AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF THE CIRCULAR NO. 23/2014/TT-BTTTT OF DECEMBER 29, 2014 ISSUED BY THE MINISTER OF INFORMATION AND COMMUNICATIONS PROVIDING GUIDELINES FOR IMPLEMENTATION OF CERTAIN PROVISIONS OF THE PUBLICATION LAW AND DECREE NO. 195/2013/NĐ-CP OF NOVEMBER 21, 2013 OF THE GOVERNMENT PROVIDING GUIDELINES FOR IMPLEMENTATION OF CERTAIN PROVISIONS OF THE PUBLICATION LAW

Based on the Law on Publishing dated November 20, 2012;

Pursuant to Decree No. 195/2013/NĐ-CP of November 21, 2013 of the Government providing guidelines for implementation of certain provisions of the Publication Law;

Pursuant to Decree No. 17/2017/NĐ-CP dated February 17, 2017, issued by the Government, on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

At the proposal of the Director of the Publishing, Printing, and Distribution Department,

The Minister of Information and Communications issues this Circular amending and supplementing certain articles of Circular No. 23/2014/TT-BTTTT of December 29, 2014 issued by the Minister of Information and Communications providing guidelines for implementation of certain provisions of the Publication Law and Decree No. 195/2013/NĐ-CP of November 21, 2013 of the Government providing guidelines for implementation of certain provisions of the Publication Law.

Article 1. Amending and supplementing certain provisions of Circular number

1. Amending and supplementing Clause 1 Article 24 as follows:

“1. Within fifteen days from the date of receipt of the project on publishing activities and electronic publication distribution of the publisher, organization, or individual as stipulated at Point a Clause 1 Article 18 of Decree No. 195/2013/NĐ-CP, the Publishing, Printing, and Distribution Department shall be responsible for examining the suitability and the ability to meet the conditions prescribed in Article 17 of Decree No. 195/2013/NĐ-CP reflected in the project and provide a written review. In case the project does not conform to the model or lacks information according to the prescribed model, it must be returned for the publisher, organization, or individual to supplement and complete.”

2. Supplement Article 26a as follows Article 26 as follows:

“Article 26a. Digital format of electronic publications submitted for deposit in the form of records in data storage devices or submitted for deposit via the Internet

The digital format of electronic publications submitted for deposit in the form of records in data storage devices or submitted for deposit via the Internet as prescribed in Clause 1 Article 21 of Decree No. 195/2013/NĐ-CP is as follows:

1. The file format of electronic publications presented in the form of printed books, calendars is “PDF”; in the form of paintings, photographs, maps, posters, loose sheets, folded sheets is “JPEG”; in the form of audio recordings with content replacing books or illustrating books is “MP3”; in the form of video recordings with content replacing books or illustrating books is “MP4”;

2. Converting other formats of electronic publications to the formats prescribed in Clause 1 of this Article must ensure that the content of the electronic publications is not altered.”

Article 2. Issuing a model project on publishing/distributing electronic publications

A model project on publishing/distributing electronic publications is hereby issued along with this Circular.

This Circular takes effect from December 25, 2025/.

The Director of the Office, the Director of the Publishing, Printing, and Distribution Department, the Directors of Provincial Departments of Information and Communications under the Central Government; the Directors of publishers and organizations, individuals related to publishing and distributing electronic publications are responsible for implementing this Circular.

During the implementation process, if there are arising issues or difficulties, please reflect them in writing to the Ministry of Information and Communications (through the Publishing, Printing, and Distribution Department) for consideration and resolution.

Article 4. Implementation provisions

1. This Circular takes effect from March 1, 2018.

2. Repeal Appendix V Item 02 issued together with Circular No. 23/2014/TT-BTTTT of December 29, 2014 issued by the Minister of Information and Communications providing guidelines for implementation of certain provisions of the Publication Law and Decree No. 195/2013/NĐ-CP of November 21, 2013 of the Government providing guidelines for implementation of certain provisions of the Publication Law.FUNCTIONS, DUTIES, POWERS, ORGANIZATIONAL STRUCTURE, OPERATIONAL REGULATIONS, AND RELATIONSHIPS OF MANAGEMENT BOARDS; DUTIES, POWERS OF THE CHAIRPERSON, VICE CHAIRPERSON (IF ANY), SECRETARY, AND MEMBERS OF MANAGEMENT BOARDS1. Publishers or organizations, individuals holding registration confirmation for publishing and distributing electronic publications before this Circular takes effect may continue their activities from the date this Circular takes effect without having to re-register for publishing and distributing electronic publications.

Article 5. Transitional Provisions

2. In cases where publishers or organizations, individuals have submitted projects on publishing and distributing electronic publications to the Ministry of Information and Communications (Publishing, Printing, and Distribution Department) before this Circular takes effect but the content of the project does not comply with the provisions of this Circular, they must revise it accordingly.

a) The list of servers located in Vietnam, and other equipment to serve the purpose of publishing and distributing electronic publications on the Internet, including at least the following information: name of server/computer/equipment, configuration, year of production, manufacturer, country of production, quantity, quality (new/used), installation location (including IP address for servers), management/staff operating, function/feature usage;June 2024;healthcare."b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."b) The list of equipment and software to serve the purpose of designing, formatting, and recording data on electronic media, including at least the following information: name of equipment/software, configuration (for equipment), year of production, manufacturer, country of production, version (for software), quantity, quality (new/used/upgraded), installation/location, management/staff operating, function/feature usage.n lFor software serving the purpose of designing, formatting, and recording data on electronic media, a general description and explanation must be provided; provide design documentation or equivalent documents. đc) The list of equipment for transmitting electronic publications that have been digitized, formatted, and stored on electronic media, including at least the following information: name of equipment, configuration, year of production, manufacturer, country of production, quantity, quality (new/used), installation location, management/staff operating, function/feature usage;Deputy ministers of ministerial-level agencies,d) Documentation proving the legal registration of Internet connection routes for publishing and distributing electronic publications on the Internet;of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairse) Explanation of technical solutions to control the publication and distribution of electronic publications, including issuance, removal, or restoration for issuance;No. f) List of equipment for statistics and management of the number of published and distributed electronic publications, including at least the following information: name of equipment, configuration, year of production, manufacturer, country of production, quantity, quality (new/used), installation location, management/staff operating, function/feature usage;n l g) Description and general explanation of the storage system ensuring technical requirements for storing published and distributed electronic publications; provide design documentation or equivalent documents.无效 Explain how authenticity, integrity, security, and immediate accessibility requirements are ensured for stored electronic publications.June 2024;h) Documentation proving the existence of a legally valid digital certificate according to the provisions of the Law on Electronic Transactions;

5. Conditions regarding technical human resources deployment include:policies(Description of technical human resource conditions as stipulated in Clause 2, Article 17 of Decree No. 195/2013/NĐ-CP, which need to establish a list of technical human resources including at least the following information: full name, position, professional qualifications, years of experience, listing information about professional certificates in information technology of technical human resources or accompanied by copies of certificates);No.họcdevelopment6. d) Description of business procedures for determining interventions that change the content of electronic publications;đổ e) Description of compliance with technical solutions for controlling digital copyright in the activities of publishing and distributing electronic publications as stipulated in Article 25 of Circular No. 23/2014/TT-BTTTT);No. 7. Planned Vietnamese domain names for publishing and distributing electronic publications on the Internet:ê(Description of Vietnamese domain names as stipulated in Clause 4, Article 17 of Decree No. 195/2013/NĐ-CP, which need to clearly specify the following contents:No.a) Publishers implementing publication; organizations and individuals implementing distribution of electronic publications on the Internet using at least one ".vn" domain and storing information on systems with IP addresses in Vietnam;No. b) Publishers implementing publication; organizations and individuals implementing distribution of electronic publications standing as the subject registering to use the domain name;"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."c) The ".vn" domain in the proposal still has a validity period of at least six months.

In cases where there is no publication or distribution of electronic publications on the Internet, it is not necessary to describe the condition of having servers, computers, and other equipment located in Vietnam to serve the purpose of publishing and distributing electronic publications as stipulated in Point a, Clause 1, Article 17 of Decree No. 195/2013/NĐ-CP; it is not necessary to describe technical measures.

Explanation on ensuring requirements for authenticity, integrity, information security, and immediate accessibility from the time of creation of stored electronic publications;

h) Documentation proving the existence of a legally valid certificate

5. Conditions regarding technical personnel to be deployed include:"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."(Describe the conditions regarding technical personnel as stipulated in Clause 2, Article 17 of Decree No. 195/2013/ND-CP, which need to establish a list of technical personnel including at least the following information: full name, position, professional qualifications, years of experience, listing information about professional certificates in information technology for technical personnel or attached copies of such certificates);

7. Proposed Vietnamese domain names for publishing and distributing electronic publications: ........
