THE MINISTER OF HEALTH

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 188/2007/NĐ-CP dated December 27, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

Considering the proposal of the Director of the Department of Organization and Cadres and the Director of the Department of Planning and Finance - Ministry of Health,

DECIDES:

Article 1. Position and Functions

The Department of Planning and Finance is a comprehensive department under the Ministry of Health, assisting the Minister in managing strategic, planning, investment development, health policy, financial, accounting, healthcare service fees, assets, aid, military health, and health statistics fields.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Strategic and planning development field for the health sector:

a) Taking the lead and coordinating with relevant units to develop and perfect strategic plans and development plans for the health sector for the Minister of Health to submit to competent authorities for approval;

b) Participating in providing comments and reviewing regional economic and social development plans concerning strategic and planning development issues of the health sector at the local level;

c) Directing the implementation of strategic and planning development plans for the health sector; inspecting, supervising, and compiling reports on the implementation of such approved strategic and planning development plans.

2. Planning development field for the health sector:

a) Taking the lead and consolidating annual, five-year development plans for the health sector to the Minister for approval and organizing their implementation after approval;

b) Serving as the focal point to guide subordinate health institutions under the Ministry of Health, health departments of other ministries and sectors, and provincial health departments in building and implementing annual and five-year plans consistent with strategic and planning development plans for the health sector;

c) Inspecting, supervising, and adjusting annual plans upon the Minister's approval; organizing mid-term reviews, final summaries, and reporting on the implementation of development plans for the health sector.

3. Financial and accounting work:

a) Taking the lead in developing financial mechanisms, policies, healthcare service pricing, various types of healthcare service fees, and related legal regulations on finance and accounting in the health sector, submitting them to competent authorities for issuance;

b) Taking the lead in guiding subordinate agencies and units under the Ministry, healthcare facilities under other ministries and sectors, and localities in implementing legal regulations related to finance, budget, accounting, auditing, and self-management and responsibility mechanisms;

c) Taking the lead in preparing medium-term expenditure plans; annual budget plans for the entire health sector and subordinate units under the Ministry of Health, and submitting them to the Minister;

d) Guiding subordinate agencies and units under the Ministry in preparing annual budget revenue and expenditure plans. Submitting annual budget revenue and expenditure plans and allocation proposals to the Minister; allocating and adjusting budgets for budgetary units within the scope of authority;

đ) Taking the lead in reviewing and announcing final accounts of budget expenditures for subordinate agencies and units under the Ministry. Compiling final accounts of annual budget revenues and expenditures of the Ministry according to regulations;

e) Taking the lead in organizing the inspection and supervision of financial management and accounting activities of subordinate units under the Ministry; recommending to the Minister specific actions to address violations in financial management according to the law;

g) Compiling and publicly disclosing annual state budget estimates and final account reports according to regulations;

h) Participating in continuous training and professional skill enhancement for the financial and accounting workforce in the health sector;

i) State management over finances of funds established by the Ministry according to the law;

4. Investment work:

a) Taking the lead in reviewing overall development plans for subordinate public institutions as a basis for constructing investment projects;

b) Taking the lead in formulating annual investment plans from various sources; adjusting and announcing investment plans for subordinate units under the Ministry of Health;

c) Taking the lead in reviewing final accounts of investment projects and submitting them to the Minister for approval within the scope of authority;

d) Serving as the focal point to coordinate with Departments and Bureaus in providing opinions on investment policies for health using non-budgetary funds (domestic and foreign);

5. Asset management:

a) Taking the lead and coordinating with relevant agencies and units to develop and submit standards, quotas, and usage regulations for assets serving specialized activities of units under the Ministry's jurisdiction to the Minister for issuance;

b) Organizing guidance, inspection of asset usage registration; compiling results of national asset inventory according to the law;

c) Advising and proposing solutions for asset management (reassignment, recovery, liquidation, sale) for subordinate public institutions according to the law;

d) Taking the lead in overseeing land use by subordinate units;

6. Aid management:

a) Being the focal point for state management of aid activities in the health sector, including Official Development Assistance (ODA) and Non-Governmental Organization (NGO) aid;

b) Taking the lead and coordinating with relevant units to develop legal regulations and guidelines for aid management, submitting them to competent authorities for issuance; formulating aid orientation and plans and utilizing aid and matching funds for programs and projects. Coordinating with the Department of International Cooperation and relevant units to attract foreign investment for the health sector;

c) Taking the lead in guiding relevant units on procedures for receiving foreign aid. Serving as the focal point for reviewing and submitting programs and projects for foreign aid (ODA, NGO) and other aid amounts for subordinate units under the Ministry of Health according to regulations;

d) Participating in reviewing and providing comments to review and agree on programs and projects for foreign aid (ODA and NGO), other aid amounts for the health sector of provincial people's committees directly under the central government and other ministries and sectors when requested.

đ) Serve as the coordinating entity to collaborate with ministries, sectors, and related units in monitoring, supervising, and evaluating the outcomes of programs, projects, and other forms of aid for subordinate units under the Ministry of Health;

e) Manage and guide subordinate units in managing aid funds and counterpart funds in accordance with current regulations; Approve budgets and compile reports on foreign aid for health, as well as the implementation status of aid programs managed by the Ministry of Health;

g) Collaborate with the Department of International Cooperation and related units to implement activities related to international integration in the healthcare sector (WTO, ASEAN...).

7. Regarding defense-related healthcare work:

a) Lead the implementation of legal normative documents, government directives, and the Ministry of Defense's guidelines on defense-related work within the healthcare sector;

b) Be responsible for implementing combined military-civilian healthcare activities, direct the organization of nationwide defense education propaganda and the implementation of comprehensive national defense education for officials, civil servants, employees, and workers in subordinate units under the Ministry of Health; coordinate with functional agencies under the Ministry of Defense to provide national defense knowledge training for officials, civil servants, and employees according to the Central National Defense Education Council's regulations;

c) Develop mobilization plans for wartime healthcare to be prepared to meet defense needs or other necessary situations; lead the development of reserve officer training plans, guide the registration and management of reserve officer teams in medical and pharmaceutical universities; manage the reserve medical and pharmaceutical officer teams in subordinate units under the Ministry of Health;

d) Direct subordinate units under the Ministry of Health to closely cooperate with local military agencies in organizing, training, and operating self-defense forces; organize oversight, urging, and supervision of the implementation of the Law on Military Service in the healthcare sector;

đ) Coordinate with functional agencies of the Ministry of Defense to annually and periodically conduct inspections, interim reviews of the implementation of defense tasks and combined military-civilian healthcare programs by the Ministry of Health;

e) Serve as the permanent member of the Steering Committee for Combined Military-Civilian Healthcare Project, assist the Steering Committee in implementing project activities according to the approved plan by the leadership of the Ministry;

8. Regarding healthcare statistics work:

a) Implement state management over healthcare statistics throughout the sector. Develop and uniformly manage healthcare statistical indicators, data collection methods, recording procedures, rules for providing and using data, and a unified system of statistical forms across the entire healthcare sector;

b) Build and manage the healthcare sector's database to serve planning and policy formulation. Aggregate and analyze periodic statistical data: annually, every five years, and every ten years. Compile and publish the Annual Statistical Yearbook on Healthcare; act as the main provider of healthcare statistical data for official publication both domestically and internationally;

c) Lead the guidance on statistical business practices for subordinate units under the Ministry of Health, local healthcare, and healthcare of other ministries and sectors. Organize and manage surveys and evaluations of healthcare sector activities as well as factors related to public health conditions;

d) Develop long-term and short-term plans for healthcare statistics work. Supervise the implementation of statistical work at subordinate units under the Ministry, local healthcare, and healthcare of other ministries and sectors;

e) Research and apply information technology in the field of healthcare statistics;

9. Serve as the coordinating entity to build, submit to competent authorities for review and approval the National Target Programs on Health; monitor, supervise, and report on the implementation of National Target Health Programs;

10. Be responsible for state management over tendering work in the healthcare sector; Lead the review of tenders within the Minister's approval authority (excluding construction tenders and tenders from development investment funds). Guide units in implementing tendering and procurement regulations in accordance with legal provisions;

11. Be responsible for building, compiling, and guiding localities and healthcare units to implement policies for free medical care for the poor, children under six years old, and other policy beneficiaries;

12. Propose, build, and guide healthcare units to implement socialized policies for health care and protection; organize evaluations and compile results of socialized health care policies across the sector;

13. Serve as the coordinating entity to compile and build reports on the implementation of Millennium Development Goals (MDGs) and Agenda 21 on Sustainable Development in the healthcare sector; compile the implementation of healthcare policies and programs in the Government's Poverty Reduction Support Credit Strategy (PRSC);

14. Participate in monitoring and evaluating the effectiveness of enterprise operations, enterprise valuation during ownership transfer, quota systems, unit prices, and pricing policies within the Ministry of Health's jurisdiction;

15. Perform other tasks assigned by the Minister of Health.

Article 3. Organizational Structure and Operations

1. Leadership of the Department:

The Director and Deputy Directors of the Department are appointed and relieved of duty by the Minister of Health. The Director is responsible to the Minister of Health and the law for the activities of the Department. The Deputy Directors assist the Director in overseeing and directing certain aspects of work according to the division of labor by the Director and are responsible to the Director and the law for the tasks assigned to them.

2. Organizational Structure of the Department:

a) General Affairs and Policy Section;

b) Public Financial Affairs Section;

c) Investment Section;

d) Aid Section;

đ) Health Statistics Section;

e) Defense Health Section.

3. Operation Mechanism:

a) The Planning and Finance Department operates under the head system;

b) The functions, duties, and authorities of the sections within the Department are defined by the Director based on the tasks assigned by the Minister of Health. The relationships between the sections within the Department are regulated by the Director;

c) The appointment and removal of leadership positions in the sections of the Department are carried out according to current regulations;

d) Leaders of the Department and leaders of the sections within the Department receive allowances according to current regulations.

4. Staffing:

The staffing of the Department is determined by the decision of the Minister of Health and is adjusted annually based on work needs and the proposal of the Director.

Article 4. Effective date

This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 5. Responsibilities for Implementation

The Heads of the Office of the Ministry, the Inspectorate of the Ministry, the Directors of Departments, the Directors of Bureaus, the Heads of General Departments under the Ministry of Health, and the Heads of agencies, units, and individuals concerned are responsible for implementing this Decision./.
