THE MINISTER OF TRANSPORTATION
Pursuant to Article 58 of the Vietnam Maritime Code dated June 30, 1990;
Now hereby promulgates with this Decision the "Regulations on Responsibilities and Forms of Handling for Organizations and Individuals when Violating Management and Operation of Road Traffic Load Control Stations for Motor Vehicles."
Pursuant to the opinion of the People's Committee of Kiên Giang Province at Circular No. 191/CV-UB dated April 23, 2002;
Considering the proposal of the Director of the Legal Affairs and Transportation Department and the Director General of the Vietnam Maritime Administration,
DECISION:
Article 1.
Now hereby announce the waters of the seaports within the jurisdiction of Kiên Giang Province including:
1- The waters before the Hòn Chông wharf and Bình Trị port;
2- The waters of the maritime route, pilotage reception zone, quarantine area, anchorage for typhoon avoidance, and transfer areas of the Hòn Chông, Bình Trị ports and the transfer area of Hà Tiên, and the anchorage area for passenger ships in Dương Đông of Kiên Giang Province;
3- The waters before other wharfs and anchorage, transfer, and typhoon avoidance areas will be announced according to the provisions of the law.
Article 2.
The scope of the waters of the seaports within the jurisdiction of Kiên Giang Province is measured from the highest tide level and is defined as follows:
1. The Hòn Chông port area
a. The boundary towards the sea: is the water area limited by straight lines connecting points HC1, HC2, HC3, HC4, HC5 with the following coordinates:
HC1. 100 08' 39''N; 1040 36' 12 E (east of Mũi Ông Thầy)
HC2. 090 59' 56''N; 1040 35' 33'E
HC3. 090 59' 56''N; 1040 33' 36'E
HC4. 100 09' 00''N; 1040 34' 10'E
HC5. 100 09' 00''N; 1040 35' 48'E (west of Mũi Ông Thầy)
b. The boundary towards the mainland: is the line running along the southern coast of Mũi Ông Thầy from HC1 to HC5.
2. The Bình Trị port area
a. The boundary towards the sea: is limited by straight lines connecting points BT1, BT2, BT3, BT4 with the following coordinates:
BT1. 100 12' 25''N; 1040 34' 52 E,
BT2. 100 11' 09''N; 1040 24' 18'E,
BT3. 100 13' 24''N; 1040 24' 18'E,
BT4. 100 13' 00''N; 1040 35' 18'E,
b. The boundary towards the mainland is the line running along the coast west of Bình An commune, from BT1 to BT4.
3. The Hà Tiên transfer area
a. The boundary towards the sea: is limited by straight lines connecting points HT1, HT2, HT3, HT4 with the following coordinates:
HT1. 100 22' 24''N; 1040 29' 00 E,
HT2. 100 21' 12''N; 1040 28' 02'E,
HT3. 100 21' 48''N; 1040 27' 20'E,
HT4. 100 22' 36''N; 104028' 57'E,
b. The boundary towards the Tô Châu River: runs from two points HT1, HT4 towards the mouth of the Tô Châu River, then along both banks of the river upstream to a line parallel to the floating bridge and 100 meters downstream from the floating bridge.
4. The anchorage area for passenger ships in Dương Đông: is limited by straight lines connecting points DD1, DD2, DD3, DD4, DD5, DD6 with the following coordinates:
DD1. 100 13' 05''N; 1030 57' 09 E,
DD2. 100 12' 00''N; 1030 56' 12'E,
DD3. 100 12' 00''N; 1030 51' 06'E,
DD4. 100 14' 00''N; 1030 51' 06'E,
DD5. 100 14' 00''N; 1030 56' 12'E,
DD6. 100 13' 12''N; 1030 57' 05'E and connected to point DD1.
Article 3.
The pilotage reception, quarantine, anchorage, transfer, and typhoon avoidance zones for vessels entering the seaports within the jurisdiction of Kiên Giang Province are defined as follows:
1. Pilotage reception and quarantine zones:
a. For the Hòn Chông port: is the water area limited by a circle with a radius of 01 nautical mile, centered at the coordinates: 100 00' 56'' N; 1040 34' 43'E.
b. For the Bình Trị port: is the water area limited by a circle with a radius of 01 nautical mile, centered at the coordinates: 100 12'12'' N; 1040 25' 14'E.
c. For the Hà Tiên transfer area: is the water area limited by a semicircle facing southwest with a radius of 0.3 nautical miles, centered at the coordinates: 100 21'39''N; 1040 28' 01'E.
d. For the anchorage area for passenger ships in Dương Đông: is the water area limited by a circle with a radius of 01 nautical mile, centered at the coordinates: 100 13'06'' N; 1030 52' 12'E.
2. Anchorage and transfer zones:
a. The Hòn Chông port area: is the water area limited by a circle with a radius of 01 nautical mile, centered at the coordinates: 100 05' 15'' N; 1040 34' 56'E.
b. The Hà Tiên transfer area: is the water area limited from a line crossing the Tô Châu River and parallel to the Tô Châu Bridge at a position 150 meters upstream from the Tô Châu Bridge, to both banks of the river, then running along both banks of the river to a line parallel to the floating bridge and 100 meters downstream from the floating bridge.
c. The anchorage area for passenger ships in Dương Đông: is the water area limited by a circle with a radius of 01 nautical mile, centered at the coordinates: 100 13' 06'' N; 1030 56' 18'E.
3. Typhoon avoidance zones:
a. The Hòn Chông and Quảng Trị port areas: is the water area within the Bà Lụa archipelago designated by the Kiên Giang Port Authority.
b. The Hà Tiên transfer area: is the water area defined in Point b, Clause 2 of this Article.
c. The anchorage area for passenger ships in Dương Đông: is determined by the Kiên Giang Port Authority.
Article 4.
1. The Kiên Giang Port Authority is responsible for performing its duties and powers as prescribed by the Vietnam Maritime Code and other relevant laws regarding all maritime activities in the waters of the seaports within the jurisdiction of Kiên Giang Province.
2. The Kiên Giang Port Authority, based on the actual situation of weather, waves, draft, and load capacity of vessels, assigns vessels to specific positions within the waters defined in Article 3 of this Decision, ensuring maritime safety and environmental hygiene.
Article 5.
Outside the waters defined in Articles 2 and 3 of this Decision, the Kiên Giang Port Authority also has the responsibility to manage the specialized state administration over maritime order and safety in the territorial waters under the jurisdiction of Kiên Giang Province in accordance with the law.
Article 6.
THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.
Article 7.
The Director of the Office of the Ministry, Heads of Departments under the Ministry, Director of the Vietnam Maritime Administration, Director of the Vietnam Inland Waterways Administration, Director of the Department of Transport and Communications of Kiên Giang Province, Director of the Kiên Giang Port Authority, Heads of agencies, units, and individuals concerned are responsible for implementing this Decision./.
