At the proposal of the Minister of Agriculture and Rural Development;
The Prime Minister issues this Decision to regulate the implementation schedule for national technical standards on vehicle emissions for motor vehicles participating in road traffic.
Article 1. Scope of Regulation
This Decision regulates the implementation schedule for national technical standards on vehicle emissions for motor vehicles (equipped with forced combustion engines and compression ignition engines) participating in road traffic within the territory of Vietnam.
Article 2. Applicability
Article 1. This Decision applies to organizations and individuals related to the management, inspection, and use of motor vehicles (equipped with forced combustion engines and compression ignition engines) participating in road traffic in Vietnam.
Article 2. This Decision does not apply to:
a) Motor vehicles registered abroad that are allowed by competent authorities to enter Vietnam temporarily for transit, temporary importation, re-exportation for a limited period to participate in conferences, exhibitions, sports events, and tourism;
b) Motor vehicles under the management of the Ministry of Defense and the Ministry of Public Security used for defense and security purposes.
Article 3. Explanation of Terms
Emission levels (including Level 1, Level 2, Level 3, Level 4, Level 5) are the emission levels for motor vehicles prescribed in the National Technical Standard on Vehicle Emissions for Road Traffic issued by the Ministry of Agriculture and Rural Development.
Article 4. Implementation Schedule for National Technical Standards on Vehicle Emissions for Road Traffic
Clause 1. Motor vehicles produced before 1999 shall comply with Level 1 from the date this Decision takes effect.
Clause 2. Motor vehicles produced from 1999 to 2016 shall comply with Level 2 from the date this Decision takes effect.
Clause 3. Motor vehicles produced from 2017 to 2021 shall comply with Level 3 from the date this Decision takes effect.
For motor vehicles produced from 2017 to 2021 participating in traffic in Hanoi and Ho Chi Minh City, they shall comply with Level 4 from January 1, 2027.
Clause 4. Motor vehicles produced from 2022 shall comply with Level 4 from the date this Decision takes effect; and comply with Level 5 from January 1, 2032.
For motor vehicles produced from 2022 participating in traffic in Hanoi and Ho Chi Minh City, they shall comply with Level 5 from January 1, 2028.
Clause 5. From January 1, 2029, motor vehicles participating in traffic in Hanoi and Ho Chi Minh City must meet the emission standards from Level 2 onwards.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
Article 5. Responsibilities
Clause 1. The Ministry of Agriculture and Rural Development shall be responsible for:
a) Guiding the implementation of this schedule;
b) Based on actual conditions, continue researching and developing regulations to enhance national technical standards on vehicle emissions for road traffic, and submit to the Prime Minister for publication of the next schedule.
Clause 2. The Ministry of Construction shall organize the inspection, certification, and designation of signs indicating compliance with the emission standards set forth in this Decision; supervise vehicle inspection centers to ensure compliance with this Decision during safety and environmental inspections.
Clause 3. The Ministry of Industry and Trade shall coordinate with relevant ministries and sectors to ensure the production, importation, and supply of fuels for motor vehicles in accordance with national technical standards on gasoline, diesel fuel, biofuel, and consistent with the emission standards and implementation schedules specified in this Decision.
Clause 4. The Ministry of Science and Technology shall be responsible for:
a) Researching and reviewing national technical standards on fuels to amend and supplement them in line with the implementation schedules for emission standards specified in this Decision;
b) Reviewing regulations on the recognition and designation of organizations for emission testing and calibration according to laws on measurement to amend and supplement them in line with the implementation schedules for emission standards specified in this Decision.
Clause 5. The Ministry of Finance shall coordinate to propose tax, fee, and financial support policies to encourage users to replace or switch to environmentally friendly vehicles.
Clause 6. The Ministry of Public Security shall organize inspections and control to ensure compliance with the corresponding emission levels stipulated in this Decision; handle violations according to the law.
Clause 7. Ministries, agencies at the level of ministries, and government agencies shall cooperate with the Ministry of Agriculture and Rural Development and the Ministry of Construction based on their functions and tasks to implement this Decision.
Clause 8. People's Committees of provinces and cities shall be responsible for:
a) Implementing this Decision; coordinating with the Ministry of Science and Technology to manage, inspect, and monitor fuel quality when circulating in the market;
Article 6. Effectiveness and Transitional Provisions
1. This Decision shall take effect from March 1, 2026.
2. Motor vehicles that have been issued valid certificates of technical quality and environmental protection inspection shall continue to operate until their next inspection period, when they must comply with the emission standards set forth in this Decision.
3. Types of motor vehicles produced or assembled based on certificates of technical quality and environmental protection issued before January 1, 2022, up to the expiration date of such certificates, and newly produced or assembled motor vehicles from chassis with driver's cabins that have been issued certificates of technical quality and environmental protection shall be subject to emission levels equivalent to those for motor vehicles produced from 2017 to the end of 2021.
4. The Prime Minister’s Decision No. 16/2019/QĐ-TTg dated March 28, 2019, regarding the phased implementation of emission standards for motor vehicles participating in traffic and imported used motor vehicles, is hereby repealed.
5. Ministers, heads of ministerial-level agencies, heads of government agencies, Chairpersons of provincial and municipal People's Committees, organizations, and individuals concerned are responsible for implementing this Decision./.
