THE MINISTER OF INDUSTRY
Pursuant to the Government Decree No. 74/CP dated November 1, 1995 on the functions, tasks, powers, and organizational structure of the Ministry of Industry;
Pursuant to Decree No. 95/1998/NĐ-CP dated November 17, 1998 of the Government on the recruitment, utilization, and management of civil servants;
Pursuant to Circular No. 04/1999/TT-TCCP dated March 20, 1999 guiding the implementation of Decree No. 95/1998/NĐ-CP; the Examination Regulations and Promotion Examination Regulations for civil servants issued together with Decision No. 466/1998-QĐ-TCCP-BCVC dated September 5, 1998 of the Minister, Head of the Organization-Civil Service Department of the Government;
At the suggestion of the Director of the Department of Organization and Cadres,
DECISION:
Article 1. Issued together with this Decision are the "Interim Regulations on the Examination for Civil Servants to enter the Ministry of Industry".
Article 2. THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.
The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of the Departments, and the Chairperson of the Examination Board for Civil Servants of the Ministry shall be responsible for implementing this Decision./.
INTERIM REGULATION
ON THE EXAMINATION FOR CIVIL SERVANTS TO ENTER THE MINISTRY OF INDUSTRY
(Issued along with Decision No. 44/2001/QĐ-BCN dated October 2, 2001 of the Minister of Industry)
Chapter 1:
GENERAL PROVISIONS
Article 1. These regulations apply to all examination sessions for civil servants entering the Ministry of Industry.
Article 2The organization of examinations for civil servants to enter the Ministry of Industry must be based on staffing quotas, job position needs, and vocational standards of the civil servant grade being recruited.
Article 3. The examination for civil servants to enter the Ministry of Industry must ensure principles of transparency, fairness, and quality; every citizen meeting the required conditions may participate in the examination.
Article 4. The examination for civil servants to enter the Ministry of Industry shall be organized by the Examination Board for Civil Servants (HĐTTCC) of the Ministry of Industry.
Article 5.
1. Candidates for the examination for civil servants to enter the Ministry of Industry (referred to as candidates) must meet the following conditions:
a/ Be a citizen of the Socialist Republic of Vietnam, voluntarily submitting an application to take the examination;
b/ Age between 18 and under 35 for women and between 18 and under 40 for men;
c/ Hold a bachelor's degree or higher;
d/ Have a clear record, possess all certificates and diplomas stipulated in accordance with the vocational standards of the civil servant grade being recruited;
e/ Be in good health to undertake assigned tasks;
f/ Not be in a period of criminal investigation or currently serving a sentence.
2. The personal file of each candidate must be prepared and submitted to the HĐTTCC of the Ministry of Industry, including:
a/ An application form to take the examination (model attached);
b/ A curriculum vitae confirmed by the competent authority (local government where the candidate resides or the employer of the candidate's parents);
c/ Certificates and diplomas according to the requirements of the civil servant grade being recruited (certified copies from the competent authority);
d/ A health check-up form confirmed by a competent medical authority (hospital at district level or higher);
e/ Two envelopes with stamps and the recipient's address clearly marked; two photographs measuring 4x6 cm.
Each candidate's examination application file must be placed in a separate envelope and submitted to the Examination Board for Civil Servants of the Ministry of Industry (as specified in Article 6 of these regulations);
Article 6. 3. Candidates must pay the examination fee as prescribed by the State.
The Examination Board for Civil Servants consists of 11 members:
1/ The Chairman of the Board is the Deputy Minister in charge of the Ministry's office;
2/ The Vice-Chairman of the Board is the Head of the Personnel-Staff Department;
3/ Members include the Director of the Ministry's Office, the Inspector General of the Ministry, and the Heads of the Departments;
Article 7. 4/ The Secretary of the Board is a staff member of the Personnel-Staff Department;
The Examination Board for Civil Servants has the following powers and responsibilities:
1/ Organizing examination sessions for civil servants to enter the Ministry.
2/ Establishing the Examination Question Committee, the Examination Supervision Committee, and the Examination Grading Committee;
Chapter 2:
3/ The Examination Board and the Examination Question Committee, Examination Supervision Committee, and Examination Grading Committee operate according to the regulations set by the Chairman of the Board.
Article 8. ORGANIZATION OF THE EXAMINATION
Thirty days before organizing the examination, the Examination Board must publicly announce on mass media or post notices in public places so that everyone can know and register to take the examination.
Article 9. The announcement includes: job positions, registration conditions and standards, number of positions needed, registration time, guidance time for examination content, examination time, examination location, examination fees, and contact phone numbers.
All candidates must participate in two mandatory examination sections:
1/ Written examination,
Article 10.
2/ Oral examination.
Within 15 days after the examination, the Examination Board must report the examination results to the Ministry for review and decision on recognizing the examination results; the Examination Board must post the examination results at the examination location to inform the candidates.
If a candidate requests a recheck within three days after the announcement of the examination results, the Board is responsible for organizing the recheck and informing the candidate of the result. Any request for a recheck or appeal beyond the specified deadline will not be resolved.
The recheck committee is established by the Chairman of the Board after announcing the examination results.
Within 30 days after the examination, the Examination Board must announce the examination results and the list of successful candidates at the designated location and notify the successful candidates.
Article 11. Successful candidates are those who do not have scores below 5 in each section (on a scale of 10) and are ranked from the highest total score until the quota for each position is filled.
Regulations on preferential treatment in examinations:
1/ Heroes of Labor and Heroes of the Armed Forces are given an additional 3 points to their examination results;
2/ Graduates from specialized training institutions with excellent grades and those who are war invalids, children of martyrs, or children of war invalids of Class 1/4 or Class 2/4 are given an additional point to their examination results;
3/ Children of officials, civil servants, and employees currently working at the Ministry are given an additional 0.5 points to their examination results;
Chapter 3:
IMPLEMENTATION
Article 12.
4/ Preferential points for candidates are added after they have met the examination results criteria.
1/ Each year, the Ministry organizes one examination session for civil servants to enter the Ministry in the first quarter; the Ministry's Office, the Inspectorate, and the Departments register the number of civil servants needed through the Personnel-Staff Department in November of the previous year for consolidation and submission to the Ministry for consideration and decision.
2/ The Director of the Ministry's Office, the Inspector General of the Ministry, and the Heads of the Departments are responsible for implementing these regulations.
