Issuing the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam

On the basis of the Law on Product Quality dated November 21, 2007;

On the basis of Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; Decree No. 75/2009/NĐ-CP dated September 10, 2009 of the Government amending Article 3 of Decree No. 01/2008/NĐ-CP of the Government;

On the basis of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production, business; Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government amending and supplementing some articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production and business;

On the basis of Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of certain provisions of the Law on Product Quality;

CONSIDERING the proposal of the Director of the Crop Production Department;

The Minister of Agriculture and Rural Development issues this Circular on the supplementary list of fertilizers permitted for production, business, and use in Vietnam,

Article 1. Issued together with this Circular is Appendix 01 containing a supplementary list of fertilizers permitted for production, business, and use in Vietnam, including two appendices:

1. Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam (Appendix 01) comprising 202 types of fertilizers divided into:

a) Organic fertilizers: 01 type;

b) Bio-fertilizers: 07 types;

c) Organic bio-fertilizers: 19 types;

d) Organic biological fertilizers: 03 types;

đ) Organic mineral fertilizers: 10 types;

e) Foliar fertilizers: 162 types.

2. List of fertilizers to replace those already included in the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam (Appendix 02), comprising 64 types, specifically:

a) Organic fertilizers: 04 types;

b) Organic bio-fertilizers: 01 type;

c) Organic biological fertilizers: 02 types;

d) Organic mineral fertilizers: 05 types;

đ) Foliar fertilizers: 51 types;

e) Soil amendment products: 01 type.

Article 2. The types of fertilizers listed in the Supplementary List of Fertilizers attached to Decision No. 84/2007/QĐ-BNN dated October 4, 2007 on "Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam" shall cease to be effective from October 4, 2012.

Article 3. Organizations and individuals permitted to produce, trade, and use the types of fertilizers specified in Article 1 must meet the conditions stipulated in Article 5 of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production and business; stipulated in Clause 4, Article 1 of Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government amending and supplementing some articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production and business.

Article 4. This Circular takes effect from October 27, 2012.

Article 5. The Director of the Office of the Ministry, the Director of the Crop Cultivation Department, the Director of the Science, Technology and Environment Department, the Directors of the Departments of Agriculture and Rural Development of the provinces and centrally governed cities, and the Heads of relevant units are responsible for implementing this Circular./.
