Regarding the issuance of the Interim Regulation on the Examination for Recruitment of Civil Servants
into the Ministry of Industry's agencies
THE MINISTER OF INDUSTRY
Pursuant to the Government Decree No. 74/CP dated November 1, 1995 on the functions, tasks, powers, and organizational structure of the Ministry of Industry;
Pursuant to Decree No. 95/1998/NĐ-CP dated November 17, 1998 of the Government on the recruitment, utilization, and management of civil servants;
Pursuant to Circular No. 04/1999/TT-TCCP dated March 20, 1999 guiding the implementation of Decree No. 95/1998/NĐ-CP; the Regulation on the organization of competitive examinations and promotion examinations for civil servants issued together with Decision No. 466/1998-QĐ-TCCP-BCVC dated September 5, 1998 of the Minister, Head of the Personnel Organization Department of the Government;
At the suggestion of the Director of the Department of Organization and Cadres,
DECISION:
Article 1. The Interim Regulation on the Examination for Recruitment of Civil Servants into the Ministry of Industry's agencies is hereby promulgated along with this Decision.
Article 2. THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER THE DATE OF SIGNATURE.
The Heads of the Ministry’s Office, the Inspectorate, the Heads of Departments, and the Chairperson of the Civil Service Competitive Examination Board shall be responsible for implementing this Decision.
INTERIM REGULATION
REGULATION ON THE EXAMINATION FOR RECRUITMENT OF CIVIL SERVANTS INTO THE MINISTRY OF INDUSTRY'S AGENCIES

PART I
GENERAL PROVISIONS
Article 1. This Regulation shall apply to the examination for recruitment of civil servants into the Ministry of Industry's agencies.
Article 2. The organization of the examination for recruitment of civil servants into the Ministry of Industry's agencies must be based on the staffing quota, the need for job positions, and the vocational standards of the civil servant grade to be recruited.
Article 3. The examination for recruitment of civil servants into the Ministry of Industry's agencies must ensure principles of transparency, fairness, and quality; all citizens meeting the conditions (as stipulated in Article 5 of this regulation) are eligible to participate in the examination.
Article 4. The organization of the examination for recruitment of civil servants into the Ministry of Industry's agencies shall be carried out by the Civil Service Competitive Examination Board (HĐTTCC) of the Ministry of Industry.
Article 5.
1. Those candidates participating in the examination for recruitment of civil servants into the Ministry of Industry's agencies (referred to collectively as candidates) must meet the following conditions:
a) They must be civil servants who have worked continuously for at least five years in other agencies or units outside the Ministry, or they must be employees who were assigned before the issuance of Decree No. 26/CP dated May 23, 1993 of the Government temporarily regulating the new salary system in enterprises, and they must voluntarily submit an application to participate in the examination;
b) They must be under 40 years old for women and under 45 years old for men, and they must have graduated from university or higher;
c) They must have a clear record, and they must possess all certificates and diplomas required according to the vocational standards of the civil servant grade to be recruited;
d) They must be in good health to undertake the assigned tasks;
e) They must not be under disciplinary action or criminal investigation.
2. The personal file of each candidate must be established and submitted to the Secretary of the HĐTTCC of the Ministry of Industry, including:
a) An application to participate in the examination with the approval of the competent authority agreeing to transfer;
b) A resume confirmed by the directly managing agency;
c) Copies of certificates and diplomas required according to the vocational standards of the civil servant grade to be recruited, confirmed by the relevant agency (copies of the training diploma must be notarized);
d) A health check report confirmed by a competent medical authority (a district-level hospital or higher);
e) Two envelopes with stamps and the recipient's address clearly marked; two photographs measuring 4x6 cm.
f) Each candidate's application file for participation in the examination for recruitment of civil servants must be placed in a separate envelope and submitted to the Civil Service Examination Board of the Ministry of Industry (as stipulated in Article 6 of the Interim Regulation on the Examination for Recruitment of Civil Servants into the Ministry of Industry's agencies).
Chapter II
ORGANIZATION OF THE EXAMINATION
Article 6. Based on the staffing quota, the need for job positions, and the vocational standards of the civil servant grade to be recruited, the Department of Organization and Cadres will coordinate with the unit requiring recruitment to conduct preliminary screening of candidates applying for the examination; the results of the assessment and evaluation of each candidate will be sent to the Secretary of the Board for consolidation and submission to the Civil Service Competitive Examination Board.
Article 7. Quarterly, upon the Secretary's proposal, the Chairman of the Board will convene a meeting to examine and recruit civil servants into the Ministry.
Article 8. The examination for recruitment of civil servants will be conducted individually, comparing each candidate's file with the vocational standards of the civil servant grade to be recruited to select suitable candidates. If multiple candidates meet the same vocational standards for the same position, priority will be given in the following order:
1. Candidates with higher academic qualifications;
2. Candidates with better graduation grades;
3. Candidates with higher proficiency in foreign languages;
4. Children of current staff members;
5. War invalids, children of martyrs, and children of war invalids of Class I/IV and Class II/IV;
6. Candidates with longer service tenure.
Article 9.
Within ten days after organizing the examination, the HĐTTCC must report the examination results to the Ministry for consideration and decision; within twenty-five days after the examination, the HĐTTCC of the Ministry must notify the candidates of the results.
Chapter III
IMPLEMENTATION
Article 10.
1. The Ministry’s Office, the Inspectorate, and the Departments shall register the number of civil servants needed for recruitment with the Secretary of the Board at the beginning of each quarter to consolidate and submit to the HĐTTCC for examination at the end of the quarter.
2. The Heads of the Ministry’s Office, the Inspectorate, and the Department Heads shall be responsible for implementing this Regulation.
3. Any recruitment of civil servants into the Ministry's agencies that does not follow the prescribed procedures or violates the provisions of this Regulation shall result in the cancellation of the recruitment results.
