Issuing Construction Standards for Postal and Telecommunications Works

Pursuant to the Law on Telecommunications dated November 23, 2009;

Pursuant to the Law on Construction promulgated on June 18, 2014;

Pursuant to the Law Amending and Supplementing Certain Articles of the Construction Law on July 17 May 14, 2016 Government Decree detailing some provisions and measures to implement the Law on Legislative Regulatory Documents;

Pursuant to Decree No. 17/2017/NĐ-CP dated February 17, 2017, issued by the Government, on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

At the proposal of the Director of the Department of Planning and Finance;

The Minister of Information and Communications issues this Circular on Construction Standards for Postal and Telecommunications Works.

Article 1. Accompanying this Circular are the Construction Standards for Postal and Telecommunications Works.

Article 2. Scope of Regulation

The standards issued accompanying this Circular stipulate direct costs regarding labor, materials, construction machinery used as a basis for determining the construction costs of postal and telecommunications works for projects using public investment capital, state capital outside public investment, and projects constructed under the Public-Private Partnership (PPP) model.

Article 3. Applicability

Article 1. This Circular applies to agencies, organizations, and individuals related to the management of construction cost for postal and telecommunications works of projects using public investment capital, state capital outside public investment, and PPP projects.

Article 2. Organizations and individuals may refer to the provisions of this Circular to manage investment construction costs for projects not covered by Clause 1 of this Article.

Article 4. Transitional Provisions

Point 1. In cases where the construction costs of postal and telecommunications works are included in the total investment ceiling or construction budget that have been reviewed or approved before the effective date of this Circular, they must be updated with the standards at subsequent cost management stages.

Point 2. For construction costs of postal and telecommunications works in construction contracts within investment projects that have tender documents or request documents issued but not yet tendered before the effective date of this Circular, the Investment Decision Maker shall consider and decide on the application of the provisions of this Circular to implement them.

Point 3. In cases where the construction contract has been tendered, or the contractor has been selected, or the contract has been signed before the effective date of this Circular, then it shall be implemented according to the tender documents, request documents, bid documents, proposal documents, and the signed contract.

Article 5. Effective Date

1. This Circular takes effect from March 1, 2021.

Point 2. During implementation, if there are difficulties or obstacles, agencies and units are requested to report to the Ministry of Information and Communications for consideration and resolution.
