REGULATING THE IMPORT OF GOODS UNDER THE QUOTA-TARIFF MANAGEMENT LIST FOR 2011

Pursuant to Decree No. 189/2007/ND-CP dated December 27, 2007, issued by the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

BASED ON THE DECREE NO. 12/2006/NĐ-CP OF JANUARY 23, 2006 ISSUED BY THE GOVERNMENT PROVIDING GUIDELINES FOR THE IMPLEMENTATION OF THE COMMERCE LAW ON INTERNATIONAL TRADE ACTIVITIES AND RELATED AGENCY PURCHASE, SALE, PROCESSING, AND TRANSIT ACTIVITIES WITH FOREIGN COUNTRIES;

After consultation with the Ministry of Agriculture and Rural Development and the Ministry of Finance;

THE MINISTER OF INDUSTRY AND TRADE REGULATES THE IMPORT OF GOODS UNDER THE QUOTA-TARIFF MANAGEMENT LIST FOR 2011 AS FOLLOWS:

ARTICLE 2. PRINCIPLES FOR GRANTING IMPORT LICENSES FOR GOODS UNDER THE TARIFF QUOTA

1. TRADERS SHALL BE ALLOCATED THE TARIFF QUOTA FOR IMPORTING SALT, SUGAR, RAW TOBACCO, AND BIRD EGGS IN ACCORDANCE WITH THE CIRCULAR NO. 04/2006/TT-BTM OF APRIL 6, 2006 ISSUED BY THE MINISTRY OF TRADE (NOW THE MINISTRY OF INDUSTRY AND TRADE) GUIDING CERTAIN PROVISIONS OF THE DECREE NO. 12/2006/NĐ-CP OF JANUARY 23, 2006 ISSUED BY THE GOVERNMENT PROVIDING GUIDELINES FOR THE IMPLEMENTATION OF THE COMMERCE LAW ON INTERNATIONAL TRADE ACTIVITIES AND RELATED AGENCY PURCHASE, SALE, PROCESSING, AND TRANSIT ACTIVITIES WITH FOREIGN COUNTRIES.

2. THE MINISTRY OF INDUSTRY AND TRADE SHALL ALLOCATE THE TARIFF QUOTA FOR IMPORTING 100,000 TONS OF INDUSTRIAL SALT TO TRADERS WHO USE IT AS RAW MATERIAL FOR CHEMICAL PRODUCTION AND 2,000 TONS OF PURE SALT TO TRADERS WHO USE IT AS RAW MATERIAL FOR MEDICINE AND HEALTHCARE PRODUCT PRODUCTION.

3. THE MINISTRY OF INDUSTRY AND TRADE SHALL ALLOCATE THE TARIFF QUOTA FOR IMPORTING 150,000 TONS OF REFINED SUGAR AND RAW SUGAR TO TRADERS WHO USE IT AS RAW MATERIAL FOR PRODUCTION, 50,000 TONS OF RAW SUGAR TO SUGAR MILLS FOR REFINING, AND 50,000 TONS OF REFINED SUGAR TO TRADERS FOR MARKET SUPPLEMENTATION.

Article 3. Effectiveness

THIS CIRCULAR SHALL TAKE EFFECT FROM JANUARY 1, 2011 AND SHALL EXPIRE ON DECEMBER 31, 2011.
