Decree No. 42/2007/NĐ-CP on the ranks of officers and non-commissioned officers in the People's Police Force

DECREE

REGULATING THE RANKS OF OFFICERS AND WARRANT OFFICERS

within the People's Public Security force

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Public Security Law dated November 29, 2005;

Considering the proposal of the Minister of Public Security,

DECREE:

Article 1

1. The rank system for officers holding basic positions in the People's Public Security Force shall be implemented in accordance with the provisions of Clause 1, Article 24 of the Law on the People's Public Security, specifically as follows:

a) Platoon Leader: Second Lieutenant, First Lieutenant, Captain;

b) Company Commander: First Lieutenant, Captain, Major;

c) Battalion Commander: Captain, Major, Lieutenant Colonel;

d) Regiment Commander, Chief of Police in a commune, town, Team Leader: Lieutenant Colonel, Colonel;

e) Brigade Commander, Chief of Police in a district, city district, provincial city, Department Head: Colonel, Senior Colonel;

f) Director of Provincial Police, Director of Police in a centrally governed city, Chief of Security Guard: Senior Colonel, Colonel;

g) General Director of a General Corps, Chief of Security Guard: Colonel, Senior Colonel;

h) Minister: Senior Colonel, Colonel General;

i) Minister: Colonel General, General.

2. For officers holding basic positions in units assigned with important or special tasks or in areas with significant security and public order importance, the highest rank may be one level higher than the highest rank specified for corresponding positions under points a, b, c, d, e, and f of Clause 1 of this Article.

The Minister of Public Security shall specify equivalent positions to basic positions and corresponding ranks within the People's Public Security Force; units assigned with important or special tasks within the People's Public Security Force and areas with significant security and public order importance.

3. The rank of Deputy positions is lower or equal to the rank of Head positions.

Article 2. Officers who meet the criteria, reach the term for promotion to a higher rank but have already reached the highest rank of their current position shall be considered for salary increase according to the Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the salary system for cadres, civil servants, public officials, and armed forces personnel.

Article 3. The ranks of officers and warrant officers not holding leadership or command positions shall be regulated by the Minister of Public Security.

Article 4. This Decree shall take effect 15 days from the date of publication in the Official Gazette and shall replace Decree No. 306/HĐBT dated October 7, 1991 of the Council of Ministers (now the Government) regulating the ranks of positions in the People's Public Security Force.

Article 5. The Minister of Public Security shall be responsible for guiding and detailing the implementation of this Decree.

The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under the direct jurisdiction of the central government shall be responsible for implementing this Decree.
