THE MINISTER OF HEALTH
Pursuant to Decree No. 49/2003/NĐ-CP dated May 15, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
Pursuant to Decree No. 179/2004/NĐ-CP dated October 21, 2004 of the Government stipulating state management over product quality;
Pursuant to Decision No. 11/2005/QĐ-TTg dated January 12, 2005 of the Prime Minister promulgating the operational regulations of the Lao Bao Special Economic Zone and Special Trade Zone, Quang Tri Province;
Considering the proposal of the People's Committee of Quang Tri Province at Document No. 2442/UBND-TM dated September 28, 2007 regarding the delegation of cosmetic inspection functions at the Lao Bao Special Economic Zone and Special Trade Zone, Quang Tri Province;
Considering the proposal of the Director of the Drug Administration of Vietnam;
DECISION:
Article 1. The Ministry of Health delegates to the Management Board of the Lao Bao Special Economic Zone and Special Trade Zone, Quang Tri Province, the function of managing cosmetics within the Lao Bao Special Economic Zone and Special Trade Zone, Quang Tri Province.
Article 2. The Management Board of the Lao Bao Special Economic Zone and Special Trade Zone, Quang Tri Province shall coordinate with the Department of Health of Quang Tri Province to organize guidance, inspection, and supervision of cosmetic business activities within the Lao Bao Special Economic Zone and Special Trade Zone, Quang Tri Province.
The Management Board of the Lao Bao Special Economic Zone and Special Trade Zone, Quang Tri Province shall be responsible for coordinating with the authorities of Quang Tri Province and relevant agencies to effectively enforce anti-smuggling measures, prevent the sale of smuggled goods, and illegal trade in cosmetics related to the operations of the Lao Bao Special Economic Zone and Special Trade Zone, Quang Tri Province.
Article 3. Organizations and individuals engaged in cosmetic business within the Lao Bao Special Economic Zone and Special Trade Zone must comply with the requirement to declare cosmetic quality standards to the Management Board of the Lao Bao Special Economic Zone and Special Trade Zone, Quang Tri Province, and must commit to full responsibility for the quality of cosmetics they sell.
Article 4. The introduction of cosmetics from the Lao Bao Special Economic Zone and Special Trade Zone into the domestic market for business purposes must be carried out in accordance with current Vietnamese laws governing imported foreign cosmetics.
Article 5. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
Article 6. The Heads of the Office and Inspectorate of the Ministry of Health, the Director of the Drug Administration of Vietnam, the Directors of the Departments of Health of Quang Tri Province, and the Heads of the Management Board of the Lao Bao Special Economic Zone and Special Trade Zone, Quang Tri Province are responsible for implementing this Decision.
