Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decree No. 86/2002/ND-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to the Government Decree No. 49/2003/NĐ-CP dated May 15, 2003 on the functions, tasks, powers, and organizational structure of the Ministry of Health, Pursuant to the Prime Minister's Decision No. 36/2004/QĐ-TTG dated March 17, 2004 approving the National Strategy for HIV/AIDS Prevention and Control in Vietnam until 2010 and vision 2020,
Considering the proposal of the Minister of Health and the Minister of Home Affairs,
DECISION:
Article 1. Establish the National Center for HIV/AIDS Prevention and Control under the Ministry of Health based on separating the functions, tasks, powers, and organizational structure related to HIV/AIDS prevention and control from the Preventive Medicine and HIV/AIDS Prevention and Control Center. Rename the former Preventive Medicine and HIV/AIDS Prevention and Control Center to the National Preventive Medicine Center:
The National Center for HIV/AIDS Prevention and Control has legal personality, its own seal and separate account; it receives funding from the state budget and other sources according to the law; it can open an account at the State Treasury; its headquarters is located in Hanoi City.
The National Center for HIV/AIDS Prevention and Control has the English name Vietnam Administration of HIV/AIDS Control (abbreviated as VAAC).
Article 2. The National Center for HIV/AIDS Prevention and Control assists the Minister of Health in performing state management functions and organizing activities in the field of HIV/AIDS prevention and control throughout the country.
Article 3. The National Center for HIV/AIDS Prevention and Control shall have one Director, not more than three Deputy Directors; it shall be organized with departments, the number of which shall not exceed seven.
The Minister of Health shall specify in detail: the functions, tasks, powers, and organizational structure of the National Preventive Medicine Center and the National Center for HIV/AIDS Prevention and Control.
Article 4. This Decision shall take effect from the date of signing.
Article 5. The Ministers, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, and Chairmen of Provincial and Central City People's Committees are responsible for implementing this Decision./.
