THE MINISTER OF HEALTH
Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 188/2007/NĐ-CP dated December 27, 2007 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Health;
Considering the proposal of the Director of the Personnel Department and the Head of the Office of the Ministry of Health.
DECISION:
Article 1. Position and Functions
The Office of the Ministry of Health is an organization under the Ministry of Health with the function of advising the Minister to synthesize and coordinate the activities of organizations under the Ministry according to the work program and plan of the Ministry's leadership; implementing administrative, archival, management, logistical, and information technology work within the Ministry's agency and other tasks assigned by the Ministry's leadership.
The Office of the Ministry of Health has its own seal and separate account.
Article 2. Tasks and Authorities
1. Serving the direction and management of work by the Ministry's leadership
a) Synthesizing, monitoring, and urging the implementation of the working regulations and work programs and plans of the Ministry's agency and the work program of the Ministry's leadership;
b) Notifying the directives and conclusions of the Ministry's leadership to relevant agencies and units;
c) Coordinating the activities of organizations within the Ministry's agency and related subordinate public service units in carrying out the Ministry's tasks;
d) Synthesizing, analyzing, and reporting on the operational situation of the Ministry's agency and the sector according to the division of labor by the Ministry's leadership;
đ) Advising, proposing, seeking directives and decisions from the Ministry's leadership regarding new and urgent matters of the Ministry that relate to Departments, Bureaus, General Departments, the Inspectorate, the Office, and related agencies and units;
e) Participating in receiving, processing, and providing information to mass media organizations, organizations, and individuals according to the directives of the Ministry's leadership;
g) Assisting the Minister in responding to questions from National Assembly deputies;
h) Receiving registration, synthesizing, monitoring, and urging proposals submitted to the Government and competent authorities;
2. Implementing administrative, management, archival, and logistical work of the Ministry of Health's agency
a) Organizing the implementation of administrative, archival, communication, and information security work within the Ministry's agency;
b) Organizing the implementation of archival work within the Ministry's agency; guiding, inspecting, and urging subordinate units to comply with legal provisions on archival work; developing plans and organizing training to improve archival skills for staff at subordinate units;
c) Organizing the construction and development of the library of the Ministry's agency; implementing statistical work in archival activities of the Ministry's agency and subordinate units;
d) Implementing reception and ceremonial duties according to regulations; being responsible for protocol work during holidays, meetings, and conferences organized by the Ministry's leadership and other urgent tasks;
đ) Organizing the implementation of management and logistical work to ensure conditions and means for the leadership's operations and working conditions for staff in the Ministry's agency according to legal provisions; ensuring environmental sanitation, security, and safety in the Ministry's agency;
e) Serving as the focal point, coordinating with Departments, Bureaus, General Departments, the Inspectorate, and the Trade Union of the Ministry's agency to care for the material and spiritual life of staff and policy beneficiaries in the Ministry's agency;
g) Organizing health services within the agency and performing other related tasks in management, logistics, security, fire prevention, and self-defense militia;
h) Managing and effectively utilizing vehicles to serve the leadership and management of the Ministry's leadership and the state administration of units under the Ministry's agency, including emergency work.
3. Implementing financial asset management and accounting work of the Ministry of Health's agency
a) Implementing the management of state funds allocated to the Ministry's agency (including state budget, loans, or international aid) according to legal provisions;
b) Managing materials and assets of the Ministry of Health's agency according to legal provisions.
4. Implementing information technology work in the Ministry of Health's agency
a) Leading the establishment and management of the electronic portal for the healthcare sector;
b) Establishing, managing, and operating the local area network (LAN) and telephone system of the Ministry of Health's agency;
c) Serving as the focal point for connecting, managing, and operating the wide area network (WAN) in healthcare and integrating the healthcare sector's database system;
d) Deploying internal network application activities and software serving the leadership and directive work of the Ministry of Health's leadership;
đ) Serving as the focal point for implementing the e-Government at the Ministry of Health, promoting the application and development of information technology in the Ministry's agency's activities.
5. Organizing the implementation of commendation and reward work and disaster prevention and search and rescue operations
a) Leading and coordinating with Departments, Bureaus, General Departments, and the Inspectorate in implementing disaster prevention and search and rescue operations in the healthcare sector;
b) Providing continuous support to the Ministry's leadership for commendation and reward work in the Ministry of Health's agency;
c) Building and implementing regulations on democratic activities and internal rules within the agency.
6. Organizing the implementation of other tasks
a) Leading and coordinating with Departments, Bureaus, General Departments, and the Inspectorate in building and implementing administrative reform plans for the Ministry of Health's agency; serving as the focal point for preparing monthly, quarterly, and annual reports on administrative reform work of the Ministry of Health to the Government and related agencies as prescribed;
b) Building and implementing plans for public welfare labor, military recruitment examinations;
c) Organizing and training self-defense forces, continuously protecting the agency, preventing fires, maintaining order and safety within the Ministry of Health's agency;
d) Performing other tasks assigned by the Minister of Health.
Article 3. Organizational Structure and Operations
1. Leadership of the Ministry's Office
The leadership of the Ministry's Office includes the Director of the Ministry's Office and Deputy Directors of the Ministry's Office appointed and relieved from duty by the Minister of Health. The Director of the Ministry's Office is responsible to the Minister of Health for all activities of the Ministry's Office. Deputy Directors of the Ministry's Office are responsible to the Director of the Ministry's Office and to the law for the tasks assigned to them.
2. Organization of the Ministry's Office consists of:
a) General Department;
b) Administrative Department;
c) Archives Department;
d) Management Department;
đ) Finance and Accounting Department;
e) Information Technology Department;
g) Security Department;
f) Disaster Prevention and Rescue Unit;
3. Operation Mechanism
a) The Ministry's Office operates under the head system;
b) The functions, tasks, and authorities of the departments within the Ministry's Office are defined by the Director of the Ministry's Office based on the functions and tasks of the Ministry's Office assigned by the Minister of Health. The working relationships between the departments within the Ministry's Office are regulated by the Director of the Ministry's Office;
c) The appointment and removal of leadership positions in the departments within the Ministry's Office shall be carried out in accordance with current laws;
d) Leaders of the Ministry's Office and leaders of the departments within the Ministry's Office shall receive allowances as prescribed by current regulations.
4. Staffing
The staffing of the Ministry of Health's Office is determined by the decision of the Minister of Health and adjusted annually according to work needs and the proposal of the Director of the Ministry's Office.
Article 4. Effective date
This Decision takes effect fifteen days after its publication in the Official Gazette.
Article 5. Responsibilities for Implementation
The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Heads of Bureaus, the Heads of General Departments under the Ministry of Health, and the Heads of relevant agencies, units, and individuals are responsible for implementing this Decision./.
