Circular No. 44/2015/TT-BCA on competition for students in educational correctional schools and inmates in compulsory educational facilities

Provisions on commendation for students at educational correctional schools,
inmates at compulsory educational facilities,
 

Pursuant to the Law on Handling Administrative Offenses 2012;

Pursuant to Decree No. 02/2014/NĐ-CP dated January 10, 2014 on the regime of applying and implementing administrative measures involving placement in educational correctional schools and compulsory educational facilities;

Pursuant to Decree No. 106/2014/NĐ-CP dated November 17, 2014 on the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the General Bureau of Criminal Investigation and Enforcement of Sentences and Judicial Assistance;

The Minister of Public Security issues this Circular on provisions regarding commendation for students at educational correctional schools and inmates at compulsory educational facilities.

PART I

GENERAL PROVISIONS

Article 1. Scope of application

This Circular stipulates criteria for commendation; conditions, procedures, formalities, authority to assess, evaluate, and classify commendation for students and inmates who are serving decisions on administrative measures involving placement in educational correctional schools and compulsory educational facilities.

Article 2. Applicability

This Circular applies to:

1. Students who are serving decisions on administrative measures involving placement in educational correctional schools (hereinafter referred to as students).

2. Inmates who are serving decisions on administrative measures involving placement in compulsory educational facilities (hereinafter referred to as inmates).

3. Authority having the power to classify commendation for students and inmates who are serving decisions on administrative measures involving placement in educational correctional schools and compulsory educational facilities.

4. Authorities, organizations, and individuals related to the classification of commendation for students and inmates who are serving decisions on administrative measures involving placement in educational correctional schools and compulsory educational facilities.

Article 3. Principles for assessment and classification of commendation

2. Ensuring the purpose, requirements, safety, effectiveness, and contributing to national security protection and maintaining public order and social safety.

2. Ensuring objectivity, fairness, transparency, democracy, and continuity.

3. Ensuring correct subjects, criteria, and conditions for commendation for students and inmates.

Chapter II

SPECIFIC PROVISIONS

Article 4. Criteria for commendation for students at educational correctional schools

1. Commendation criteria

a) Criterion 1

Recognizing their own mistakes, being sincere and repentant; truthfully reporting crimes and violations of the law; providing all information about their own and others' law violations that they know.

b) Criterion 2

Strictly complying with laws, regulations of educational correctional schools, and other relevant regulations; actively preventing and combating wrongful acts; practicing civilized, disciplined, orderly, and civilized behavior; not making negative statements, attitudes, or actions that adversely affect the student body or other students.

c) Criterion 3

Actively and conscientiously studying, working, learning trades, and participating in other educational programs; respecting and being polite to teachers; strictly adhering to labor discipline, safety, and hygiene; protecting property, maintaining cleanliness, and preserving the environment, promoting the commendation movement among students and within the educational correctional school.

d) Criterion 4

Actively cultivating moral character and healthy lifestyles; respecting the lives, health, dignity, and personal integrity of themselves and other students; fostering unity, mutual assistance in study and self-improvement, striving to become useful members of society.

2. Based on the commendation criteria stipulated in Clause 1 of this Article, students at educational correctional schools will be classified as excellent, good, average, and poor according to the provisions of Article 6 of this Circular.

Article 5. Criteria for competition and excellence for compulsory educational facility inmates

1. Commendation criteria

a) Criterion 1

Recognize personal mistakes, be sincere and repentant; truthfully report crimes and violations of the law; provide all information about crimes and violations of the law committed by oneself and others known to oneself.

b) Criterion 2

Strictly comply with laws, regulations of compulsory educational facilities, and directives of the Director of compulsory educational facilities; actively prevent and combat wrongful acts; maintain civilized living habits, discipline, order, and civility; refrain from negative speech, attitudes, or actions that adversely affect the inmate community or other inmates.

c) Criterion 3

Proactively and positively engage in study, work, vocational training, and other educational programs of compulsory educational facilities; fully participate in assigned workdays, complete assigned work quotas, adhere to labor discipline and safety; have a sense of protecting property, maintaining hygiene, and environmental protection within the compulsory educational facility, promoting competition and excellence among inmates.

d) Criterion 4

Actively cultivate moral character and healthy lifestyles; respect the lives, health, dignity, and personality of oneself and others; have a sense of mutual assistance in learning, working, and progressive self-improvement, striving to become useful members of society.

2. Based on the competition and excellence criteria stipulated in Clause 1 of this Article, compulsory educational facility inmates will be ranked as excellent, good, average, or poor according to the provisions of Article 6 of this Circular.

Article 6. Ranking for Competition and Excellence

1. Excellent ranking

Students and inmates who strictly follow the provisions of Articles 4 and 5 of this Circular and were previously ranked as good or excellent shall be ranked as excellent, specifically as follows:

a) Students and inmates who meet Criterion 1 stipulated in Articles 4 and 5 of this Circular must be individuals who recognize their own mistakes, sincerely report their own violations of the law accurately and completely; feel remorseful, determined to study, work, improve themselves, and correct their mistakes; truthfully report, expose, and provide all information about crimes and violations of the law committed by students, inmates, and others known to them.

b) Students and inmates who meet Criterion 2 stipulated in Articles 4 and 5 of this Circular must be individuals who strictly comply with laws, decisions to place in educational rehabilitation centers or compulsory educational facilities, internal regulations of educational rehabilitation centers or compulsory educational facilities, and directives of the Principal of educational rehabilitation centers or the Director of compulsory educational facilities; maintain civilized living habits, discipline, order, and civility; actively combat negative behaviors and wrongful acts of other students and inmates; refrain from negative speech, attitudes, or actions that distort the truth, cause division, disrupt unity, or adversely affect the collective or the progress of other students and inmates.

c) Students and inmates who meet Criterion 3 stipulated in Articles 4 and 5 of this Circular must be individuals who always demonstrate proactive, diligent awareness in studying cultural subjects, civic education, working, vocational training, and other educational programs; promote competition and excellence among students and inmates; have a sense of protecting property. The results of cultural studies, vocational training, and other educational programs must reach at least a satisfactory level. Inmates must fully participate in assigned workdays, actively engage in work with discipline, complete assigned work quotas; adhere to requirements for labor safety, hygiene, and environmental protection.

d) Students and inmates who meet Criterion 4 stipulated in Articles 4 and 5 of this Circular must be individuals who cultivate themselves according to healthy and civilized lifestyles, improve their moral qualities, strive to become useful members of society; respect the lives, health, dignity, and personality of oneself and others; encourage and assist other students and inmates in daily life, work, and study.

đ) Students and inmates required by competent authorities to pay fines under administrative penalty decisions or compensate for damages caused by their own administrative violations must pay off the full amount (with proof or confirmation from competent authorities). If not fully paid, they must actively implement, specifically as follows:

- In cases where students or inmates have partially paid fines, been granted a deferral of fine payment, or had fines reduced or waived according to Articles 76 and 77 of the Law on Handling Administrative Violations, it shall be considered as having actively implemented.

- In cases where students or inmates are required to compensate for damages to victims but have not yet done so or have only partially compensated, and the victim has provided a written statement waiving further implementation or confirming receipt of full compensation, such confirmation must be issued by the People's Committee of the locality where the victim resides or the Civil Enforcement Agency handling the case.

- For students in educational rehabilitation centers, if competent authorities require parents or legal representatives to pay fines or compensate for damages, and these individuals have completed payment or the student has repeatedly written letters, made phone calls, or directly requested parents or legal representatives to implement and have partially succeeded, it shall be considered as having actively implemented.

2. Good ranking

Students and inmates who basically comply with the provisions of Articles 5 and 6 of this Circular and were previously ranked as average, good, or excellent shall be ranked as good.

Specifically, Criterion 3 has not been fully met, manifested as: Not truly active in work; academic and vocational training results must reach at least an average level; have a positive impact on promoting competition and excellence among students and inmates but not outstanding. For students who do not participate in work or study, or participate irregularly or poorly due to illness, there must be a confirmation letter from the Medical Officer.

In the case of inmates who are frequently ill, sick, old, and unable to participate in labor, study, or cannot fully complete the assigned quota, there must be a confirmation document from the Medical Officer and approval from the Director of the Educational Rehabilitation Center and the Director of the Compulsory Education Facility.

Additionally, if students or inmates are required by competent authorities to execute administrative penalty decisions involving fines or compensation for damages caused by their administrative violations, and have not yet fulfilled these obligations, they must provide a commitment to continue fulfilling them. Relatives of students or inmates or their legal representatives must submit a petition detailing their family's particularly difficult economic circumstances, making it impossible for them to fulfill these obligations. The petition must be confirmed by the People's Committee of the commune where they reside or by the workplace or educational institution where they study.

In cases where students or inmates have no relatives (maternal or paternal grandparents; maternal or paternal parents; biological father or mother; husband or wife; legally adopted father or mother; husband or wife; biological children, daughters-in-law, sons-in-law, legally adopted children; full siblings; siblings-in-law; aunts, uncles, cousins; nephews or nieces) or still have relatives but do not have a fixed residence and cannot be contacted, they must submit a petition detailing their situation (confirmed by the Director of the Educational Rehabilitation Center and the Director of the Compulsory Education Facility) and a commitment to fulfill their obligations after completing the decision.

3. Rank average competition

Students or inmates who do not meet the criteria for good or excellent ranking, or who have violated the Internal Regulations of the Educational Rehabilitation Center or Compulsory Education Facility but have not reached the level of disciplinary action starting from a warning, or who were ranked poor in the previous evaluation period but have made efforts to improve, shall be ranked average.

4. Rank poor competition

Students or inmates who do not acknowledge their mistakes, refuse to study and train, shirk labor, or violate laws, the Internal Regulations of the Educational Rehabilitation Center or Compulsory Education Facility and are subject to disciplinary action starting from a warning during the evaluation period, or intentionally file complaints contrary to legal regulations regarding the application of administrative measures leading to placement in the Educational Rehabilitation Center or Compulsory Education Facility or other issues related to compliance with decisions, shall be ranked poor.

Article 7. Ranking in the case of meritorious service

1. Students or inmates who perform meritorious service as stipulated in Clause 7, Article 3 of Decree No. 02/2014/NĐ-CP dated January 10, 2014 on the system of applying and implementing administrative measures leading to placement in the Educational Rehabilitation Center and Compulsory Education Facility, saving property worth from five million to twenty million dong, shall have their competition ranking for that period increased by one grade. In cases where property worth more than twenty million dong is saved, or people in dangerous situations are saved, or multiple acts of meritorious service are performed, the competition ranking for that period shall be increased by two grades.

2. Students or inmates who discover and provide information helping the Educational Rehabilitation Center or Compulsory Education Facility prevent and combat plots or actions causing disorder, insecurity, sabotage, or escape from the Educational Rehabilitation Center or Compulsory Education Facility; capture escaped students or inmates; prevent and combat destructive behavior of others or crimes committed by students or inmates during their time at the Educational Rehabilitation Center or Compulsory Education Facility, or assist investigative agencies in detecting crimes, confirmed in writing by the Director of the Educational Rehabilitation Center or the Director of the Compulsory Education Facility or the Public Security Police of the district, county, city directly under the province, centrally governed city (Public Security Police at the district level) or higher, and awarded commendations, shall have their competition ranking for that period applied according to the provisions of Clause 1 of this Article.

Article 8. Periods for Evaluation and Classification of Competitive Activities

1. Students and inmates are classified in competitive activities according to three periods: Week, month, quarter.

2. Students and inmates who comply with decisions at educational centers and compulsory educational facilities for four days or more shall be classified in competitive activities on a weekly basis; for three weeks or more, they shall be classified on a monthly basis; those who have been classified for two months or more shall be classified on a quarterly basis.

Students and inmates who do not meet the time requirements for classification in competitive activities during the evaluation and classification period must still review and assess their academic performance, labor, and discipline to serve as a basis for subsequent assessment and evaluation processes.

Article 9. Regular Periods for Evaluation and Classification of Competitive Activities

1. The regular period for evaluating the results of classification in competitive activities on a weekly basis runs from Saturday of the previous week to Friday of the current week.

2. The regular period for evaluating the results of classification in competitive activities on a monthly basis runs from the 26th day of the previous month to the 25th day of the following month.

3. The regular period for evaluating the results of classification in competitive activities on a quarterly basis is calculated as follows:

a) Quarter I runs from November 26 of the previous year to February 25 of the following year;

b) Quarter II runs from February 26 to May 25;

c) Quarter III runs from May 26 to August 25;

d) Quarter IV runs from August 26 to November 25.

Article 10. Conditions for Regular Classification in Competitive Activities

1. Excellent Classification

a) Weekly classification: All days of the week are assessed with good attitudes and compliance with decisions;

b) Monthly classification

- All weeks of the month are assessed with good classifications;

- For months with four weeks, there must be at least two weeks with good classifications, including the last week which must be good, and the other two weeks must be satisfactory. For months with five weeks, there must be at least three weeks with good classifications, including the last week which must be good, and the other two weeks must be satisfactory. Only students and inmates who were previously classified as satisfactory or excellent in the immediate preceding month can be classified as excellent;

In cases where students and inmates have only been eligible for classification for three weeks, all three weeks must be classified as good or the first week as satisfactory and the remaining two weeks as good;

c) Quarterly classification

All three months must be classified as good or two months as good, including the last month which must be good, and the other month must be satisfactory. Only students and inmates who were previously classified as satisfactory or excellent in the immediate preceding quarter can be classified as excellent (except in cases of meritorious service);

For students and inmates who have only been eligible for classification for two months, both months must be classified as good or the first month as satisfactory and the second month as good (except in cases of meritorious service);

2. Satisfactory Classification

a) Weekly classification: All days of the week are assessed with satisfactory attitudes and compliance with decisions;

b) Monthly classification

- All weeks of the month are assessed with satisfactory classifications;

- For months with four weeks, there must be at least two weeks with satisfactory or good classifications, including the last week which must be satisfactory or good, and the other two weeks must be average. For months with five weeks, there must be at least three weeks with satisfactory or good classifications, including the last week which must be satisfactory or good, and the other two weeks must be average;

Only students and inmates who were previously classified as average, satisfactory, or excellent in the immediate preceding month can be classified as satisfactory (except in cases of meritorious service);

For students and inmates who have only been eligible for classification for three weeks, all three weeks must be classified as satisfactory or the first week as average, the remaining two weeks as satisfactory or the first week as average, the second week as satisfactory, and the third week as good;

c) Quarterly classification

Three months in a quarter must be classified as satisfactory or have two months classified as satisfactory or good, including the third month which must be satisfactory or good, and the other month must be average. Only students and inmates who were previously classified as average or better in the immediate preceding quarter can be classified as satisfactory (except in cases of meritorious service);

For students and inmates who have only been eligible for classification for two months, both months must be classified as satisfactory or the first month as average and the second month as satisfactory (except in cases of meritorious service).

3. Average Classification

a) Weekly classification: All days of the week are assessed with average attitudes and compliance with decisions;

b) Monthly classification

- All weeks are classified as average or the initial weeks are classified as satisfactory or good but the final week is classified as average;

- For months with four weeks, there must be at least three weeks classified as average, including the last week which must be average, and the other week must be poor;

- For months with five weeks, there must be at least four weeks classified as average, including the last week which must be average, and the other week must be poor;

- For new students who have only been eligible for classification, all weeks must be classified as average or the initial two weeks as satisfactory or good but the final week is classified as average;

c) Quarterly classification

- Three months in a quarter must be classified as average;

- The first two months must be classified as average, and the remaining month must be classified as satisfactory or good;

- The first two months must be classified as good or satisfactory, and the third month must be classified as average;

- The first month must be classified as poor, the second month as average, and the third month as satisfactory or good.

For students and inmates who have only been eligible for classification for two months, both months must be classified as average or the first month as good or satisfactory, and the second month as average.

4. Rank poor competition

Students and inmates who do not meet the conditions and standards for classification as average, satisfactory, or excellent as stipulated in Article 6 and Clause 1, 2, 3 of this Article, or who violate laws, internal regulations of educational centers and compulsory educational facilities and are disciplined with warnings or higher penalties, but do not show significant improvement in subsequent weeks or months, will be classified as poor.

Article 11. Procedures for ranking competition achievements

The procedures for ranking competition achievements for students and inmates shall be carried out in accordance with the following provisions:

1. Self-assessment report of students and inmates

Based on the four competition criteria stipulated in Articles 4 and 5 of this Circular, students and inmates write their self-assessment reports quarterly regarding the results of implementing decisions; they assess their academic performance, labor, and discipline improvement; state their future goals and self-rate their category for that quarter. In cases where students or inmates cannot write due to illiteracy or illness, they must have another student or inmate write on their behalf, after listening and agreeing with the content, then sign or affix their fingerprint on the self-assessment report, which must also bear the signature of confirmation from the class teacher in charge (hereinafter referred to as the class teacher) and the warder in charge (hereinafter referred to as the warder).

2. Weekly, monthly, and quarterly meetings for evaluating and ranking competition achievements

At all weekly, monthly, and quarterly meetings for evaluating and ranking competition achievements for students and inmates, the class teacher and warder must chair the meeting; each student and inmate must self-assess their implementation of decisions (if it is a quarterly ranking meeting, each student and inmate must read their self-assessment report before the group); the group provides opinions, then votes by raising hands; if at least two-thirds of the students and inmates present agree, they will be included in the list of proposed rankings. The results of the evaluation, assessment, and ranking meetings for weekly, monthly, and quarterly competitions must be recorded in minutes.

3. Regular meetings of student and inmate groups

a) On Friday of each week, the student and inmate group meets to evaluate, assess, and rank weekly. Based on the weekly evaluation and ranking results of the student and inmate group, the class teacher and warder review and rank the competition achievements for each student and inmate, and inform them.

b) On the 25th of each month, the student and inmate group meets to evaluate, assess, and rank monthly competition achievements. Based on the monthly evaluation and ranking results of the student and inmate group, the class teacher and warder review and prepare a list of proposed monthly competition achievement rankings for students and inmates, transfer it to the Head of the Educational Service Team or the Head of the Education Team, file a report to the Principal of the educational institution or the Director of the compulsory education facility, who has been authorized to approve and sign it, then inform the students and inmates.

c) On February 25, the student and inmate group meets to evaluate, assess, and rank February and the first quarter; on May 25, the group meets to evaluate, assess, and rank May and the second quarter; on August 25, the group meets to evaluate, assess, and rank August and the third quarter; on November 25, the group meets to evaluate, assess, and rank November and the fourth quarter. Based on the quarterly evaluation and ranking results of the student and inmate group, the class teacher and warder review and prepare a list of quarterly competition achievement rankings for each student and inmate, and propose it to the Sub-committee or Competition Achievement Ranking Committee.

4. Sub-committee for evaluating and proposing competition achievement rankings for decision implementation at branch schools of educational institutions or compulsory education facilities

a) For educational institutions with branch schools and compulsory education facilities with branches, the Principal of the educational institution or the Director of the compulsory education facility issues a decision to establish a Sub-committee for evaluating and proposing competition achievement rankings for decision implementation at each branch school or branch, headed by the Deputy Principal in charge of the branch school or the Deputy Director in charge of the branch. Members include: Branch School Director, Branch Director, duty officers, base staff, surveillance officers, medical personnel, class teachers, warders in charge of student and inmate groups, commandants of security police forces, and education service and education officers as secretaries.

b) Based on the proposed quarterly competition achievement rankings for decision implementation by class teachers and warders, the Sub-committee for evaluating and proposing competition achievement rankings for decision implementation at branch schools or branches convenes to evaluate and propose competition achievement rankings for students and inmates of the branch school or branch. When reviewing a student and inmate group, the class teacher and warder report the proposed ranking list for that group and explain any issues raised by meeting participants; then proceed to vote by raising hands; if at least two-thirds of the sub-committee members agree, the proposal is included in the list of proposed rankings. Afterward, complete the files and lists and submit them to the Competition Achievement Ranking Committee of the educational institution or compulsory education facility.

5. Competition Achievement Ranking Committee for decision implementation at educational institutions or compulsory education facilities

a) The Principal of the educational institution or the Director of the compulsory education facility issues a decision to establish a Competition Achievement Ranking Committee for decision implementation quarterly for students and inmates, the committee's composition includes:

- The Principal of the educational institution or the Director of the compulsory education facility - Chairperson of the Committee;

- The Deputy Principal of the educational institution in charge of educational work or the Deputy Director of the compulsory education facility in charge of educational work - Permanent Member;

- The Deputy Principal of the educational institution in charge of the branch school or the Deputy Director of the compulsory education facility in charge of the branch - Member;

- Branch School Director or Branch Director - Member;

- Head of the Educational Service Team (for educational institutions); Head of the Education Team (for compulsory education facilities) - Secretary;

- Head of the Class Teacher Team (for educational institutions); Head of the Warder Team (for compulsory education facilities) - Member;

- Head of the Cultural Teacher Team (for educational institutions) - Member;

- Head of the Surveillance Team (for compulsory education facilities) - Member;

- Platoon Leader of Protective Police (for educational centers for juveniles); Mobile Protective Police Team Leader - Member;

- Medical Officer - Member;

- Duty officer of the residential area for students at educational centers for juveniles - Member;

- Student file officer, warder - Member;

b) The Disciplinary Competition Classification Council of educational centers for juveniles and compulsory educational facilities shall convene to review and classify disciplinary competition compliance based on the recommendations of the Review Sub-committee and the proposed classification of disciplinary competition compliance from the branch or zone. When reviewing a branch or zone, the Deputy Principal in charge of the branch or the Deputy Director in charge of the zone, or the Branch Head, Zone Head will report the list of students and wards recommended for classification by that branch or zone and explain issues raised by meeting participants. The Council will vote by raising hands; if at least two-thirds of the Council members agree, it will be approved;

c) For educational centers for juveniles and compulsory educational facilities without branches or zones, when the Council convenes to classify disciplinary competition compliance for students and wards in teams (groups), the team (group) head teacher or custodian will attend, present specific cases, propose classifications for students and wards, and explain issues raised by meeting participants. The Council will consider and vote by raising hands for each case; if at least two-thirds of the Council members agree, it will be approved;

d) Based on the results of the Disciplinary Competition Classification Council meeting, the Head of the Administrative Service Team, the Head of the Education Service Team will compile and transfer to the team (group) head teachers or custodians to record in the Evaluation and Classification Report Form for Disciplinary Competition Compliance, along with the self-assessment reports of each student and ward under their responsibility. Afterward, they will return these to the Head of the Administrative Service Team, the Head of the Education Service Team for verification, then submit to the Principal of the educational center for juveniles, the Director of the compulsory educational facility, or the Deputy Principal, Deputy Director in charge of education for approval, signature, stamping, and public announcement to all students and wards;

 Article 12. Management and storage of classification results

1. The results of classifying disciplinary competition compliance for students and wards must be stored in each individual's file, including:

a) The evaluation and assessment report of the classification results of disciplinary competition compliance quarterly (with the self-assessment report of the student or ward during that quarter) for each student and ward. For students and wards who have not been classified for a full quarter, the self-assessment report of the period not yet classified must be stored;

b) Decisions rewarding students and wards who have performed meritorious acts; health confirmation certificates for sick or ill students and wards;

c) Various invoices, receipts, and documents regarding the suspension, exemption, and payment of fines, compensation for damages caused by administrative violations committed by students and wards;

d) Complaints and accusations from students and wards regarding the classification results of disciplinary competition compliance and the notification of complaints' responses from the Principal of the educational center for juveniles, the Director of the compulsory educational facility;

đ) Other related documents concerning the classification of disciplinary competition compliance for students and wards (if any);

2. The classification results of disciplinary competition compliance for each student and ward must be entered into the student and ward database software. All ledgers, meeting minutes, lists of disciplinary competition compliance classifications by head teachers, custodians, sub-committees, and the Disciplinary Competition Classification Council must be stored and managed according to the file management system of the Ministry of Public Security;

3. Quarterly, after completing the classification of disciplinary competition compliance for students and wards, the Principal of the educational center for juveniles, the Director of the compulsory educational facility must submit a consolidated report on the classification results of disciplinary competition compliance to the Criminal Enforcement and Legal Aid General Department for monitoring and consolidation;

Chapter III

IMPLEMENTING PROVISIONS

Article 13. Effective Date

This Circular takes effect from October 26, 2015, and replaces Decision No. 417/2003/QĐ-BCA(V26) dated July 2, 2003, issued by the Minister of Public Security on the issuance of regulations on standards and classification of disciplinary competition for inmates in compulsory educational facilities;

1. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of provincial People's Committees under the central government, and related agencies, units, and individuals are responsible for implementing this Circular.

1. The General Bureau of Criminal Enforcement and Judicial Assistance shall be responsible for guiding, urging, and inspecting the implementation of this Circular.

2. The Heads of the General Departments, Heads of units directly under the Ministry, Directors of Public Security, Directors of Fire Prevention and Fighting Services of provinces and centrally-administered cities, and relevant organizations and individuals are responsible for implementing this Circular;

During implementation, if difficulties arise, local public security agencies should report to the Ministry of Public Security (through the Criminal Enforcement and Legal Aid General Department) for timely guidance.
