Citizens performing the duty to join the People's Public Security

Based on the Law on Military Service;

Pursuant to the Law on People's Police dated November 20, 2018;

Pursuant to Decree No. 70/2019/NĐ-CP dated August 23, 2019 of the Government on the implementation of the duty to participate in the People's Public Security Force;

Pursuant to Decree number 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

Upon the proposal of the Director of the Health Bureau;

The Minister of Public Security issues the Circular stipulating health standards and medical examinations for selecting citizens to fulfill their duty to join the People's Public Security.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates health standards and medical examinations for selecting citizens to fulfill their duty to join the People's Public Security, including: Standards, preliminary checks, initial screening, medical examination, re-examination, medical appraisal, and classification of health status for selecting citizens to fulfill their duty to join the People's Public Security, and the responsibilities of public security units and localities in conducting medical examinations for selecting citizens to fulfill their duty to join the People's Public Security.

Article 2. Applicability

1. Citizens eligible for medical examination to fulfill their duty to join the People's Public Security include:

a) Male citizens within the age range for conscription who have registered for military service according to the provisions of the Law on Military Service;

b) Female citizens within the age range for conscription who have registered for military service according to the provisions of the Law on Military Service, with appropriate professional qualifications meeting the requirements of the People's Public Security, if they voluntarily apply and the People's Public Security has a need, they will be considered and selected to fulfill their duty to join the People's Public Security.

2. Public security units and localities and related organizations and individuals.

Article 3. Explanation of Terms

In this Circular, the following terms shall be understood as follows:

1. Medical examination for fulfilling the duty to join the People's Public Security is the process of conducting health checks, classifying, and concluding on the health status of citizens fulfilling the duty to join the People's Public Security before being preliminarily screened for health suitability for fulfilling the duty to join the People's Public Security, carried out by the Health Examination Team established by the Director of the District, County, City, or Provincial City Health Center (hereinafter referred to as the district level).

2. Preliminary health screening for fulfilling the duty to join the People's Public Security is the process of conducting basic health checks and evaluations of citizens fulfilling the duty to join the People's Public Security before each recruitment period and call-up for fulfilling the duty to join the People's Public Security.

3. Medical examination for fulfilling the duty to join the People's Public Security is the process of conducting health examinations, classifying, and concluding on the health status of citizens called up to fulfill the duty to join the People's Public Security who have passed the preliminary health screening and those who have registered to fulfill the duty to join the People's Public Security, conducted by the Medical Examination Board at the district level.

4. The Medical Examination Board at the district level is a specialized board operating on a part-time basis established by the Chairman of the People's Committee at the district level upon the proposal of the Health Department at the same level.

5. Re-examination of health for fulfilling the duty to join the People's Public Security is the process of conducting health examinations, classifying, and re-concluding on the health status of new recruits fulfilling the duty to join the People's Public Security, carried out by the Examination Board of the receiving unit.

6. The Re-examination Board of Health for Fulfilling the Duty to Join the People's Public Security is a specialized board operating on a part-time basis established by the Head of the Unit under the Ministry and the Director of the Public Security of the Province or Central City (hereinafter referred to as the provincial-level Public Security).

7. Medical Appraisal for Fulfilling the Duty to Join the People's Public Security is the use of equipment, techniques, and expertise to conduct health examinations and conclude on the health status of citizens registering to fulfill the duty to join the People's Public Security in cases of complaints.

8. Health Record for Fulfilling the Duty to Join the People's Public Security is documentation regarding the health condition of citizens registering to fulfill the duty to join the People's Public Security, including the health examination certificate for fulfilling the duty to join the People's Public Security and other relevant health documents.

9. Health Form for Fulfilling the Duty to Join the People's Public Security is a medical summary containing basic information about the health of citizens, serving as the basis for selecting citizens with sufficient health to fulfill the duty to join the People's Public Security.

Article 4. Classification of Health Status

1. Health classification is based on the health standards set forth in Appendix 1 issued together with this Circular.

2. Methods of scoring, recording health forms for fulfilling the duty to join the People's Public Security, and methods of health classification are implemented according to Clauses 2, 3, 4, and 5 of Article 9 of the Joint Circular No. 16/2016/TTLT-BYT-BQP dated June 30, 2016, of the Ministry of Health and the Ministry of Defense on medical examination for fulfilling military service duties (hereinafter referred to as Joint Circular No. 16/2016/TTLT-BYT-BQP).

Article 5. Health Standards

1. Physical fitness criteria for selecting citizens to fulfill the duty to join the People's Public Security are implemented according to the provisions in Table 1 of Appendix 1 issued together with this Circular.

2. Clinical and paraclinical health criteria for citizens selected to fulfill the duty to join the People's Public Security are implemented according to the current provisions in Table 2 of Appendix 1 issued together with this Circular.

3. Only citizens with health Class 1 (one) and Class 2 (two) and meeting the special indicators specified in Article 6 of this Circular are recognized as having sufficient health for selection.

Article 6. Special Indices

Citizens performing the duty to join the People's Police must ensure the following special indices:

1. Not addicted to narcotics or precursor substances.

2. Normal hair color and type.

3. No skin pigment disorders.

4. No tattoos on the skin, including micro-pigmentation.

5. No piercings in the ears (for males), nose, or other body parts for wearing jewelry.

6. No chronic diseases or social diseases.

7. No hypertrophic scars that cause contraction in the head, face, neck, forearms, hands, or feet areas.

Article 7. Health Certificate

1. The health certificate is printed on white A4 paper (21 x 29.7 cm) according to the model prescribed in Model 1 of Appendix 3 issued together with this Circular.

2. The health certificate consists of three parts:

a) Part I - Brief Curriculum Vitae and Medical History:

The Brief Curriculum Vitae is recorded by the County Police;

Medical history: recorded by the Commune Health Station and responsible for it;

b) Part II - Health Examination: recorded by the County Military Service Physical Examination Board;

c) Part III - Summary Table: recorded by the County Military Service Physical Examination Board on the left half and by the Re-examination Health Board of the unit receiving personnel on the right half.

3. Management of the health certificate for the duty to join the People's Police

a) Before joining the duty to join the People's Police, the health certificate for the duty to join the People's Police is managed by the County Police;

b) When citizens join the duty to join the People's Police, the health certificate for the duty to join the People's Police is handed over to the receiving unit for management.

4. The health certificate for the duty to join the People's Police is valid when:

a) Recorded according to the prescribed model;

b) Written with ink pen or ballpoint pen, not with pencil;

c) Writing is clear, without erasures or abbreviations;

d) All contents prescribed in the health certificate for the duty to join the People's Police are fully recorded;

đ) Not exceeding six months from the date the Physical Examination Board concludes on the health status, except in cases of special health developments.

Article 8. Implementation funds

1. Funding to ensure physical examinations, preliminary health screenings, health checks, health appraisals, and conducting tests for citizens performing the duty to join the People's Police shall be sourced from local budgets allocated for national defense and security work as stipulated in Article 3 of Joint Circular No. 16/2016/TTLT-BYT-BQP.

2. Funding to ensure re-examinations of health shall be arranged within the annual budget of the police units and localities.

3. Standards for consumable materials and funding for activities related to re-examinations of health for the duty to join the People's Police are implemented as prescribed in Appendix 2 issued together with this Circular.

Chapter II

ORGANIZATION OF HEALTH EXAMINATIONS

Article 9. Health Checks, Preliminary Screenings

Health checks and preliminary screenings for the duty to join the People's Police are carried out according to the provisions of Articles 4 and 5 of Joint Circular No. 16/2016/TTLT-BYT-BQP.

Article 10. Health Examinations

1. Composition, working principles, tasks of the Board, tasks of members of the Board, examination time, and organization of health examination rooms for the duty to join the People's Police are implemented according to the provisions of Article 6 of Joint Circular No. 16/2016/TTLT-BYT-BQP. The County Police assigns one medical officer to participate in the County Military Service Physical Examination Board.

2. Content of health examinations

a) Physical examination; clinical examination of various specialties according to the criteria prescribed in Appendix 1 issued together with this Circular; during the examination, if a citizen is examined and has a specialty score of 3 or higher, the examiner of that specialty is responsible for reporting to the Chairman of the Physical Examination Board for consideration and decision on continuing the examination of other specialties;

b) Para-clinical examination:

Blood test: blood formula; blood group, blood sugar, HIV, HBsAg, HCV;

Urine test: urine sugar, proteinuria, drugs and precursors;

Chest X-ray.

In cases where additional para-clinical examinations are required to serve the health conclusion as requested by the Physical Examination Board.

c) Classification of health status according to the provisions of Article 4 of this Circular.

d) Other standards are prescribed in Article 6 of this Circular.

Article 11. Medical Re-examination

1. Subjects for re-examination: All citizens who have been concluded by the Military Service Council at the district level to be fit for health to fulfill their duty to join the People's Public Security Force.

2. The Medical Re-examination Board

a) The Re-examination Board:

The head of public security units and localities shall issue a decision to establish the Board based on the proposal of the organizational personnel department after reaching consensus with the health department. Each unit and locality shall organize one Medical Re-examination Board, operating on a part-time basis.

b) Composition of the Council:

The Board consists of from 3 to 5 doctors, including at least 1 internist and 1 surgeon;

Chairman of the Board: Director of the hospital, Head of the Health Department or Medical Station Chief;

Deputy Chairman of the Board: Deputy Director of the hospital, Deputy Head of the Health Department or Deputy Medical Station Chief;

Members of the Board.

3. Content of Medical Re-examination

All health standards as prescribed in Articles 5 and 6 of this Circular. For the results of clinical tests already conducted at the Military Service Health Examination Board at the district level, only those clinical test contents not included in the health examination file will be re-examined.

4. Organization of Medical Re-examination Rooms

a) The arrangement of examination rooms must follow the principle of one-way, closed-loop flow, facilitating the examinees and ensuring minimum conditions for each specialty examination.

b) The number of examination rooms is determined based on the number of medical staff of the Medical Re-examination Board and actual circumstances, including:

Physical fitness, movement, Eye, Ear-Nose-Throat, Dental-Maxillofacial examination rooms;

Endocrine, urology-reproductive, dermatology, oncology examination rooms;

Circulatory, respiratory, digestive, mental-neurological examination rooms;

A laboratory meeting the conditions to conduct tests according to the health examination content at point b, Clause 2, Article 10 of this Circular;

X-ray room (if available);

Gynecological examination room (if available);

Conclusion room.

Article 12. Health Appraisal

The implementation of health appraisal for participation in the People's Public Security Force is carried out in accordance with Article 8 of the Joint Circular No. 16/2016/TTLT-BYT-BQP.

Article 13. Requirements for Citizens During Health Check and Preliminary Selection

1. Must present

a) The health examination summons issued by the Head of the Public Security Office at the district level;

b) Identity card or citizen identification card still valid.

2. Do not consume alcohol, beer, or stimulants.

3. Adhere to the rules of the health examination area and health check area.

Chapter III

RESPONSIBILITIES OF PUBLIC SECURITY UNITS AND LOCALITIES

Article 14. Health Department

1. Direct the health work of public security units and localities to grasp the health files of citizens called up to fulfill their duty to join the People's Public Security Force and organize the re-examination of new recruits' health according to regulations.

2. Direct and organize inspections of the re-examination of health work for fulfilling the duty to join the People's Public Security Force.

3. Summarize and report the results of health examination work for fulfilling the duty to join the People's Public Security Force according to regulations.

Article 15. Subordinate Units of the Ministry

1. The Command of Mobile Police, the Command of Security Protection, and units assigned quotas to select citizens to fulfill their duty to join the People's Public Security Force shall budget funds and organize the re-examination of health for new recruits joining the People's Public Security Force according to regulations.

2. The Planning and Finance Department is responsible for ensuring the funding for the re-examination of health for new recruits for public security units and localities and guiding the management, use, and settlement of accounts for the funding according to regulations.

Article 16. Provincial Public Security

1. Coordinate with the Health Department of the province, centrally-administered city to direct, organize the implementation and supervise the health examination for fulfilling the duty of participating in the People's Public Security according to the plan of the provincial Military Service Council.

2. Prepare budget and organize re-examination of health status in accordance with regulations.

3. Organize agreements with each unit receiving recruits regarding health standards, quantity, time, location, and method of recruitment.

4. Coordinate with the Health Department of the province, centrally-administered city to examine and resolve difficulties and complaints related to the work of health examination for fulfilling the duty of participating in the People's Public Security.

5. Summarize and report the results of the health examination work for fulfilling the duty of participating in the People's Public Security as prescribed.

6. Direct the provincial Public Security Health Service to advise on implementing health examination tasks and report the results of the health examination work for fulfilling the duty of participating in the People's Public Security to the Public Security Health Service of the Ministry of Public Security in accordance with the regulations of the Ministry of Public Security.

Article 17. County-level Public Security

1. Coordinate with the Health Office of the county and the County Health Center or County Hospital to propose members of the County Military Service Health Examination Board, develop plans for health examination agreements for citizens eligible to fulfill the duty of participating in the People's Public Security.

2. Summon citizens eligible to fulfill the duty of participating in the People's Public Security for health examination or health check-up according to the plan of the County Military Service Council.

3. Coordinate with relevant county agencies in organizing the health examination work for fulfilling the duty of participating in the People's Public Security according to the plan; monitor the quantity and quality of health of citizens coming for examination.

4. Manage the health certificates for fulfilling the duty of participating in the People's Public Security handed over by the County Military Service Health Examination Board.

5. Take the lead and coordinate with the County Health Office to organize the handover of health records of citizens called up to fulfill the duty of participating in the People's Public Security to the units receiving recruits according to the plan.

6. Coordinate with the County Health Office and related units and agencies to resolve complaints related to health examinations for fulfilling the duty of participating in the People's Public Security.

7. Summarize and report to the provincial Public Security the results of the health examination work, the situation of new recruit handovers after each selection and call-up of citizens to fulfill the duty of participating in the People's Public Security according to Appendix 3 issued together with this Circular.

8. Direct the county-level Public Security Health Service to proactively advise on implementing health examination tasks.

Article 18. Commune-level Public Security

1. Take the lead and coordinate with the Commune Health Station to organize preliminary health screening; compile lists of citizens fit for health to fulfill the duty of participating in the People's Public Security, through the Commune Military Service Council, report to the county-level Public Security and the County Military Service Council.

2. Urge citizens eligible to fulfill the duty of participating in the People's Public Security to go for health examination according to the plan of the County Military Service Council.

3. Announce the results of health examination according to the conclusion of the County Military Service Health Examination Board.

Chapter IV

IMPLEMENTING PROVISIONS

Article 19. Effective Date

1. This Circular takes effect from November 18, 2019.

2. This Circular replaces Joint Circular No. 09/2009/TTLT-BCA-BYT dated November 3, 2009 of the Ministry of Public Security and the Ministry of Health guiding health examination for selecting citizens to serve for a limited period in the People's Public Security.

Article 20. Responsibility for Implementation

1. The Director of the Health Service Bureau shall be responsible for guiding and inspecting the implementation of this Circular.

2. Heads of units under the Ministry of Public Security, Directors of Public Security of provinces, centrally-administered cities shall be responsible for enforcing this Circular.

During the implementation process, if there are difficulties or obstacles, relevant agencies, organizations, and individuals should reflect them to the Ministry of Public Security (through the Health Service Bureau) for timely guidance./.
