Pursuant to the Railway Law dated June 14, 2005;
Pursuant to Decree No. 14/2015/NĐ-CP dated February 13, 2015, issued by the Government detailing and guiding the implementation of certain provisions of the Railway Law;
Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
At the proposal of the Director of the Cadre Organization Department and the Director of the Vietnam Railway Administration;
The Minister of Transport issues this Circular amending and supplementing some articles of Circular No. 76/2015/TT-BGTVT dated December 1, 2015 of the Minister of Transport on management of examination, issuance, reissuance, and revocation of licenses for driving trains on railway tracks and Circular No. 38/2010/TT-BGTVT dated December 17, 2010 of the Minister of Transport on standards for positions of railway staff directly serving train operations, training facility conditions, and content and curriculum of training for railway staff directly serving train operations.
Article 1. Amending and supplementing Clause 2, Article 2 of Circular No. 76/2015/TT-BGTVT dated December 1, 2015 of the Minister of Transport on management of examination, issuance, reissuance, and revocation of licenses for driving trains on railway tracks.
"2. This Circular does not apply to:
a) Persons directly controlling railway transportation means within the scope of railway depot or internal railway area directly serving production lines of enterprises without passing through residential areas or intersecting with road systems;
b) Persons directly controlling specialized railway transportation means during operation for rescue and emergency response to railway traffic accidents when the means move within the accident site."
Article 2. Amending and supplementing Point a, Clause 8, Article 5 of Circular No. 38/2010/TT-BGTVT dated December 17, 2010 of the Minister of Transport on standards for positions of railway staff directly serving train operations, training facility conditions, and content and curriculum of training for railway staff directly serving train operations.
"a) Is a railway maintenance worker with five years of service or more and holds a certificate or diploma in track, bridge, or tunnel inspection or a diploma from a vocational college or higher in railway engineering or bridge and tunnel engineering."
Article 3. Effectiveness
This Circular shall take effect from March 1, 2017.
Article 4. Organization of Implementation
The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, the Director of the Vietnam Railway Administration, Heads of agencies, organizations, and individuals related shall be responsible for enforcing this Circular./.
