DECISION OF THE PRIME MINISTER

Regarding the investment policy for the project to restore and improve Vietnam's fisheries infrastructure 

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Considering the report of the Ministry of Fisheries (No. 975/TTr-KHĐT dated June 12, 1995) requesting approval of the preliminary feasibility study report on the project to restore and improve Vietnam's fisheries infrastructure and the assessment opinion of the State Appraisal Council (Circular No. 2319-VPTĐ dated July 17, 1995 of the State Planning Commission);

 

DECISION:

Article 1. Approve the investment policy for the project to Restore and Improve Vietnam's Fisheries Infrastructure with the following contents:

1. Project name: Restore and Improve Vietnam's Fisheries Infrastructure.

2. Objectives of the project: To restore, upgrade and construct 10 fishing ports in nine provinces and cities to provide additional berthing space for 3,500 vessels; increase port capacity for marine product handling to 35,000 tons per year. Enhance fishing capabilities to exploit marine resources effectively in distant waters, contributing to the protection of marine resources and coastal environmental sanitation; create additional job opportunities for workers.

3. Scope and scale of the project: The project includes ten sub-projects to restore, upgrade and construct 10 fishing ports in nine provinces and cities and enhance fishing vessel capacity, specifically:

a. Restore, upgrade and construct 10 fishing ports:

Cat Ba Fishing Port - Haiphong City

Cuu Hai Fishing Port - Nghe An Province

Xuan Pho Fishing Port - Ha Tinh Province

Song Gianh Fishing Port - Quang Binh Province

Thuan Phuoc Fishing Port - Han River - Quang Nam - Da Nang Province

Phan Thiet Fishing Port - Binh Thuan Province

Tac Cau Fishing Port - Kien Giang Province

Phu Quy Fishing Port - Binh Thuan Province

Con Dao Fishing Port - Ba Ria - Vung Tau Province

Ca Mau Fishing Port - Kien Giang Province

b. Increase fishing vessel capacity above 100 horsepower per unit.

4. Investment capital for the project: Total investment capital: 71.4 million USD.

Loan from the Asian Development Bank is 57 million USD.

Domestic counterpart funds will cover the remaining amount.

The investment in infrastructure components of the fishing ports will be sourced from allocated budget funds; the investment in exploitation and business components (warehouses, seafood processing facilities, ice production, engines, equipment, and means) will be financed through loans as prescribed by the State.

Construction of fish markets, retail stores for supplies and services, cafeterias, clubs, educational and health welfare facilities shall not be funded by these loans.

Construction and upgrading of the KCS system will be funded from other balanced sources and reported to the Government.

5. All construction works and equipment purchases must go through bidding to save materials, capital, and improve project quality.

6. The maximum time to implement the project is six years, starting from the date of funding allocation.

Article 2. Task allocation:

1. The State Planning Commission shall take the lead, coordinating with the Ministry of Finance, the Ministry of Fisheries, and relevant sectors to balance the capital for the project.

2. The Ministry of Finance shall be responsible for balancing the budget to allocate domestic counterpart funds for the project according to the approved feasibility study; repay the loan when due, in accordance with international commitments on borrowing and repayment.

3. The Ministry of Fisheries, as the project manager, shall have the responsibility:

Based on the approved preliminary feasibility study, coordinate with localities where the projects are located to guide investors in preparing feasibility reports for each sub-project separately, conduct project review according to current regulations, ensuring control within the total investment capital determined in Clause 4 of Article 1 of this Decision.

Organize project management, implement investment in fishing port infrastructure, ensure quality, timely completion, compliance with regulations, and project acceptance and settlement, put the project into effective use.

Negotiate with the Asian Development Bank along with relevant ministries to transfer the planned investment capital for the KCS system to supplement the infrastructure construction of fishing ports, or lend to fishermen to develop production.

4. The Vietnam Agricultural Bank shall take the lead, coordinating with the Ministry of Fisheries and localities, to consider lending to fishermen and seafood production and trading enterprises part of the loan from the Asian Development Bank to purchase engines and build non-infrastructure components of the fishing ports as per the project program, ensuring recovery and repayment to the state budget to settle foreign debt.

5. Chairmen of People's Committees in provinces and cities where sub-projects are located shall designate project investors; coordinate with the Ministry of Fisheries, the Ministry of Finance, and relevant ministries and sectors to prepare domestic counterpart funds for construction; resolve land, relocation, resettlement, and compensation procedures for people affected by the project in accordance with current regulations, and closely cooperate with the Ministry of Fisheries to implement the project smoothly.

Article 3. - This Decision takes effect from the date of signature. The Minister of Fisheries, Ministers of relevant Ministries, Heads of agencies at the level of Ministries, agencies under the Government, and Chairmen of People's Committees of provinces and cities concerned are responsible for implementing this Decision.
