Regulations on the level of collection, system of collection, payment, management and use of fees for using highway toll station at Co Chi Bridge, National Highway 60, Tra Vinh Province

Pursuant to the Ordinance on Fees and Charges No. 38/2001/PL-UBTVQH11 dated August 28, 2001;
Pursuant to Decree No. 215/2013/NĐ-CP dated December 23, 2013 of the Government on the functions, tasks, powers and organizational structure
Pursuant to Decree No. 215/2013/NĐ-CP dated December 23, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
At the proposal of the Director of the Policy Department;
The Minister of Finance issues this Circular stipulating the rates for, procedures of collection, payment, management, and use of fees for using the highway section from Phap Van to Cau Giay, Hanoi City as follows:
Article 1. Scope of application
The objects subject to the collection of fees for using the highway section from Phap Van to Cau Giay, Hanoi City shall be implemented according to the provisions of Article 3, Article 4, and Article 5 of Circular No. 159/2013/TT-BTC dated November 14, 2013 of the Ministry of Finance guiding the procedures for collection, payment, management, and use of fees for using highways to recover investment costs in road construction (hereinafter referred to as Circular No. 159/2013/TT-BTC).
Article 2. Fee Collection Schedule
This Circular also promulgates the Table of Rates for Fees for Using the Highway Section from Phap Van to Cau Giay, Hanoi City (rates already include value-added tax).
Article 3. Procedures for collecting fees and fee collection receipts
1. Collection procedures
a) At the Entry Station: The driver stops at the entry lane booth. The fee collector provides the driver with an Entry Road Card (smart card; paper ticket or barcode ticket).
b) At the Exit Station: Upon reaching the exit lane, the driver stops at the exit lane booth, hands over the Entry Road Card to the fee collector, pays the fee, and receives the fee collection receipt.
c) For the Toll Station (at Km 212+200) shared with the Cau Giay-Ninh Binh Expressway Project: In case the vehicle travels from the Cau Giay-Ninh Binh Expressway to the Phap Van-Cau Giay Highway, at the toll station, the vehicle owner must return the Entry Road Card for the expressway, pay the fee for using the Cau Giay-Ninh Binh Expressway (according to the toll collection regulations of the Cau Giay-Ninh Binh Expressway Project), receive the fee collection receipt from the Cau Giay-Ninh Binh Expressway Project, and obtain the Entry Road Card for the Phap Van-Cau Giay Highway. In case the vehicle travels from the Phap Van-Cau Giay Highway to the toll station, the vehicle owner returns the Entry Road Card for the Phap Van-Cau Giay Highway, pays the fee for using the Phap Van-Cau Giay Highway (according to the rates specified in this Circular), receives the fee collection receipt, and obtains the Entry Road Card for the Cau Giay-Ninh Binh Expressway.
2. For vehicles using monthly tickets or quarterly tickets
Vehicle owners purchasing monthly or quarterly tickets will be issued a monthly ticket card (valid from the first day of the month until the end of the month), a quarterly ticket card (from the first day of the first month of the quarter until the end of the quarter), and a fee collection receipt. When passing through the toll station, the vehicle owner swipes the card at the entry and exit stations and does not need to pay the fee when passing through the station.
Monthly and quarterly tickets must be used strictly according to the designated route as prescribed. If the vehicle enters other sections, the vehicle owner must purchase tickets for those sections according to the regulations. Once the monthly ticket expires, the card loses its validity, and the vehicle owner must purchase the next monthly or quarterly ticket to continue using it.
3. Fee collection receipts
The fee collection receipts for the toll station on the Phap Van-Cau Giay Highway, Hanoi City, shall be implemented according to the provisions of Article 9 of Circular No. 159/2013/TT-BTC.
1. Fees for the use of motorways at the Tam Ky toll station, National Highway 1, Quang Nam Province shall be collected, paid, managed and used according to the provisions of Article 8 of Circular No. 159/2013/TT-BTC. The total amount of annual fees collected, after deducting taxes as prescribed, shall be determined as the amount for capital recovery according to the financial plan of the BOT Contract for the Project to expand National Highway 1 from Km987 to Km027, Quang Nam Province.
1. Fees for using the highway section from Phap Van to Cau Giay, Hanoi City, shall be collected, paid, managed, and used according to the provisions of Article 8 of Circular No. 159/2013/TT-BTC. The total annual revenue from fees, after deducting taxes as prescribed, shall be determined as the amount of fees for recovering capital under the financial plan of the BOT Contract for the Investment Project to Upgrade the Highway Section from Phap Van to Cau Giay, Hanoi City.
2. The entity assigned by the Ministry of Transport to organize the collection of fees for using the highway section from Phap Van to Cau Giay, Hanoi City shall be responsible for:
a) Organizing sales points at the toll station that are convenient for drivers, avoiding traffic congestion, selling all types of tickets promptly and fully according to buyers' requirements, without limiting the sale time for monthly and quarterly tickets;
b) Implement registration, declaration, collection, payment, use of collection documents, and publicize the fee collection system for the use of motorways according to regulations;
c) Reporting the results of fee collection regularly monthly, quarterly, and annually in accordance with the regulations of the General Department of Roads of Vietnam and the Ministry of Transport.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. This Circular takes effect from May 23, 2015.
The start date for collecting fees according to the rates in this Circular shall be when the following conditions are met: The project has been approved by the Ministry of Transport and completed acceptance and put into operation; the Ministry of Transport has issued a Decision allowing the collection of fees.
2. Other matters related to the collection, payment, management, use, and public disclosure of the procedures for collecting fees for using the highway section from Phap Van to Cau Giay, Hanoi City, which are not specified in this Circular, shall be implemented according to the guidance provided in Circular No. 63/2002/TT-BTC dated July 24, 2002, and Circular No. 45/2006/TT-BTC dated May 25, 2006, of the Ministry of Finance guiding the implementation of laws on fees and charges; Circular No. 159/2013/TT-BTC dated November 14, 2013, of the Ministry of Finance guiding the procedures for collection, payment, management, and use of fees for using highways to recover investment costs in road construction; Circular No. 156/2013/TT-BTC dated November 6, 2013, of the Ministry of Finance guiding the implementation of certain articles of the Law on Tax Administration; the Law Amending and Supplementing Certain Articles of the Law on Tax Administration and Decree No. 83/2013/NĐ-CP dated July 22, 2013, of the Government; Circular No. 39/2014/TT-BTC dated March 31, 2014, of the Ministry of Finance guiding the implementation of Decree No. 51/2010/NĐ-CP dated May 14, 2010, and Decree No. 04/2014/NĐ-CP dated January 17, 2014, of the Government regarding invoices for goods and services and any subsequent amendments and supplements (if any).
3. Organizations and individuals subject to the payment of fees, entities assigned by the Ministry of Transport to organize the collection of fees for using the highway section from Phap Van to Cau Giay, Hanoi City, and relevant agencies shall be responsible for implementing this Circular.
- For the application of fee levels for container vehicles (including dedicated tractor-trailers): Apply the fee level based on the total weight of the vehicle, regardless of whether it is loaded or not loaded.

Note:
- Vehicles with monthly or quarterly tickets for the route from Phap Van to Van Diem shall be used at toll stations of the project on the Phap Van - Van Diem section (including toll stations at Thanh Xuan intersection);
- Vehicles with monthly or quarterly tickets for the route from Phap Van to Caotoc Cau Gie - Ninh Binh Expressway shall be used at toll stations of the project on the Phap Van - Caotoc Cau Gie - Ninh Binh section (including toll stations at Van Diem intersection and Thanh Xuan intersection);
- Vehicles with monthly or quarterly tickets for the route from Thanh Xuan to Caotoc Cau Gie - Ninh Binh Expressway shall be used at toll stations of the project on the Thanh Xuan - Caotoc Cau Gie - Ninh Binh section (including toll stations at Van Diem intersection);
- Vehicles with monthly or quarterly tickets for the route from Thanh Xuan to Cau Gie - Ha Nam shall be used at toll stations of the project on the Thanh Xuan - Cau Gie - Ha Nam section (including toll stations at Van Diem intersection and the toll station at Km 212+200, Caotoc Cau Gie - Ninh Binh Expressway);
- Vehicles with monthly or quarterly tickets for the route from Phap Van to Cau Gie - Ha Nam shall be used at all toll stations of the project;
- The load capacity of each type of vehicle applying the face value above is the designed load capacity (cargo weight), based on the Vehicle Registration Certificate issued by the competent authority.
- For the application of toll rates for container-carrying vehicles (including dedicated trailer units): The toll rate shall be applied based on the total weight of the vehicle, regardless of whether it is loaded or not.
