CIRCULAR
OF THE MINISTRY OF VETERANS AND SOCIAL AFFAIRS DECREE NO. 43/TBXH DATED NOVEMBER 2, 1981 ON SOME REGULATIONS IN PRODUCTION, EXCHANGE, ACCOUNTING, AND DISTRIBUTION OF ENTERPRISES OPERATED BY VETERANS

Enterprises operated by veterans are a form of production organization for disabled persons operating under an economic accounting method (according to Decision No. 196-CP dated October 16, 1972 of the Council of Ministers) and "managed by veterans themselves, under special leadership and assistance from the State" (according to Decision No. 284-CP dated December 23, 1974 of the Council of Ministers).

The State builds and develops these enterprises to encourage veterans to utilize their labor capabilities to stabilize and improve their living conditions by effectively using limited state subsidies to increase their income from production.

The relationship between enterprises operated by veterans and economic units, besides being equal and cooperative, also involves encouragement and assistance to create favorable conditions for economic organizations to support the production and business activities of enterprises operated by veterans. Enterprises and state and collective economic organizations must consider this as their duty and responsibility.

While implementing new policies of the State, the Ministry of Veterans and Social Affairs requests provincial People's Committees, municipalities, and centrally governed special zones when guiding enterprises operated by veterans to resolve issues related to production, exchange, accounting, and balanced distribution according to the regulations below:

1. Provincial People's Committees, municipalities, and centrally governed special zones need to pay attention to prioritizing job allocation and income to ensure the livelihood of veterans when assigning production plan targets to enterprises operated by veterans, in accordance with the provisions of Joint Circular No. 1-TT/LB dated April 10, 1975 of the State Planning Commission and the Ministry of Veterans and Social Affairs.

In addition to the production plan targets assigned by the State, enterprises should establish cooperative relationships and seek assistance from agencies, enterprises, cooperatives, collective and private organizations to directly sign economic contracts to ensure that veterans have regular employment through the utilization of equipment and capital.

For products from the planned part supplied by the State in the form of selling raw materials, purchasing products, or processing, enterprises must ensure material usage quotas, product quality, and deliver sufficient quantities to designated consumption agencies by the State.

Enterprises operated by veterans are economic organizations primarily associated with state-owned enterprises and government agencies. Therefore, for products from the planned part managed independently by the enterprise, the State encourages enterprises to sell to state-owned commerce. To avoid capital stagnation when state-owned commerce does not purchase promptly, enterprises may organize sales on the market in accordance with current State regulations.

2. In production and business operations, enterprises should focus on specialized products suitable for laborers with disabilities and weaker physical conditions. Depending on local economic development conditions, provincial People's Committees, municipalities, and centrally governed special zones may allocate stable raw material products for these enterprises to produce, invest additional technical equipment, and guide enterprises to improve specialized production tools, improve working conditions, hygiene, and safety appropriate to the characteristics of disabled workers.

3. In accounting, enterprises must accurately and strictly calculate all production costs and ensure profitable business operations. When determining enterprise prices and wholesale industrial prices, the portion of products assigned production plan targets like state-owned enterprises must follow the principles stipulated in Directive No. 153-CT dated September 18, 1981 of the Chairman of the Council of Ministers and Circular No. 4-VGNN/KHCS dated July 23, 1981 of the State Price Commission; other products must be calculated according to the provisions of Circular No. 194-CT dated October 14, 1981 of the Chairman of the Council of Ministers regarding the resolution of processing prices, procurement prices for small-scale industrial and handicraft products.

To encourage veterans to engage in productive labor, based on the price determination principles established by the Chairman of the Council of Ministers, the State Price Commission, sectors, and localities, while calculating enterprise prices for enterprises operated by veterans, they must ensure that veterans have income comparable to workers in the same profession.

4. Enterprises must fully implement the wage distribution principles outlined in Circular No. 49-TBXH. Specific wage levels depend on the production and business results of each enterprise, so each enterprise must base its application of the ratio between wages and appropriate funds on the principle of ensuring the livelihood of veterans and war invalids, taking into account the increase in living expenses, while maintaining production, implementing collective welfare priorities, and expanding enterprise production.

5. Enterprises may apply existing State reward forms for state-owned enterprises, including monetary and in-kind rewards, and according to the following provisions:

a. For cadres, civil servants, and employees dispatched by the State to assist enterprises and incorporated into the enterprise's organizational structure:

- They shall receive additional rewards equivalent to the higher salary level of the enterprise for the work assigned by the enterprise;

- They shall receive rewards according to the general system applicable to veteran members of the enterprise.

b. Rewards for external units that assist enterprises in resolving difficulties and achieving economic benefits.

c. Rewards for innovation, savings in raw materials, and rewards for units outside the industry, accounting, and production costs. Wage differential rewards, quality improvement rewards, and over-quota production rewards shall be allocated from the enterprise's reward fund and shall not exceed 10% of this fund.

During the implementation of the above provisions, the People's Committees of provinces, centrally governed cities, and special administrative-economic zones shall identify any new issues arising concerning these special enterprises and discuss with the Ministry of Veterans Affairs to promptly address them, thereby enhancing state management to ensure the stability of production and living conditions for war invalids and disabled veterans in such enterprises.
