CIRCULAR

Guidelines for issuing Vietnam-Cambodia border crossing permits

for Vietnamese officials, employees, and workers traveling to Cambodia

Pursuant to the Agreement on the Regime of the Land Border between the Socialist Republic of Vietnam and the Kingdom of Cambodia signed on July 20, 1983;

Pursuant to Resolution No. 61/NQ-CP dated December 17, 2010 of the Government on simplifying administrative procedures within the scope of management functions of the Ministry of Public Security;

Pursuant to Decree No. 77/2009/NĐ-CP dated September 15, 2009 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

The Ministry of Public Security issues guidelines for issuing Vietnam-Cambodia border crossing permits for Vietnamese officials, employees, and workers traveling to Cambodia as follows:

Article 1. Scope of Regulation

This Circular guides the procedures for issuing Vietnam-Cambodia border crossing permits (hereinafter referred to as border crossing permits); specifies the subjects eligible for border crossing permits; the validity period and scope of use of border crossing permits; the value of use of border crossing permits and promulgates the model "Border Crossing Permit" and the model "Application Form for Border Crossing Permit" (Form TK6).

Article 2. Subjects Eligible for Border Crossing Permits

Officials, employees, and workers from provinces sharing a land border with Cambodia; officials, employees, and workers from central agencies and other provinces with offices located in provinces sharing a land border with Cambodia who have the need to travel to the adjacent border province of Cambodia for work purposes.

Article 3. Validity Period and Scope of Use of Border Crossing Permits

1. Each individual receives a separate border crossing permit valid for no more than 12 months from the date of issuance and cannot be extended.

2. The border crossing permit is only valid for use within the adjacent border province of Cambodia.

3. Officials, employees, and workers holding border crossing permits may enter and exit through the nearest border gate.

Article 4. Documents Required for Application for Border Crossing Permits

The documents include:

- One Application Form for Border Crossing Permit according to Form TK6 issued under this Circular, confirmed and stamped with a superimposed photograph by the direct managing authority;

- Two photographs measuring 4x6 cm, facing forward, bareheaded, with a white background, one of which is affixed to the application form.

In case of reissuing a border crossing permit, the previously issued permit must be returned if it still has remaining validity.

Article 5. Place of Acceptance of Applications and Time Limit for Processing Border Crossing Permit Applications

1. Officials, employees, and workers requiring border crossing permits shall submit their applications at the Exit and Entry Management Department of the Public Security Bureau of the province sharing a border with Cambodia where they have their office.

Officials, employees, and workers may entrust their organizations, entities, or enterprises to submit the application and receive the result. If applying for multiple persons, a list signed and stamped by the organization, entity, or enterprise must be attached. When submitting the application and receiving the result, staff members must present an introduction letter and their identity card.

2. The time limit for processing border crossing permit applications is three working days from the date all required documents are received.

3. Officials, employees, and workers who are granted border crossing permits must pay the prescribed fee as stipulated by the Ministry of Finance.

Article 6. Implementation Organization

1. The Immigration Management Department is responsible for:

- Organizing the printing and management of blank border crossing permits according to the model issued under this Circular; providing blank border crossing permits upon request of the Public Security Bureaus of provinces sharing a border with Cambodia.

- Guiding the Public Security Bureaus of provinces sharing a border with Cambodia on the issuance of border crossing permits and resolving any issues arising during the implementation of this Circular.

- Organizing inspections and monitoring the implementation of this Circular at the Public Security Bureaus of provinces sharing a border when requested.

2. The Public Security Bureau of provinces sharing a border with Cambodia is responsible for:

- Allocating personnel, equipment, and facilities to ensure the acceptance, processing of applications, delivery of results, and transmission of data on border crossing permit issuance to the Immigration Management Department.

- Organizing the printing of the Application Form for Border Crossing Permit according to Form TK6 issued under this Circular to provide for officials, employees, and workers requiring border crossing permits.

Article 7. Effective Date

1. This Circular takes effect from August 14, 2011.

2. The heads of the General Departments, heads of units directly under the Ministry, Directors of Public Security Bureaus of provinces and centrally-administered cities, and Directors of Fire Prevention and Control Departments are responsible for implementing this Circular.

During the implementation process, if any issues arise, local public security units, relevant agencies, and organizations should report them to the Ministry of Public Security (through the Immigration Management Department) for timely guidance./.
