Regarding the establishment of the Industrial Zone Management Board of Tra Vinh Province

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 36/CP dated April 24, 1997 of the Government promulgating the Regulations on Industrial Zones, Export Processing Zones, and High-Tech Zones;

Considering the proposal of the Chairman of the People's Committee of Tra Vinh Province and the Minister of Home Affairs,

Article 1. The Industrial Zone Management Board of Tra Vinh Province is established under the Tra Vinh Provincial People's Committee to manage industrial zones within the territory of Tra Vinh Province.

The Industrial Zone Management Board of Tra Vinh Province shall have legal personality, bank accounts, offices, and seals with the national emblem; it shall be the focal point for budget planning of the Tra Vinh Provincial People's Committee and shall be allocated construction funds from the state budget separately. The staffing and operating expenses of the Board shall be included in the provincial government's state budget.

Article 2. Tasks and Powers

The Industrial Zone Management Board of Tra Vinh Province shall be responsible for performing tasks and exercising powers related to the management of industrial zones as stipulated in Article 27 of the Regulations on Industrial Zones, Export Processing Zones, and High-Tech Zones issued together with Decree No. 36/CP dated April 24, 1997 of the Government.

Article 3. Organizational Structure and Staffing

1. Organizational Structure:

a) The Industrial Zone Management Board of Tra Vinh Province shall have a Director appointed by the Prime Minister; several Deputy Directors and some members shall be appointed by the Chairman of the Tra Vinh Provincial People's Committee upon the recommendation of the Board Director.

b) The Industrial Zone Management Board of Tra Vinh Province shall have an organizational structure as specified in Article 28 of the Regulations on Industrial Zones, Export Processing Zones, and High-Tech Zones issued together with Decree No. 36/CP dated April 24, 1997 of the Government, specifically including:

- Office;

- Inspection;

- Specialized departments.

Depending on the specific development requirements of industrial zones in Tra Vinh Province at different stages, the Director of the Tra Vinh Provincial Industrial Zone Management Board shall submit proposals on organizational structures to the Chairman of the Tra Vinh Provincial People's Committee for decision within their authority.

c) Affiliated units.

2. Staffing:

The staffing of the Industrial Zone Management Board of Tra Vinh Province includes the Director, specialized Deputy Directors, and the staffing of the office, inspection department, and specialized departments, which are civil service positions.

The staffing of the Industrial Zone Management Board of Tra Vinh Province shall be decided by the Chairman of the Tra Vinh Provincial People's Committee in accordance with Decree No. 71/2003/NĐ-CP dated June 19, 2003 of the Government on decentralization of administrative and public service staffing management and Decree No. 112/2004/NĐ-CP dated April 8, 2004 of the Government on the mechanism for managing staffing for public institutions.

Article 4: This Decision shall take effect fifteen days after its publication in the Official Gazette.

Article 5: The Ministers, Heads of ministerial-level agencies, Heads of central agencies under the Government, the Chairman of the Tra Vinh Provincial People's Committee, and the Director of the Tra Vinh Provincial Industrial Zone Management Board are responsible for implementing this Decision./.
