ON THE ISSUANCE OF REGULATIONS ON THE OPERATIONS OF THE CENTRAL GUIDANCE BOARD FOR HOUSING AND LAND POLICIES 

PRIME MINISTER

Pursuant to Directive No. 346/TTg dated July 5, 1994 of the Prime Minister on the organization and implementation of Government Decrees concerning ownership rights over housing and land use rights in urban areas and the buying and selling of housing;

Pursuant to Decision No. 347/TTg dated July 5, 1994 of the Prime Minister on the establishment of the Central Guidance Board for Housing and Land Policies;

Pursuant to the conclusions of the meeting held on July 28, 1994 of the Central Guidance Board for Housing and Land Policies,

DECISION:

Article 1 The attached Decision hereby promulgates the Regulations on the operations of the Central Guidance Board for Housing and Land Policies.

Article 2. This Decision takes effect from the date of signature.

Article 3. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally governed cities, and members of the Central Guidance Board for Housing and Land Policies shall be responsible for implementing this Decision.

REGULATIONS

OPERATIONS OF THE CENTRAL GUIDANCE BOARD FOR HOUSING AND LAND POLICIES

I. TASKS AND LIMITS OF THE CENTRAL GUIDANCE BOARD FOR HOUSING AND LAND POLICIES (HEREINAFTER REFERRED TO AS THE CENTRAL BOARD)

1- The Central Board has the task of assisting the Government in researching and drafting policies regarding housing and land, while also directing the uniform implementation of these policies nationwide; periodically summarizing and evaluating the results achieved and proposing amendments and supplements to the policies in accordance with the level of economic development of the country at each stage.

2- The Central Board has the authority:

a) To convene meetings of localities and central ministries and sectors to disseminate the State's policies on housing and land;

b) To request localities and central ministries and sectors to provide data and reports on issues related to the construction and implementation of State policies on housing and land;

c) To inspect the implementation of State systems and policies on housing and land in localities and central ministries and sectors;

d) To suspend the enforcement of documents issued by localities and central ministries and sectors that contravene State systems and policies in the field of housing and land, and to recommend the Prime Minister take appropriate measures.

II. WORKING REGIME

1- The Central Board is an advisory body of the Government on housing and land policies, and is accountable to the Government for the results of the tasks assigned by the Government.

2- The Central Board operates according to the principle of democratic centralism. Members of the Central Board work on a part-time basis and are individually responsible for the areas of work assigned to them.

3- The Chairman directs the operation of the Central Board and has the authority:

- To convene meetings of the Central Board to discuss matters related to the implementation of assigned tasks.

- To approve plans and progress of the Central Board in implementing national policies on housing and land, and to urge and inspect the implementation of these plans and progress; guiding localities to organize the implementation of plans for establishing and developing regulations on the operations of local guidance boards.

- To assign tasks to individual members of the Central Board and to urge and inspect the completion of these tasks.

- To establish a permanent team to assist the Central Board in performing its functions and tasks.

- To invite experts in the field of housing management to serve as advisors to the Central Board.

- To dispatch teams of specialists to work regularly in key areas: Hanoi City, Ho Chi Minh City, Hai Phong City, and Quang Nam-Da Nang Province to urge, monitor the situation, identify emerging issues, and report to the Central Board for resolution.

- To require Central Board members to report on their work and to organize periodic reviews and summaries of the Central Board's activities.

4- The Deputy Chairman assists the Chairman in directly managing the program and plan of the Board, the activities of the permanent team, and the specialist team. In the absence of the Chairman, the Deputy Chairman will preside over the activities of the Central Board.

5- Members of the Central Board are responsible for directing the implementation of the work assigned by the Chairman and regularly reporting the results of their work to the Chairman. For issues not covered by existing policies, they must promptly report to the Chairman or bring them up at Central Board meetings for advice on resolution.

6- The permanent team of the Central Board directly implements tasks assigned by the Chairman and Deputy Chairman. They timely follow up, summarize, and distill experiences from the implementation in localities to help the Central Board provide unified guidance nationwide.

7- Advisors to the Central Board operate according to the direct requirements and delegations of the Chairman.

III. FINANCIAL REGIME AND EQUIPMENT

1- The budget of the Central Board is prepared according to the draft approved by the Chairman within the total funds allocated by the Ministry of Finance, including:

a) Costs for completing the headquarters and equipment for the Central Board and the specialist team;

b) Costs for research and drafting of documents;

c) Costs for dissemination meetings and training sessions for ministries, sectors, and localities;

d) Costs for organizing and directing implementation in localities;

e) Costs for summary and reporting;

g) Costs for office supplies and printing materials;

h) Other costs.

2- Based on the allocated funds, the Ministry of Finance annually transfers funds into the account of the National Management Agency through the Ministry of Construction and settles accounts with the Ministry of Finance according to the approved budget by the Chairman.

3- All equipment provided for the operation of the Central Board is recorded as assets of the National Management Agency - Ministry of Construction and must be managed and used according to current asset regulations.

IV. REPORTING, STATISTICAL, AND SUMMARIZATION REGIME

1- On the basis of reports regularly submitted by ministries, sectors, and localities to the Steering Committee, the Standing Working Group is responsible for compiling and reporting on the implementation results of housing and residential land policies nationwide to the Steering Committee for review and approval before submitting the report to the Government.

2- The Steering Committee meets monthly to review and draw lessons from the work results, develop plans for the following month, and propose specific measures to guide sectors and localities in effectively implementing housing and residential land policies.
