CIRCULAR
Amending and supplementing certain Articles of Circular No. 285/2016/TT-BTC dated November 14, 2016 on the levels of collection, collection system, payment, management of fees and charges in veterinary work; Circular No. 286/2016/TT-BTC dated November 14, 2016 of the Minister of Finance on the levels of collection, collection system, payment, management, and utilization of fees for quality and safety food control in agriculture.Pursuant to Decree No. 120/2016/NĐ-CP dated August 23, 2016 of the Government detailing and guiding the implementation of certain provisions of the Law on Fees and Charges;Pursuant to Decision No. 16/2018/QĐ-TTg dated March 23, 2018 of the Prime Minister on applying financial mechanisms for the Plant Protection Department, the Veterinary Department, and the Quality Control Department of Forestry, Agriculture, and Aquatic Products under the Ministry of Agriculture and Rural Development.

Pursuant to the Law on Fees and Registration Fees dated November 25, 2015;
The Minister of Finance issues this Circular amending and supplementing certain Articles of Circular No. 285/2016/TT-BTC dated November 14, 2016 on the levels of collection, collection system, payment, and management of fees and charges in veterinary work; Circular No. 286/2016/TT-BTC dated November 14, 2016 of the Minister of Finance on the levels of collection, collection system, payment, management, and utilization of fees for quality and safety food control in agriculture.
Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Article 1. Amending and supplementing Article 3 of Circular No. 285/2016/TT-BTC dated November 14, 2016 as follows:
Implementing Resolution No. 75/NQ-CP dated August 9, 2017, of the Government on the regular session of the Government in July 2017;
At the proposal of the Director of the Department of Tax Policy,
"Organizations collecting fees in veterinary work include the Veterinary Department; Regional Animal Health Inspection Bureaus I, II, III, IV, V, VI, VII; Border Animal Quarantine Bureaus in Lang Son, Lao Cai, Quang Ninh; Central I and II Veterinary Drug Testing Centers; Central I and II Animal Health Sanitation Inspection Centers; Central Animal Diagnostic Center; Management Bureaus with specialized veterinary functions as stipulated in Article 6 of the Veterinary Law; Agricultural Service Centers, Agricultural Departments, Economic Departments under People's Committees at the district level assigned the task of managing specialized veterinary work." Article 2. Amending Clause 3 of Article 6 of Circular No. 285/2016/TT-BTC dated November 14, 2016 as follows:
a) At the end of each quarter, the collecting organizations base their actions on the amount of collected fees and the approved budget expenditure (annual budget divided into quarters). If the amount of collected fees exceeds the approved budget expenditure, they must deposit the difference into the account of the Veterinary Department (for organizations managed by the central government) to reallocate funds for subordinate agencies that lack revenue as stipulated in this Circular.

Article 4. Amend and supplement Article 3 of Circular No. 286/2016/TT-BTC dated November 14, 2016 as follows:
"Article 3. Collection Organizations
The organization collecting fees for quality management and food safety assessment in the agricultural sector shall be the agency implementing food quality and safety management operations, including: The Quality Management Bureau for Agricultural, Forestry, and Aquatic Products; The Central and Southern Regional Quality Management Bureaus for Agricultural, Forestry, and Aquatic Products; The Inspection, Certification, and Quality Consulting Center for Agricultural, Forestry, and Aquatic Products; The Quality Centers for Agricultural, Forestry, and Aquatic Products in Regions 1, 2, 3, 4, 5, and 6; The Animal Health Service; The Plant Protection Service; The Fisheries General Department; Local inspection agencies with the function of inspecting and certifying food safety conditions.
Article 5. Amend and supplement Points 1, 2, and 3 of Part I of the Fee Schedule in food safety work issued together with Circular No. 286/2016/TT-BTC dated November 14, 2016 as follows:

Article 6. Implementation Provisions
1. This Circular takes effect from June 22, 2018.
2. The fee adjustment contents stipulated in Clause 3, Article 6 of Circular No. 285/2016/TT-BTC and Clause 1, Article 6 of Circular No. 286/2016/TT-BTC shall remain effective until December 31, 2018.
3. During the implementation process, if there are any difficulties, organizations and individuals are requested to promptly report to the Ministry of Finance for study and resolution./.
