BASED ON THE DECREE NO. 56/2022/ND-CP dated August 24, 2022 of THE GOVERNMENT stipulating the functions, tasks, powers, and organizational structure of THE MINISTRY OF TRANSPORT;
At the proposal of the Director of the Science, Technology, and Environment Department and the Director of the Vietnam Registration Agency;
The Minister of Transport issues this Circular stipulating on the issuance, reissuance, temporary suspension, revocation of inspection certificates for motor vehicle traffic inspectors. This Circular stipulates on the issuance, reissuance, temporary suspension, revocation of inspection certificates for motor vehicle traffic inspectors (hereinafter referred to as inspection certificates).
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
1. This Circular applies to organizations and individuals related to the issuance, reissuance, temporary suspension, revocation of inspection certificates for motor vehicle traffic inspectors.
Article 2. Applicability
2. This Circular does not apply to organizations and individuals related to the issuance, reissuance, temporary suspension, revocation of inspection certificates for motor vehicle traffic inspectors under the management of the Ministry of National Defense and the Ministry of Public Security.
1. A motor vehicle traffic inspector (hereinafter referred to as an inspector) is a person who has been issued an inspection certificate to perform specialized work in inspecting and certifying motor vehicles, special-purpose motorcycles, and motor vehicle parts.
Article 3. Explanation of Terms
In this Circular, the following terms are understood as follows:
2. Inspector training is the provision of theoretical knowledge and skills to trainees to enable them to perform specialized work in inspecting motor vehicles and exhaust emissions from motorcycles and motorbikes.
3. Inspector practical training is the process where trainees apply the knowledge and skills acquired during training to specialized work at inspection facilities under the guidance and supervision of inspectors.
4. Inspector skill assessment is the examination of knowledge and skills of inspectors.
Article 4. Specialized Work of Inspectors
The specialized work of inspectors includes inspection work and certification work.
1. Inspection work:
a) Inspection of technical safety and environmental protection of motor vehicles (hereinafter referred to as motor vehicle inspection);
b) Inspection of technical safety and environmental protection of special-purpose motorcycles (hereinafter referred to as special-purpose motorcycle inspection);
c) Exhaust emission inspection of motorcycles and motorbikes.
2. Certification work:
a) Quality inspection and certification of technical safety and environmental protection of motor vehicles, special-purpose motorcycles, and motor vehicle parts (hereinafter referred to as quality inspection and certification);
b) Inspection and evaluation of the assurance of technical safety and environmental protection quality of motor vehicles, special-purpose motorcycles, and motor vehicle parts at production and assembly facilities, testing and certification facilities, and maintenance and repair facilities for motor vehicles (hereinafter referred to as quality assurance inspection);
c) Testing of motor vehicles and special-purpose motorcycles;
d) Testing of motor vehicle parts;
đ) Exhaust emission testing of motor vehicles;
e) Energy consumption testing of motor vehicles.
ISSUANCE AND REISSUANCE OF INSPECTION CERTIFICATES FOR INSPECTORS
Chapter II
TRAINING, PRACTICAL TRAINING, AND ISSUANCE AND REISSUANCE OF INSPECTION CERTIFICATES FOR INSPECTORS PERFORMING SPECIALIZED WORK IN MOTOR VEHICLE INSPECTION AND EXHAUST EMISSION INSPECTION OF MOTORCYCLES AND MOTORBIKES
Section 1
Article 5. Inspector Training
1. Content of training for Class III inspectors performing specialized work in exhaust emission inspection of motorcycles and motorbikes:
a) Responsibilities and authorities of organizations and individuals in exhaust emission inspection activities of motorcycles and motorbikes; violations and handling of violations in exhaust emission inspection activities of motorcycles and motorbikes; labor safety regulations; measurement regulations; conduct and professional ethics rules;
b) Legal regulatory documents, standards, technical regulations, procedures, operational guidelines, software related to specialized work in exhaust emission inspection of motorcycles and motorbikes;
c) Structure, operating principles, technical maintenance of exhaust emission inspection equipment for motorcycles and motorbikes;
d) Inspection methods in exhaust emission inspection of motorcycles and motorbikes.
2. Content of training for Class II inspectors performing specialized work in motor vehicle inspection:
a) History of formation, development, and construction of the inspection system; responsibilities and authorities of organizations and individuals in inspection activities; violations and handling of violations in inspection activities; labor safety regulations; measurement regulations; conduct and professional ethics rules;
b) Legal regulatory documents, national technical standards, national standards, procedures, operational guidelines related to specialized work in motor vehicle inspection;
c) Inspection methods in motor vehicle inspection activities;
d) Use of operational software programs related to motor vehicle inspection activities;
đ) Structure, operating principles, technical maintenance of motor vehicle inspection equipment;
e) Knowledge about technology installed on motor vehicles;
g) Recommendations of the International Organization for Motor Vehicle Inspection (CITA) in inspection activities;
h) Procedures, calculation methods, and evaluation of design documentation for modified motor vehicles; use of operational software programs related to certification of technical safety and environmental protection of modified motor vehicles.
3. Content of training for Class I inspectors performing specialized work in motor vehicle inspection:
a) Operational skills: analysis of structure, diagnosis of technical condition, faults, and causes of faults of motor vehicle components, systems, and assemblies, and remedial measures;
b) New technologies applied in motor vehicle inspection and evaluation;
c) Management and organizational skills for motor vehicle inspection activities at inspection facilities;
d) Analysis, evaluation, and diagnosis of the operational status of measuring instruments (inspection equipment).
4. Trainees must take a test after completing the training if they achieve 70% or more of the total score to meet the requirements; if they score less than 70% of the total score, they can retake the test once. If the trainee still fails after retaking the test, they must undergo training and testing according to the provisions of this Article if needed.
4. Trainees must take an examination upon completion of the vocational training. If the result reaches 70% or more of the total points, the requirements are met; if the result is below 70% of the total points, the trainee is only allowed to retake the examination once. In case the trainee still fails after retaking the examination, they must undergo further training and examination in accordance with the provisions of this Article if necessary.
Article 6. Practical Training for Vehicle Inspection Officers
1. Trainees applying for a Class III or Class I Vehicle Inspector Certificate are not required to undergo practical training as stipulated in Clauses 3 and 4 of this Article.
2. Within sixty days from the date of achieving the required results in professional training, trainees applying for a Class II Vehicle Inspector Certificate must undertake practical training at a vehicle inspection facility. If the trainee does not complete the practical training within the specified period, they must retake the professional training. The trainee shall be guided during the practical training by a Class I or Class II Vehicle Inspector with at least twenty-four months of experience and must prepare a report on the results of the practical training for Vehicle Inspectors as prescribed in Appendix III issued together with this Circular.
3. Duration and volume of practical training:
a) Three months for trainees who already hold a Vehicle Inspector Certificate and have performed one or more specialized tasks as provided for in Clause 2, Article 4 of this Circular, or have worked for over eighteen months at maintenance, repair, and automobile assembly facilities that meet the production, assembly, importation, and service provision conditions set by the Government (the time is based on the date of issuance of the first Vehicle Inspector Certificate or can be accumulated based on labor contracts and social insurance records): the trainee must conduct at least 100 inspections per stage for various types of vehicles (multiple stages may be practiced on a single vehicle); prepare vehicle records for at least fifteen vehicles; issue safety and environmental protection certificates for at least ten modified motor vehicles;
b) Six months for trainees who already hold a Vehicle Inspector Certificate and have performed one or more specialized tasks as provided for in Clause 2, Article 4 of this Circular, or have worked between twelve and eighteen months at maintenance, repair, and automobile assembly facilities that meet the production, assembly, importation, and service provision conditions set by the Government (the time is based on the date of issuance of the first Vehicle Inspector Certificate or can be accumulated based on labor contracts and social insurance records): the trainee must conduct at least 200 inspections per stage for various types of vehicles (multiple stages may be practiced on a single vehicle); prepare vehicle records for at least thirty vehicles; issue safety and environmental protection certificates for at least twenty modified motor vehicles;
c) Nine months for trainees who already hold a Vehicle Inspector Certificate and have performed one or more specialized tasks as provided for in Clause 2, Article 4 of this Circular, or have worked between six and twelve months at maintenance, repair, and automobile assembly facilities that meet the production, assembly, importation, and service provision conditions set by the Government (the time is based on the date of issuance of the first Vehicle Inspector Certificate or can be accumulated based on labor contracts and social insurance records): the trainee must conduct at least 300 inspections per stage for various types of vehicles (multiple stages may be practiced on a single vehicle); prepare vehicle records for at least forty-five vehicles; issue safety and environmental protection certificates for at least thirty modified motor vehicles;
d) A minimum of twelve months for cases not covered under points a, b, and c of this clause: the trainee must conduct at least 400 inspections per stage for various types of vehicles (multiple stages may be practiced on a single vehicle); prepare vehicle records for at least sixty vehicles; issue safety and environmental protection certificates for at least forty modified motor vehicles.
4. Content of practical training:
a) Using programs and software at the vehicle inspection facility including: vehicle data lookup; inspection management software; warning software; inspection evaluation programs; device control programs; and other business management programs;
b) Practicing the preparation of vehicle records and inspecting five stages;
c) Practicing the certification of safety and environmental protection for modified motor vehicles.
Article 7. Documents for issuing new or renewed certificates for vehicle inspection officers performing specialized vehicle inspection work and motorcycle exhaust emission inspection.
1. List of document components for issuing new or renewed certificates:
a) A request for issuance of a certificate for a vehicle inspection officer according to the form prescribed in Appendix V attached hereto;
b) A professional curriculum vitae according to the form prescribed in Appendix I attached hereto;
c) A copy issued from the original book or a certified copy of the corresponding professional degree certificate;
d) A copy of the notification of completion of specialized vocational training;
đ) A copy of the valid driving license for automobiles, as stipulated in point a, Clause 1, Article 4 of this Circular, for the corresponding specialized work;
e) A confirmation document of practical training for vehicle inspection officers according to the form prescribed in Appendix II attached hereto;
g) A copy of the certificate of vehicle inspection officer or labor contract and social insurance file (for cases where the time and volume of practical training for vehicle inspection officers are reduced according to Clause 3, Article 6 of this Circular).
2. Documents for requesting issuance of a new certificate for a vehicle inspection officer:
a) Class III Inspector: the document components prescribed in points a, b, c, and d, Clause 1 of this Article;
b) Class II Inspector: the document components prescribed in points a, b, c, d, đ, e, and g, Clause 1 of this Article;
c) Class I Inspector: the document components prescribed in points a, b, d, and đ, Clause 1 of this Article.
3. Documents for requesting renewal of a certificate for a vehicle inspection officer:
a) Renewal according to point a and point c, Clause 1, Article 9 of this Circular: the document components prescribed in points a, b, and đ, Clause 1 of this Article;
b) Renewal according to point b, Clause 1, Article 9 of this Circular: the document components prescribed in point a, Clause 1 of this Article.
Article 8. Procedures for issuing new certificates for vehicle inspection officers performing specialized vehicle inspection work and motorcycle exhaust emission inspection.
1. After receiving the notification of successful completion of vocational training (for Class III and Class I Inspectors) or the end of practical training (for Class II Inspectors), organizations or individuals requesting issuance of a new certificate for a vehicle inspection officer shall submit the documents as prescribed in Clause 2, Article 7 of this Circular through one of the following methods: directly, via postal service, via the public service portal, and the Ministry of Transport's single window electronic system.
2. Receiving documents:
a) In case of direct submission: on the same working day, the Vietnam Vehicle Inspection Agency will check the document components; if they are incomplete according to regulations, it will notify in writing to the organization or individual to supplement them; if complete, it will accept the documents;
b) In case of submission through other methods: within three working days from the date of receipt of the documents, the Vietnam Vehicle Inspection Agency will check the document components; if they are incomplete according to regulations, it will notify in writing or online to the organization or individual to supplement them; if complete, it will accept the documents.
3. Within thirty days from the date of receipt of all required documents, the Vietnam Vehicle Inspection Agency will notify and organize the assessment of the vocational skills of vehicle inspection officers for specialized vehicle inspection work. The individual will be assessed by an inspector of a higher class or an inspector of the same class with at least thirty-six months of experience. The assessment results will be recorded in the vehicle inspection officer assessment report according to the form prescribed in Appendix IV attached hereto.
4. Issuance of a certificate for a vehicle inspection officer or notification of the vocational assessment results:
a) Within five working days from the date of completion of the vocational assessment of a vehicle inspection officer, the Vietnam Vehicle Inspection Agency will issue a new certificate for a vehicle inspection officer according to the form prescribed in Appendix VII attached hereto for cases where the assessment results meet the requirements, or notify the vocational assessment results according to the form prescribed in Appendix VIII attached hereto for cases where the assessment results do not meet the requirements. If the individual has unsatisfactory assessment results, the procedures stipulated in this Article must be followed to obtain a new certificate for a vehicle inspection officer;
b) For specialized work in motorcycle exhaust emission inspection, within five working days from the date of receipt of all required documents, the Vietnam Vehicle Inspection Agency will issue a new certificate for a vehicle inspection officer according to the form prescribed in Appendix VII attached hereto.
5. The certificate for a vehicle inspection officer will be delivered through one of the following methods: directly, via postal service, via the public service portal, and the Ministry of Transport's single window electronic system.
6. The validity period of the certificate for a vehicle inspection officer for each specialized work is sixty months from the date of issuance.
Article 9. Procedures for reissuing certificates for vehicle inspection officers performing specialized vehicle inspection work, motorcycle exhaust inspection, and motorbike inspection.
1. Reissue of certificates for vehicle inspection officers shall be carried out in the following cases:
a) Expiry of validity;
b) Loss, damage, or incorrect information;
c) Revocation pursuant to Clause 1, Article 14 of this Circular.
2. Organizations and individuals requesting the reissue of certificates for vehicle inspection officers shall submit the application file in accordance with Clause 3, Article 7 of this Circular through one of the following methods: directly, via the postal service, via the public service gateway, and the Ministry of Transport's single window electronic system.
3. Receipt of application files:
a) In case of direct submission: on the same working day, the Vietnam Vehicle Inspection Agency will check the document components; if they are incomplete according to regulations, it will notify in writing to the organization or individual to supplement them; if complete, it will accept the documents;
b) In case of submission through other methods: within three working days from the date of receipt of the documents, the Vietnam Vehicle Inspection Agency will check the document components; if they are incomplete according to regulations, it will notify in writing or online to the organization or individual to supplement them; if complete, it will accept the documents.
4. Reissue of certificates for vehicle inspection officers performing specialized vehicle inspection work in cases specified in points a and c, Clause 1 of this Article.
a) Within thirty days from the date of receipt of all required documents, the Vietnam Vehicle Inspection Agency shall notify and organize an assessment of the vehicle inspector's professional skills for specialized vehicle inspection work. The individual shall be assessed by a higher-ranked inspector or an inspector of the same rank with at least thirty-six months of experience. The assessment results shall be recorded in the vehicle inspector assessment report according to the form prescribed in Appendix IV attached to this Circular;
b) Within five working days from the end of the professional skills assessment, the Vietnam Vehicle Inspection Agency shall reissue the certificate for vehicle inspection officers according to the form prescribed in Appendix VII attached to this Circular if the assessment results meet the requirements, or notify the professional skills assessment results according to the form prescribed in Appendix VIII attached to this Circular if the assessment results do not meet the requirements. In case the individual does not meet the assessment criteria, the procedures stipulated in this Article shall be followed to obtain the reissued certificate for vehicle inspection officers.
5. Reissue of certificates for vehicle inspection officers performing specialized vehicle inspection work in the case specified in point b, Clause 1 of this Article, and certificates for vehicle inspection officers performing specialized motorcycle exhaust inspection and motorbike inspection work. Within five working days from the date of receipt of all required documents, the Vietnam Vehicle Inspection Agency shall reissue the certificate for vehicle inspection officers according to the form prescribed in Appendix VII attached to this Circular.
6. Certificates for vehicle inspection officers shall be delivered through one of the following methods: directly, via the postal service, via the public service gateway, and the Ministry of Transport's single window electronic system. For the case specified in point b, Clause 1 of this Article, organizations and individuals must return the most recently issued certificate for vehicle inspection officers when receiving the reissued certificate (applicable to paper-based certificate issuance).
7. Validity period of certificates for vehicle inspection officers for each specific task:
a) In the case of reissuing certificates for vehicle inspection officers as prescribed in points a and c, Clause 1 of this Article: the validity period of the certificate for vehicle inspection officers for each specific task is sixty months from the date of issuance;
b) In the case of reissuing certificates for vehicle inspection officers as prescribed in point b, Clause 1 of this Article: the validity period of the certificate for vehicle inspection officers for each specific task shall be the same as the validity period of the most recently issued certificate.
Section 2
CERTIFICATES FOR VEHICLE INSPECTION OFFICERS PERFORMING SPECIALIZED TASKS IN THE INSPECTION OF SPECIAL PURPOSE VEHICLES AND CERTIFICATION
Article 10. Documents for issuing new and reissuing certificates for vehicle inspection officers performing specialized inspection work on special-purpose motorcycles and certification
1. List of document components for issuing new or renewed certificates:
a) A request for issuance of a certificate for a vehicle inspection officer according to the form prescribed in Appendix V attached hereto;
b) A professional curriculum vitae according to the form prescribed in Appendix I attached hereto;
c) A certified copy from the original record or a certified copy of a university degree in a related engineering field concerning motor vehicles, special-purpose motorcycles, and automotive parts;
d) A certified copy of one of the following documents: acceptance letter, employment letter, labor contract working at a unit under the Vietnam Vehicle Inspection Agency or an inspection facility or testing facility designated by the Vietnam Vehicle Inspection Agency;
đ) A confirmation of practical work in specialized fields according to the form prescribed in Appendix VI issued together with this Circular;
e) A certified copy of a valid automobile driving license (applicable for the specialized work specified in points a, b, and c, Clause 2, Article 4 of this Circular);
g) A certified copy of a document proving participation in one of the following tasks: compiling training materials; teaching; guiding business practices; drafting legal regulations, standards, technical norms, scientific research topics, and business procedures related to specialized work (applicable for the specialized work specified in Clause 2, Article 4 of this Circular).
2. Documents for requesting issuance of a new certificate for a vehicle inspection officer:
a) Class II Inspector: the documents specified in points a, b, c, d, đ, and e, Clause 1 of this Article;
b) Class I Inspector: the documents specified in points a, b, c, d, e, and g, Clause 1 of this Article.
3. Documents for requesting renewal of a certificate for a vehicle inspection officer:
a) Reissue according to the provisions of points a and d, Clause 1, Article 12 of this Circular: the documents specified in points a, b, and e, Clause 1 of this Article;
b) Reissue according to the provisions of point b, Clause 1, Article 12 of this Circular: the documents specified in point a, Clause 1 of this Article;
c) Reissue according to the provisions of point c, Clause 1, Article 12 of this Circular (applicable for inspectors performing specialized certification work): the documents specified in points a, b, đ, and e, Clause 1 of this Article.
Article 11. Procedures for issuing new certificates for vehicle inspection officers performing specialized inspection work on special-purpose motorcycles and certification
1. Organizations and individuals applying for issuance of new certificates for vehicle inspection officers shall submit the documents as stipulated in Clause 2, Article 10 of this Circular through one of the following methods: directly, via postal service, via the public service gateway, and the single window electronic information system of the Ministry of Transport.
2. Receiving documents:
a) In case of direct submission: on the same working day, the Vietnam Vehicle Inspection Agency will check the document components; if they are incomplete according to regulations, it will notify in writing to the organization or individual to supplement them; if complete, it will accept the documents;
b) In case of submission through other methods: within three working days from the date of receipt of the documents, the Vietnam Vehicle Inspection Agency will check the document components; if they are incomplete according to regulations, it will notify in writing or online to the organization or individual to supplement them; if complete, it will accept the documents.
3. Within five working days from the date of receiving complete documents as prescribed, the Vietnam Vehicle Inspection Agency shall issue new certificates for vehicle inspection officers according to the form prescribed in Appendix VII issued together with this Circular.
4. The certificate for vehicle inspection officers shall be delivered through one of the following methods: directly, via postal service, via the public service gateway, and the single window electronic information system of the Ministry of Transport.
5. The validity period of the certificate for vehicle inspection officers for each specialized work is sixty months from the date of issuance.
Article 12. Procedures for reissuing certificates for vehicle inspection officers performing specialized inspection work on special-purpose motorcycles and certification
1. Reissue of certificates for vehicle inspection officers shall be carried out in the following cases:
a) Expiry of validity;
b) Loss, damage, or incorrect information;
c) Supplementing the content of specialized work;
d) Revocation according to the provisions of Clause 1, Article 14 of this Circular.
2. Organizations and individuals applying for reissuance of certificates for vehicle inspection officers shall submit the documents as stipulated in Clause 3, Article 10 of this Circular through one of the following methods: directly, via postal service, via the public service gateway, and the single window electronic information system of the Ministry of Transport.
3. Receipt of application files:
a) In case of direct submission: on the same working day, the Vietnam Vehicle Inspection Agency will check the document components; if they are incomplete according to regulations, it will notify in writing to the organization or individual to supplement them; if complete, it will accept the documents;
b) In case of submission through other methods: within three working days from the date of receipt of the documents, the Vietnam Vehicle Inspection Agency will check the document components; if they are incomplete according to regulations, it will notify in writing or online to the organization or individual to supplement them; if complete, it will accept the documents.
4. Within five working days from the date of receiving complete documents as prescribed, the Vietnam Vehicle Inspection Agency shall reissue certificates for vehicle inspection officers according to the form prescribed in Appendix VII issued together with this Circular.
5. The certificate for vehicle inspection officers shall be delivered through one of the following methods: directly, via postal service, via the public service gateway, and the single window electronic information system of the Ministry of Transport. For cases specified in points b and c, Clause 1 of this Article, organizations and individuals must return the most recently issued certificate when receiving the reissued certificate (applicable for paper certificates).
6. The validity period of the certificate for vehicle inspection officers for each specialized work:
a) In cases of reissuing certificates for vehicle inspection officers according to the provisions of points a, c, and d, Clause 1 of this Article: the validity period of the certificate for vehicle inspection officers for each specialized work is sixty months from the date of issuance;
b) In the case of reissuing certificates for vehicle inspection officers as prescribed in point b, Clause 1 of this Article: the validity period of the certificate for vehicle inspection officers for each specific task shall be the same as the validity period of the most recently issued certificate.
Chapter III
SUSPENSION AND REVOCATION OF THE CERTIFICATE FOR VEHICLE INSPECTION OFFICERS
Article 13. Suspension of the Inspection Certificate
1. The Inspection Certificate shall be suspended for 30 days when the holder commits any of the following acts:
a) Altering the results of certification or inspection (except in cases provided for in point d, Clause 1 of Article 14 of this Circular);
b) Engaging in harassment, causing difficulties, or inconvenience to organizations or individuals during the performance of duties;
c) Failing to perform assigned tasks without a valid reason;
d) Violating labor discipline regulations or internal rules and regulations of the agency or unit.
2. Upon receiving a justified complaint or reflection indicating that an inspector has committed any act stipulated in Clause 1 of this Article, the Vietnam Inspectorate Bureau shall issue a decision to suspend the effect of the Inspection Certificate within seven working days and notify the inspection facility using the violating inspector and the local Department of Transport, while simultaneously publishing such information on the Vietnam Inspectorate Bureau's website.
Article 14. Revocation of the Inspection Certificate
1. The Inspection Certificate shall be revoked when the holder falls under any of the following circumstances:
a) Simultaneously conducting inspections or confirming inspection results at two or more inspection facilities at the same time on the same day;
b) Fabricating documents to obtain the Inspection Certificate;
c) Being temporarily suspended from inspecting three or more times within a continuous period of twelve months;
d) Being convicted by a court judgment for violations related to certification or inspection activities;
đ) Using tools or software to modify vehicle data, inspection data, or certification data to legitimize vehicle information or inspection results;
e) Losing or having restricted civil capacity;
g) Not directly performing specialized work related to vehicle inspection for a continuous period of twelve months or longer.
2. Within seven working days from the date of determining that an inspector falls under any of the circumstances stipulated in Clause 1 of this Article, the Vietnam Inspectorate Bureau shall issue a decision to revoke the Inspection Certificate, send it to the inspection facility using the violating inspector, the local Department of Transport for coordination, and publish it on the Vietnam Inspectorate Bureau's website.
3. In cases where the Inspection Certificate is revoked according to point g, Clause 1 of this Article, reissuing the Inspection Certificate shall be carried out in accordance with the provisions of Article 9 or Article 12 of this Circular.
4. In cases where the Inspection Certificate is revoked according to points a, b, c, d, đ, and e, Clause 1 of this Article, reissuing the Inspection Certificate shall be carried out in accordance with the provisions of Article 9 or Article 12 of this Circular twelve months after the revocation date.
Chapter IV
IMPLEMENTATION
Article 15. Responsibilities of the Vietnam Inspectorate Bureau
1. Organizing training sessions for inspectors in accordance with the provisions of this Circular.
2. Implementing the issuance, reissuance, suspension, and revocation of Inspection Certificates.
3. Publicizing training plans, schedules, outcomes, and evaluations of inspector skills on the Vietnam Inspectorate Bureau's website.
Article 16. Responsibilities of the Department of Transport
Reporting to the Vietnam Inspectorate Bureau when an inspector within its jurisdiction falls under any of the circumstances stipulated in Clause 1 of Article 13 and Clause 1 of Article 14 of this Circular.
Article 17. Responsibilities of the inspection body proposing to issue new or renewed inspection certificates
1. Shall be responsible for assigning personnel to guide and confirm the internship process for inspection officers.
2. Shall be responsible for assigning inspection officers to participate in updating and professional training programs.
3. Shall notify the Vietnam Inspection Agency when an inspection officer of the inspection body falls under any of the cases stipulated in Clause 1, Article 13 and Clause 1, Article 14 of this Circular.
Article 18. Effective Date
This Circular takes effect from January 1, 2025; Point d, Clause 1, Article 14 of this Circular shall apply from January 1, 2026 for inspection officers conducting specialized vehicle inspection work.
Article 19. Transitional Provisions
1. Motor vehicle inspection officers who have completed five stages and obtained certification before this Circular takes effect may continue to perform specialized motor vehicle type II inspection work until the expiration date on their certificate.
2. High-level motor vehicle inspection officers who obtained certification before this Circular takes effect may continue to perform specialized motor vehicle type I inspection work until the expiration date on their certificate.
3. Motor vehicle inspection officers who have been certified but have not completed five stages before this Circular takes effect may continue to perform motor vehicle inspection work and must submit an application for renewal of the motor vehicle type II inspector certificate within twelve months from the date this Circular takes effect, in accordance with the provisions of this Circular.
4. Trainees who complete the inspection officer internship training before this Circular takes effect may continue to intern as inspection officers in accordance with the laws at the time of completing the training and must follow the procedures for issuing new inspection officer certificates as stipulated in this Circular./.
