REGULATIONS ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE COUNCIL FOR PREVENTIVE MEDICINE AND HIV/AIDS CONTROL

THE MINISTER OF HEALTH

Pursuant to Decree No. 49/2003/ND-CP dated May 15, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Health;

Pursuant to Circular No. 3543/VPCP-NC dated July 18, 2003 of the Office of the Government regarding the Prime Minister's opinion allowing the Council for Preventive Medicine and HIV/AIDS Control to use the national emblem seal;

At the proposal of the Director of the Department of Organization and Cadres and the Director of the Council for Preventive Medicine and HIV/AIDS Control - Ministry of Health,

DECIDES:

Article 1. To promulgate with this Decision the Regulations on the functions, tasks, powers and organizational structure of the Council for Preventive Medicine and HIV/AIDS Control.

Article 2. This Decision takes effect from the date of issuance. All previous regulations contrary to the provisions of this Decision shall be abolished.

Article 3. The Permanent Deputy Head of the Office, Heads of Departments under the Ministry of Health, Directors of the Council for Preventive Medicine and HIV/AIDS Control, and Heads of related units are responsible for implementing this Decision./.

REGULATIONS ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE

OF THE COUNCIL FOR PREVENTIVE MEDICINE AND HIV/AIDS CONTROL

I. Functions, Tasks, Powers of the Council for Preventive Medicine and HIV/AIDS Control.

1.                  1. Position and functions of the Council.

1.1. The Council for Preventive Medicine and HIV/AIDS Control is a specialized management agency under the Ministry of Health, assisting the Minister of Health in performing state management functions and enforcing laws, directing professional activities in the fields of preventive medicine, HIV/AIDS prevention and control, and border health quarantine throughout the country.

1.2. The Council has legal personality, maintains a bank account, uses the national emblem seal, and has its headquarters in Hanoi City. The operating budget of the Council is funded by the State budget and other legitimate sources.

2.                  2. Tasks and powers of the Council for Preventive Medicine and HIV/AIDS Control.

2.1.            2.1. Lead in developing strategies, planning, and plans for the following areas: Disease surveillance and control, HIV/AIDS prevention and control, border health quarantine, social disease prevention, environmental health, school health, community nutrition, occupational health and occupational diseases, accident and injury prevention; vaccine and medical product production management; chemical insecticide and disinfectant management for approval by the Minister of Health within their authority or for submission to the Government for approval.

2.2.            2.2. Develop, amend, and supplement draft Laws, Ordinances, and regulatory legal documents on preventive medicine, HIV/AIDS prevention and control, and border health quarantine for issuance by the Minister of Health within their authority or for submission to the Government; establish lists, standards, technical levels, and policies in the field of preventive medicine, HIV/AIDS prevention and control, and border health quarantine. 2.3. Manage and direct specialized activities in the preventive medicine system,

2.3.            HIV/AIDS prevention and control, and border health quarantine throughout the country. Manage and direct the professional activities of institutes under the preventive medicine system. 2.4. Lead in developing industry standards in the following areas: infectious disease prevention and control, HIV/AIDS prevention and control, border health quarantine, social disease prevention, vaccines and medical products; chemical disinfectants and insecticides in the health sector; environmental health, school health, occupational health and occupational disease prevention, accident and injury prevention; drinking water quality, domestic water supply, sanitation facilities.

2.4.            2.5. Implement legal regulatory documents on preventive medicine, HIV/AIDS prevention and control, and border health quarantine. Manage, direct, and implement measures to prevent and control diseases nationwide. Submit to the Minister of Health for approval within their authority or for the Minister to submit to the Government for approval special measures to contain epidemics according to the law. Establish annual national reserves and usage quotas for drugs, chemicals, and equipment for epidemic prevention for localities, sectors, and units. 2.6. Develop content and direct and implement health education communication activities in the fields of preventive medicine, HIV/AIDS prevention and control, and

2.5.            border health quarantine. Develop training plans and organize retraining for staff in the field of preventive medicine. Lead or coordinate with relevant units to inspect, audit, and handle violations in specialized preventive medicine activities,

Decide within their authority on issuing, suspending, or revoking licenses, certificates, registration for circulation of vaccines, medical products, chemical insecticides and disinfectants for household and health use, and border health quarantine according to the law; organize fee collection and other types of revenue. 2.9. Carry out scientific research and international cooperation in the fields of preventive medicine, HIV/AIDS prevention and control, and border health quarantine. office for HIV/AIDS prevention and control and border health quarantine in accordance with the Law.

2.10.        2.10. Managing, directing, and organizing the implementation of the following activities:

2.10.1.              2.10.1.                Environmental health, school health, and community nutrition. Building and leading campaigns to prevent diseases and improve community health. Directing the supervision of drinking water and domestic water quality.

2.10.2.  2.10.2.    Occupational health work, care for workers' health, prevention of occupational diseases, and prevention of accidents and injuries. Serving as the focal point for managing, directing specialized preventive medical activities of Ministries and sectors.

2.10.3.              2.10.3.                Managing, directing, and inspecting the production, use, export, and import of vaccines, biological products, chemicals, and medical insecticides and disinfectants. Planning the distribution of various types of vaccines and biological products.

2.11.        2.11. Managing, directing, and organizing the implementation of measures to prevent and control HIV/AIDS. Advising the Minister on inter-sectoral coordination in organizing the implementation of HIV/AIDS prevention and control work and the implementation of HIV/AIDS prevention and control projects and programs. Assisting the Minister of Health in serving as the permanent representative of the National Committee for HIV/AIDS Prevention and Control and the Prevention of Drug Addiction and Prostitution.

2.12.        2.12. Managing, directing, and organizing the implementation of technical activities in the field of border health quarantine. Building and strengthening the border health quarantine system. Advising the Minister on international cooperation and inter-sectoral coordination in border health quarantine. 2.13. Managing the organization, staff, assets, and budget allocated

Leadership of the Bureau: Includes a Director and Deputy Directors, appointed and relieved from duty by the Minister of Health. The Director is responsible to the Minister of Health for all activities of the Bureau. Deputy Directors assist the Director and are responsible to the Director for assigned tasks.

2.4     2.6. Environmental Health, School Health, and Nutrition Department.

2.5     2.7. Occupational Health, Occupational Diseases, and Accidents and Injuries Department.

2.6     3. Operational Mechanism:

2.7     The Bureau operates under the headship system.

3.      The functions, duties, and authorities of the Bureau Office and Departments are defined by the Director based on the tasks assigned by the Ministry of Health. Relationships between organizations within the Bureau are regulated by the Director.

3.1.   3.1.     Appointments and dismissals of leadership positions in the Bureau Office and Departments follow the regulations of the Ministry of Health.

3.2.   3.2.     Leaders of the Bureau, Bureau Office, and Department leaders receive allowances according to current regulations.

3.4.   3.4.     The staffing of the Bureau is determined by the Decision of the Minister of Health and adjusted annually based on work needs and the proposal of the Director./.

The staffing of the General Department is determined by the Decision of the Minister of Health and adjusted annually based on work requirements and proposals from the Director of the General Department./.
