PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Education Law 2005 and the Law Amending and Supplementing Certain Articles of the Education Law 2009;

Pursuant to Resolution No. 35/2009/QH12 dated June 19, 2009 of the National Assembly on the policy orientation for reforming certain financial mechanisms in education and training from the 2010-2011 academic year to the 2014-2015 academic year;

Considering the proposal of the Minister of Education and Training,

DECISION:

Article 1. Scope and Applicability

Maintaining the preferential allowance system for teachers teaching at public preschool and general education institutions who have been assigned, detailed, or transferred (hereinafter referred to collectively as "assigned") with effective time from September 1, 2010 to May 31, 2015 to work at Departments of Education and Training under districts, towns, cities directly under provinces, and centrally-administered municipalities (hereinafter abbreviated as "Department of Education and Training"); Departments of Education and Training under provinces, centrally-administered municipalities (hereinafter abbreviated as "Department of Education and Training"), without holding leadership positions and not receiving leadership position allowances, to support teachers in overcoming difficulties during the initial period of implementing the assignment decision.

Article 2. Level of maintained preferential allowance

Is the level of preferential allowance that teachers are currently enjoying at preschool and general education public institutions before being assigned to work at the Department of Education and Training, Department of Education and Training.

Article 3. Duration of maintenance

The duration of maintaining the preferential allowance regime prescribed in this Decision is the actual working time of teachers at the Department of Education and Training, Department of Education and Training, not exceeding 36 months.

Article 4. Calculation method

The maintained preferential allowance of one month = [Current rank and grade salary coefficient + seniority bonus above ceiling (if any)] x general minimum wage x maintained preferential allowance rate.

Article 5. Effective Date

This Decision takes effect from October 1, 2011.

2. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under central cities shall be responsible for enforcing this Decision.
