MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
To implement the directive of the Prime Minister regarding the Ministry of Agriculture and Rural Development's decision to suspend the organization of exploitation, distillation, purchase, and consumption of citronella oil (document 321/VPCP-VX, dated January 23, 1999).
DECISION:
Article 1. Suspend the organization of exploitation, distillation, purchase, and consumption of citronella oil nationwide; all licenses already issued to enterprises, organizations, and individuals for exploitation, distillation, purchase, and consumption of citronella oil shall be void from the date this decision is issued.
Article 2. The centrally governed provinces continue to implement document number 4397/BNN-KL, dated November 18, 1998, of the Ministry of Agriculture and Rural Development concerning the prevention of the illegal felling and root extraction of citronella plants for distillation purposes; organize an inventory of the quantity of citronella oil within their jurisdiction; the inventory will be conducted as follows:
a. Establish a multi-sectoral inventory team comprising the Forest Inspection Branch, Provincial Police, and Market Management Branch, led by the Forest Inspection Branch, to inventory the quantity of citronella oil held by organizations and individuals (referred to collectively as the owner) who have been granted permits by competent state authorities (from provincial People's Committees upwards) for exploitation, distillation, purchase, and consumption of this product up until the issuance of document number 4379/BNN-KL on November 18, 1998.
b. Complete the inventory before March 23, 1999; strictly prohibit the misuse of the inventory process to falsely report quantities of citronella oil. After completing the inventory, report to the Provincial People's Committee for permission to transport and consume the actual quantity of citronella oil inventoried.
c. For the quantity of citronella oil held by organizations and individuals with permits for exploitation and purchase that were issued without proper authority or obtained through illegal exploitation, purchase, or trade, prepare a record and handle according to the provisions of the law.
d. The Forest Inspection Branch assists the provincial People's Committees in summarizing the quantity of citronella oil inventoried (including those confiscated), propose handling measures for the goods, submit these proposals to the provincial People's Committee for resolution, and send them to the Ministry of Agriculture and Rural Development before March 30, 1999, for consolidation and reporting to the Prime Minister.
Article 3. The Forest Inspection Branch advises the provincial People's Committees to direct relevant agencies to continue implementing Directive 287/TTg dated May 2, 1997, of the Prime Minister regarding the organization of inspections to eliminate individuals and organizations damaging forests; dismantle illegal exploitation, distillation, purchase, and consumption points of citronella oil, and strictly punish according to the law any organizations and individuals violating these regulations; strengthen public awareness campaigns about protecting the citronella plant and forests generally, and inform enterprises, organizations, and individuals about the policy of suspending exploitation, processing, purchasing, and consuming citronella oil so they are aware and comply.
Article 4. Assign the Forest Inspection General Department to coordinate with central specialized agencies to monitor and inspect the implementation of this decision and compile the situation to report to the Minister.
Article 5. The Heads of the Ministry's Office, the Director of the Forest Inspection General Department, the Director of the Forestry Development General Department, the Directors of Provincial Departments of Agriculture and Rural Development, and the Chiefs of Provincial Forest Inspection Branches are responsible for enforcing this decision./.
