidelines for implementation as follows:

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

This Circular stipulates conditions regarding the scale and capacity of concentrated industrial slaughterhouses, preservation and processing facilities for livestock and poultry, and concentrated industrial poultry farms that are eligible for the support policy as specified in Articles 1 and 2 of Decision No. 394/QĐ-TTg dated March 13, 2006 of the Prime Minister.

Organizations and individuals within the country investing in new construction and expansion of slaughterhouses, preservation and processing facilities for livestock and poultry, and concentrated industrial poultry farms must meet the conditions set forth in Section II of this Circular.

II. SPECIFIC PROVISIONS

1. Conditions for Slaughterhouses, Preservation and Processing Facilities for Livestock and Poultry

a) Regarding Scale and Capacity

- Slaughterhouses for poultry in plains provinces with large markets shall have a capacity of at least 500 birds per hour; in mountainous provinces with smaller markets, the capacity shall be at least 250 birds per hour.

- Slaughterhouses for pigs shall have a capacity of at least 200 animals per day.

- Slaughterhouses for cattle and buffalo shall have a capacity of at least 50 animals per day.

b) Regarding Veterinary Sanitation and Food Safety

- Slaughterhouses and initial processing facilities for animals and animal products must meet all veterinary sanitation conditions as prescribed in Article 33 of the Animal Health Ordinance and the following conditions regarding location, buildings, and equipment:

+ Must be isolated from residential areas, public works, main roads, and pollution sources; not prone to flooding; surrounded by walls; have separate entrances and exits for animals and animal products; internal pathways must be paved with tiles or concrete;

+ Must have separate areas for holding animals awaiting slaughter, slaughtering and initial processing of animals and animal products, isolation areas for sick animals, and areas for disposing of substandard products;

+ Must have a testing and sample examination room, and a veterinary inspection area;

+ Must have a wastewater treatment system and animal waste disposal system suitable for the slaughtering and initial processing capacity. Wastewater and treated waste must meet hygiene standards before being discharged into the environment;

+ Buildings must be designed to prevent dust and harmful animal intrusions; facilitate cleaning and disinfection; and be arranged separately for storing edible products, non-edible products, transportation vehicles, slaughtering and processing tools, and rest areas for workers to avoid contamination and cross-contamination;

+ Equipment and tools used in slaughtering and initial processing of animals and animal products must be made of rust-resistant materials that do not affect product quality, are easy to clean and disinfect.

- Water used in slaughtering and initial processing of animals and animal products must meet veterinary hygiene standards as prescribed.

c) Regarding Slaughtering and Processing Technology

- For small-scale slaughterhouses and preservation and processing facilities for livestock and poultry, domestic-made equipment and technologies can be used in an industrial or semi-industrial manner but must ensure synchronization (including production lines, packaging equipment, vacuum systems, etc.) and food safety.

- For slaughterhouses and preservation and processing facilities for livestock and poultry as specified in point a, clause 1, part II of this Circular, modern equipment and technology produced domestically or imported should be used. It is encouraged to apply advanced, synchronized, and automated technology.

2. Conditions for Concentrated Industrial Poultry Farms

a) Regarding Farming Scale

- Commercial poultry farms with a regular population of at least 2,000 birds (excluding chicks under seven days old).

- Breeding poultry farms with a regular population of at least 1,000 birds.

- In concentrated industrial poultry farming areas, the scale must not be less than 30,000 birds, with each household having a minimum of 4,000 commercial birds or 2,000 breeding birds.

b) Regarding Veterinary Sanitation and Biosecurity

- Concentrated industrial poultry farms must meet all veterinary sanitation conditions as prescribed in Clause 2, Article 12 of the Animal Health Ordinance and current regulations, specifically as follows:

+ Must comply with approved planning; concentrated industrial poultry farms in plains and midlands must be at least 300 meters away from residential areas, and in mountainous regions, at least 1 kilometer away;

+ Must have surrounding fences or walls to prevent unauthorized entry by people and animals;

+ Must have a separate administrative area;

+ Must have a place for staff and visitors to change clothes and shower;

+ Must have a disinfection pit for people and transport vehicles before entering the farm and the poultry rearing area;

+ The environment in the poultry rearing area must meet veterinary hygiene standards as prescribed;

+ Must have separate storage areas for feed, raw materials for feed production, farming equipment, and hazardous disinfectants;

+ Must have isolation and disposal areas for sick and dead poultry and waste according to veterinary guidance;

+ Must implement regular cleaning, disinfection, and sterilization when there is an outbreak and after each flock cycle;

+ Must have a disease prevention program and procedures in accordance with animal health laws;

+ Must ensure downtime between flocks and after selling poultry products;

+ Must have measures to eliminate rodents, insects, and restrict wild birds;

- The rearing area must have sufficient clean water;

- Organizations and individuals operating concentrated industrial poultry farms with a scale of at least 1,000 breeding birds or 2,000 commercial birds must register with the veterinary authority for assessment of farming conditions and veterinary sanitation.

3. Planning for Concentrated Industrial Livestock and Poultry Rearing, Slaughtering, and Preservation and Processing Facilities

- The provincial People's Committee shall plan centralized poultry farming areas, industrial zones, and slaughterhouses, preservation, and processing facilities for livestock and poultry in their locality. These facilities must ensure veterinary hygiene conditions and food safety standards:

+ Reorganize waterfowl farming towards enclosed housing; prohibit free-range farming; do not raise or house them in canals or streams with flowing water;

+ Centralized poultry farming areas and industrial zones must be located at least 300 meters away from residential areas; at least 500 meters away from public offices, schools, hospitals, and markets; relocate poultry farms within residential areas to planned zones.

- For districts with extensive land and far from residential areas, central highlands and mountainous provinces should focus on building large-scale poultry farming zones.

- The provincial People's Committee shall have policies to support investment in infrastructure (roads, electricity, water supply, environmental treatment up to the perimeter fence) for slaughterhouses, preservation, and processing facilities for livestock and poultry, and centralized, industrial poultry farming facilities of significant scale.

- Centralized poultry farming areas and industrial zones may include multiple households and be divided into plots, ensuring environmental sanitation according to point b, clause 2, section II of this Circular. Encourage the application of fully enclosed barns equipped with cooling systems to prevent heat, automatic feeding and watering systems, or naturally ventilated barns, and implement simultaneous entry and exit procedures.

III. IMPLEMENTATION

1. The Livestock Breeding Department shall be responsible for:

a) Direct, urge, and inspect the implementation of modern poultry farming methods towards centralized and industrial models in accordance with the provisions of this Circular and other relevant laws by the centrally governed cities and provinces;

b) Direct the establishment of some poultry farming models; coordinate with the Animal Health Department, the Processing and Marketing Department of Forestry and Salt Industry to direct the establishment of some centralized and industrial slaughterhouse, preservation, and processing models for livestock and poultry in different ecological regions;

c) Organize the development of biosecurity procedures and guide the implementation of safe waterfowl farming practices.

2. The Animal Health Department shall be responsible for:

a) Organizing inspections of veterinary hygiene conditions for large-scale centralized poultry farming facilities;

b) Directing the implementation of avian influenza vaccine injections. Guide the application of other preventive measures against dangerous diseases.

c) Directing animal health agencies to strictly control slaughter, preservation, and processing conditions for livestock and poultry.

3. The Processing and Marketing Department of Forestry and Salt Industry shall be responsible for:

Guiding the implementation of slaughter, preservation, and processing technologies for livestock and poultry. Guide the selection of advanced equipment and technologies in livestock and poultry farming.

4. Provincial People's Committees shall have the responsibility:

a) Directing the Department of Agriculture and Rural Development to organize the implementation of Decision No. 394/QD-TTg dated March 13, 2006, of the Prime Minister and the provisions of this Circular.

b) Approving new construction projects, expansion of slaughterhouses, preservation, and processing facilities for livestock and poultry, and centralized, industrial poultry farming facilities.

5. The Departments of Agriculture and Rural Development of centrally governed cities and provinces shall be responsible for:

a) Taking the lead in coordinating with the Departments of Planning and Investment, Natural Resources and Environment to develop plans for centralized poultry farming areas and slaughterhouse, preservation, and processing zones for livestock and poultry in their jurisdiction to be submitted to the provincial People's Committee for approval;

b) Guiding organizations and individuals to invest in poultry farming, slaughterhouses, preservation, and processing facilities in accordance with the plan, ensuring veterinary hygiene, food safety, and environmental protection;

c) Directing the Animal Health Service, veterinary stations:

- To monitor veterinary hygiene during poultry farming, slaughter, preservation, and processing within their jurisdiction;

- To inspect veterinary hygiene conditions of poultry farming, slaughter, preservation, and processing facilities within their jurisdiction;

- To guide the application of disease prevention programs for livestock and poultry at farming facilities;

- To cooperate with the Provincial Department of Agriculture and Rural Development Inspectorate to handle organizations and individuals violating the provisions of this Circular and other laws related to farming and animal health.

d) Monitor and urge the implementation of Decision No. 394/QD-TTg dated March 13, 2006, of the Prime Minister and this Circular; implement reporting requirements to the provincial People's Committee as prescribed.

6. Effective Date

This Circular shall take effect fifteen days after its publication in the Official Gazette.

During implementation, if any issues arise or difficulties occur, the provincial People's Committees of centrally governed cities and related agencies are requested to promptly report in writing to the Ministry of Agriculture and Rural Development for timely review, amendment, and supplementation./.
