activities of calibration, verification, testing management and organization of scientific and technological tasks of the State Bank of Vietnam

 

Pursuant to the Law on Science and Technology dated June 18, 2013;

Decree No. 08/2014/ND-CPdated January 27, 2014, issued by the Government detailing and guiding the implementation of certain provisions of the Law on Science and Technology;

Decree No. 70/2018/ND-CP dated May 15, 2018, issued by the Government stipulating the management and use of assets formed through the implementation of scientific and technological tasks funded by state capital;

Decree No.102/2022/ND-CP dated December 12, 2022, issued by the Government stipulating the functions, tasks, authorities, and organizational structure of the State Bank of Vietnam;

At the proposal of the Director of the Legal Department;

The Governor of the State Bank of Vietnam promulgates the Circular on the management and organization of scientific and technological tasks of the State Bank of Vietnam.

 

PART I

GENERAL PROVISIONS

 

Article 1. Scope of Regulation

Article 1. This Circular stipulates the management and organization of scientific and technological tasks under the management responsibility of the State Bank of Vietnam (hereinafter referred to as scientific and technological tasks).

Clause 2. The management and organization of national-level scientific and technological tasks shall be managed by the Ministry of Science and Technology, with the State Bank of Vietnam (hereinafter referred to as the State Bank) being entrusted to lead their implementation according to the guidance of the Ministry of Science and Technology and relevant legal documents.

Article 2. Applicability

This Circular applies to units under the State Bank, organizations, and individuals related to the activities of managing and organizing the implementation of scientific and technological tasks.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

Point 1. An independent consultant is a person with a bachelor's degree or higher, having competence and experience in the relevant field of consultancy.

Point 2. Ordering the implementation of scientific and technological tasks refers to setting requirements for scientific and technological products, providing funding for organizations and individuals to research and create scientific and technological products through contracts for the implementation of scientific and technological tasks.

Point 3. Selecting the implementation of scientific and technological tasks involves choosing the most suitable organization or individual with the appropriate conditions and capabilities to carry out scientific and technological tasks through the examination and evaluation of registration files for selection in accordance with this Circular.

Point 4. Direct assignment for the implementation of scientific and technological tasks involves designating an organization or individual with sufficient capability, conditions, and relevant expertise to undertake scientific and technological tasks.

Point 5. A Council is one of the following Councils: Advisory Council at the ministry level for proposed scientific and technological tasks; Council for determining scientific and technological tasks at the ministry level; Council for selecting or directly assigning the implementation of scientific and technological tasks at the ministry level; Council for evaluating and accepting the results of the implementation of scientific and technological tasks at the ministry level; Council for determining scientific and technological tasks at the local level; Council for selecting or directly assigning the implementation of scientific and technological tasks at the local level; Council for evaluating and accepting the results of the implementation of scientific and technological tasks at the local level.

Point 6. The chairperson of the session of the Council is the Chairman of the Council or the Vice-Chairman of the Council authorized by the Chairman of the Council.

Point 7. Administrative secretaries of the Councils and financial review teams are staff members of the Institute of Banking Strategy responsible for preparing documents and assisting the Councils and financial review teams.

Article 4. Classification of scientific and technological tasks under the management responsibility of the State Bank 1. Ministry-level scientific and technological tasks:

a) Ministry-level scientific and technological tasks are tasks of significant importance and urgency for the development of the banking industry, addressing scientific and technological issues within the banking sector. Ministry-level scientific and technological tasks include ministry-level scientific and technological topics or projects, or other forms as prescribed by law;

b) Ministry-level scientific and technological topic is a ministry-level scientific and technological task with the aim of providing scientific evidence and proposing timely scientific and technological solutions to address practical issues in the banking industry;

c) Ministry-level scientific and technological project is a ministry-level scientific and technological task whose research results consist of proposals or draft mechanisms, policies, procedures, regulations, legal documents with sufficient theoretical and practical foundations to serve the establishment of mechanisms, policies, and laws within the State Bank's regulatory domain.

2. Basic-level scientific and technological tasks:

a) Basic-level scientific and technological tasks are tasks aimed at resolving scientific and technological issues within the scope of responsibilities of units under the State Bank, including basic-level scientific and technological topics or projects, or other forms as prescribed by law;

b) Basic-level scientific and technological topic is a basic-level scientific and technological task primarily focused on understanding the nature and laws, proposing solutions to address scientific and technological issues in the banking field at the unit level under the State Bank, with the aim of applying them to the practical work of the unit;

c) Basic-level scientific and technological project is a basic-level scientific and technological task aimed at resolving scientific and technological issues of units under the State Bank, with the main goal of serving the creation of products, management processes, enhancing the technological or managerial level of the unit.

3. Emergency scientific and technological tasks are tasks aimed at researching and resolving urgent issues arising from practical requirements in the banking industry.

4. Scientific and technological tasks involving content related to state secrets are governed by the Law on Protection of State Secrets, the List of State Secrets in the Banking Sector issued by the Prime Minister, and must comply with the Regulations on Protection of State Secrets of the State Bank.

Article 5. Code of scientific and technological tasks

1. The code of ministry-level scientific and technological tasks is recorded as follows: ĐTNH.XXX/YY; ĐANH.XXX/YY, where:

a) ĐTNH is the common symbol for ministry-level scientific and technological topics;

b) ĐANH is the common symbol for ministry-level scientific and technological projects;

c) Group XXX is a group of three digits recording the serial number of ministry-level scientific and technological tasks listed in the decision to commission ministry-level scientific and technological tasks;

d) Group YY is a group of two digits recording the last two digits of the year when the ministry-level scientific and technological task begins implementation;

đ) Between the group of common alphabetic symbols and the group of task serial numbers is a period, between the group of task serial numbers and the group of year designation digits is a forward slash.

2. The code of basic-level scientific and technological tasks is recorded as follows: ĐTNH-CS.XXX/YY; ĐANH-CS.XXX/YY, where:

a) ĐTNH-CS is the common symbol for basic-level scientific and technological topics;

b) ĐANH-CS is the common symbol for basic-level scientific and technological projects;

c) Group XXX is a group of three digits recording the serial number of basic-level scientific and technological tasks listed in the decision to commission basic-level scientific and technological tasks;

d) Group YY is a group of two digits recording the last two digits of the year when the basic-level scientific and technological task begins implementation;

đ) Between the group of common alphabetic symbols and the group of task serial numbers is a hyphen, between the group of task serial numbers and the group of year designation digits is a forward slash.

3. Codes for other types of scientific and technological tasks as prescribed by law, if they arise, shall be assigned according to the principle similar to Clause 1 and Clause 2 of this Article. In which, the group of common alphabetic symbols is an abbreviation of the type of scientific and technological task.

3. The code numbers for other types of scientific and technological tasks as prescribed by law, if they arise, shall be assigned according to the principle similar to Clause 1 and Clause 2 of this Article. In this context, the group of common letter symbols is an abbreviation of the type of scientific and technological task.

Article 6. Methods for assigning scientific and technological tasks

1. The methods for assigning scientific and technological tasks include selection and direct assignment.

2. The direct assignment method shall only be applied to scientific and technological tasks falling under any of the following cases:

a) Scientific and technological tasks involving state secrets, special services for security and defense;

b) Urgent scientific and technological tasks;

c) Scientific and technological tasks that can only be carried out by one scientific and technological organization with sufficient human resources, expertise, and equipment.

3. The selection method shall apply to scientific and technological tasks not covered by Clause 2 of this Article.

Article 7. Management of scientific and technological tasks

1. Principles of managing scientific and technological tasks:

a) Ensuring centralized and unified management of scientific and technological tasks within the Banking sector;

b) Ensuring autonomy, promoting creativity, and enhancing responsibility of organizations and individuals in implementing scientific and technological tasks of the Banking sector;

c) Ensuring efficient use of State Bank resources to carry out scientific and technological tasks of the Banking sector;

d) Ensuring compliance with all legal provisions on scientific and technological activities; mechanisms, policies, strategies, and plans for developing science and technology in the Banking sector.

2. Contents of managing scientific and technological tasks:

a) Determining the annual list of scientific and technological tasks;

b) Organizing the implementation of scientific and technological tasks;

c) Monitoring, inspecting, and evaluating the application of results from scientific and technological tasks;

d) Publishing information, preserving research results in science and technology;

đ) Managing funds for implementing scientific and technological tasks:

(i) For scientific and technological tasks using state budget funds, they shall be implemented according to the provisions of the State Budget Law and related legal documents;

(ii) For scientific and technological tasks using State Bank funds, they shall be implemented according to financial regulations and guidelines of the State Bank;

e) Other related tasks.

3. Online management of scientific and technological tasks:

a) Organizations and individuals responsible for leading or participating in scientific and technological tasks must comply with online management procedures and processes for scientific and technological tasks on the Banking Science and Technology Information Portal at the address: www.khoahocnganhang.org.vn;

b) The Institute of Banking Strategy is the unit managing and operating the Banking Science and Technology Information Portal; it has the responsibility to guide organizations and individuals in exploiting and updating online information on the management of scientific and technological tasks.

 

Chapter II

MINISTRY-LEVEL SCIENTIFIC AND TECHNOLOGICAL TASKS

Section 1

ORDERING THE IMPLEMENTATION OF MINISTRY-LEVEL SCIENTIFIC AND TECHNOLOGICAL TASKS

 

Article 8. Requirements for ministry-level scientific and technological tasks

1. Consistent with the strategy, plan, and orientation for the development of science and technology in the Banking sector during each period.

2. Not overlapping in content with scientific and technological tasks of the Banking sector completed in the last five years.

3. Not violating intellectual property regulations, inventions, and patents both domestically and internationally recognized by relevant intellectual property protection agencies.

4. Having a budget estimate for implementing the task that is appropriate to the capacity of state budget funds or State Bank funds and current financial regulations.

5. Implementation time not exceeding thirty-six months from the date of signing the contract for implementing the scientific and technological task.

6. Proposing specific solutions and application addresses or having commercialization potential.

7. For ministry-level scientific and technological topics: Publishing research results in the form of articles in domestic and/or international specialized journals (belonging to the ISI or Scopus system or ASEAN citation system) during the implementation period of the ministry-level scientific and technological task as stated in the contract and not later than the acceptance date.

8. For ministry-level scientific and technological projects: Proposing the establishment, revision of mechanisms, policies, procedures, and regulatory documents that meet scientific and practical evidence and have a roadmap for implementation.

Article 9. Orientation of scientific and technological tasks for the Banking Industry

1. The Institute of Banking Strategy shall advise on the development of the orientation of scientific and technological tasks for the Banking Industry, to be submitted to the Governor of the State Bank of Vietnam (hereinafter referred to as the Governor) for approval before March 31 each year.

2. The orientation of scientific and technological tasks for the Banking Industry shall be developed based on one or more of the following grounds:

a) Requirements from Party leadership, State leadership, and leadership of the State Bank of Vietnam;

b) Strategies, plans, and development programs of the State Bank of Vietnam and strategies, master plans, and development plans of sectors managed by the State Bank of Vietnam;

c) Development strategy for science and technology and five-year or ten-year scientific and technological goals and tasks of the State Bank of Vietnam;

d) Science and technology activity plans of the Ministry of Science and Technology and the State Bank of Vietnam.

3. The orientation of scientific and technological tasks shall be widely publicized and announced on the banking industry's science and technology information portal, and notified to organizations and individuals who have proposed them, except for scientific and technological tasks with contents related to state secrets as stipulated in Clause 4, Article 4 of this Circular.

Article 10. Proposing Departmental Scientific and Technological Tasks

1. All organizations and individuals have the right to participate in proposing departmental scientific and technological tasks for the State Bank of Vietnam.

2. Organizations and individuals within the State Bank of Vietnam shall submit proposals for departmental scientific and technological tasks through their own organization using Form No. 02 attached as Appendix I to this Circular. Organizations with the responsibility to review, select, and compile proposals for departmental scientific and technological tasks from individuals within their organization shall send these proposals to the Institute of Banking Strategy using Form No. 03 attached as Appendix I to this Circular.

3. Organizations and individuals outside the State Bank of Vietnam shall directly submit proposals for departmental scientific and technological tasks to the Institute of Banking Strategy using Form No. 01 attached as Appendix I to this Circular.

Article 11. Advisory Council foundation for proposing departmental scientific and technological tasks

1. Based on the compilation of a list of proposals for departmental scientific and technological tasks from organizations and individuals, the Director of the Institute of Banking Strategy shall establish an Advisory Council to review and assess proposals for departmental scientific and technological tasks.

2. The Council shall consist of between 05 and 07 members and 01 administrative secretary. Members of the Council include: Chairperson, 01 Deputy Chairperson, 02 opposing members, 01 secretary member, and other members. Members of the Council are representatives of proposing organizations, representatives of organizations within the banking industry, scientists, and managers with appropriate expertise and qualifications relevant to the research fields of proposed departmental scientific and technological tasks.

3. The Council shall have the duty to review and assess the quality of proposals for departmental scientific and technological tasks according to the following aspects: name of proposal, urgency and novelty of the proposal, feasibility, and expected outcomes when implementing the task. In necessary cases, the Council may recommend for the proposer to refer to and modify the proposal to meet scientific and practical requirements, and report to their organization before resubmitting to the Institute of Banking Strategy.

4. Working methods of the Council:

a) At least 05 working days prior to the meeting of the Council, the Institute of Banking Strategy shall be responsible for sending documents to the members of the Council. Documents include: Proposal form for departmental scientific and technological tasks; Summary table of departmental scientific and technological tasks proposed by organizations and individuals; Results of information searches regarding related scientific and technological tasks;

b) The person in charge of convening the Council meeting shall convene the Council meeting and decide on the meeting format, either in person, online, or a combination of both. The Council shall convene when at least 2/3 of its members are present, including the person in charge of the meeting, opposing members, and the secretary member; The Council meeting shall be conducted in accordance with the procedures specified in Form No. 08 attached as Appendix II to this Circular;

c) Based on the evaluation results of the Council members, the Council secretary shall compile the proposals for departmental scientific and technological tasks recommended for submission to the Advisory Council to determine departmental scientific and technological tasks, along with recommendations for proposers to make modifications if necessary, as specified in Form No. 04 attached as Appendix II to this Circular.

5. Based on the evaluation results of the Council, the Institute of Banking Strategy shall be responsible for compiling the proposals according to Form No. 04 attached as Appendix I to this Circular, to be submitted to the Governor for consideration and decision on the list of tasks to be submitted to the Advisory Council to determine departmental scientific and technological tasks.

Article 12. Advisory Board determines scientific and technological tasks at the ministry level

1. The Institute for Banking Strategy shall submit to the Governor for decision on establishing Advisory Boards to determine scientific and technological tasks at the ministry level.

2. The Board shall consist of from five to seven members and one administrative secretary. Members of the Board include: Chairperson, one Deputy Chairperson, two reviewing members, one secretarial member, and other members. Board members are representatives of the basic advisory board members for scientific and technological tasks at the ministry level, representatives of organizations within and outside the State Bank, scientists, managers with competence and expertise appropriate to the research field of scientific and technological tasks at the ministry level.

3. The Board has the task of advising and determining scientific and technological tasks at the ministry level proposed by the State Bank for commissioning, including: determining the name, goal orientation, main content, expected products, and implementation methods of each scientific and technological task at the ministry level.

4. Working methods of the Council:

a) At least 05 working days prior to the meeting of the Council, the Institute of Banking Strategy shall be responsible for sending documents to the members of the Council. Documents include: Proposal form for departmental scientific and technological tasks; Summary table of departmental scientific and technological tasks proposed by organizations and individuals; Results of information searches regarding related scientific and technological tasks;

b) Members of the Board provide comments on the proposed scientific and technological tasks according to Model No. 01 attached as Appendix II of this Circular and send them to the Institute for Banking Strategy at least one working day before the Board meeting;

c) The person in charge of convening and chairing the Board meeting shall convene the Board meeting and decide to hold it in person, online, or a combination of both. The Board shall meet when at least two-thirds of its members participate, including the person in charge of convening and chairing the Board meeting, two reviewing members, and the secretarial member;

d) Board members are individually responsible for their advisory opinions, and keep confidential information related to the content of the Board meeting;

đ) Individuals and representatives of organizations proposing scientific and technological tasks at the ministry level may be invited to attend the Board meeting;

e) For proposals that are recommended "not to proceed," the Institute for Banking Strategy shall notify the reasons to the organization or individual proposing the scientific and technological task at the ministry level.

5. The Board meeting shall be conducted in accordance with the procedures specified in Model No. 08 attached as Appendix II of this Circular.

Article 13. Approval of the list of commissioned scientific and technological tasks at the ministry level

1. Based on the minutes of the Advisory Board meeting to determine scientific and technological tasks at the ministry level, the Institute for Banking Strategy shall compile the list of commissioned scientific and technological tasks at the ministry level and submit it to the Governor for approval. In case of necessity, the Governor may request the Institute for Banking Strategy to seek additional opinions from independent consultants before deciding to approve the list.

2. The content of the list of commissioned scientific and technological tasks at the ministry level approved by the Governor includes: task name, goal orientation, expected products, estimated time for implementation, method of assigning the task.

3. Within seven working days from the date the list of commissioned scientific and technological tasks at the ministry level is approved by the Governor, the Institute for Banking Strategy shall be responsible for publishing this list on the Science and Technology Information Portal of the Banking Industry.

Article 14. Determination of urgent scientific and technological tasks at the ministry level

1. When important and urgent issues arise from practical activities related to the development of the banking industry or assigned by the leadership of the State Bank, organizations and individuals shall submit proposal files for urgent scientific and technological tasks at the ministry level to the Institute for Banking Strategy.

2. Proposal files for urgent scientific and technological tasks at the ministry level include: task assignment document (if any); task proposal document for scientific and technological tasks at the ministry level by the organization or individual; detailed description of the scientific and technological task at the ministry level according to Model No. 02 attached as Appendix III of this Circular; expected products and budget estimate for implementation.

3. The Institute for Banking Strategy shall submit to the Governor for approval of urgent scientific and technological tasks at the ministry level without depending on the annual science and technology plan of the State Bank.

 

Section 2

SELECTION OR DIRECT ASSIGNMENT IMPLEMENTATION MINISTRY-LEVEL SCIENTIFIC AND TECHNOLOGICAL TASKS

 

Article 15. Conditions for participation in selection or direct assignment to perform ministry-level scientific and technological tasks

1. An organization with functions suitable for the specialized field of the ministry-level scientific and technological task ordered by the State Bank has the right to register to participate in the selection or be directly assigned to perform the ministry-level scientific and technological task of the State Bank, except for the following cases:

a) At the time of submitting the application, it has not fully repaid the recovered funds according to the contract for performing the previous ministry-level scientific and technological task (if any);

b) It has committed violations leading to being suspended from performing the ministry-level scientific and technological task for a period of three years from the date of the competent authority's decision to the date of submitting the application.

2. The individual registering to lead the ministry-level scientific and technological task must meet the following requirements:

a) Having a bachelor’s degree or higher;

b) Having relevant expertise;

c) Leading or primarily participating in the development of the description of the ministry-level scientific and technological task;

d) Having the ability to organize and ensure sufficient time to lead the research work of the ministry-level scientific and technological task;

đ) Not falling under any of the following circumstances:

(i) The individual leading the ministry-level scientific and technological task was evaluated at the level of "unsatisfactory" within three years from the date of the conclusion of the Evaluation and Acceptance Committee;

(ii) Committing violations leading to being suspended from performing the ministry-level scientific and technological task for a period of three years from the date of the suspension decision;

(iii) Being currently under criminal investigation or having been convicted without having had the criminal record expunged.

Article 16. Announcement of Selection to Perform Ministry-Level Scientific and Technological Tasks

The list of ministry-level scientific and technological tasks to be implemented through the selection process will be announced by the Institute of Banking Strategy on the Science and Technology Information Portal of the banking industry at least twenty-one days before the deadline for receiving applications.

Article 17. Application Documents for Participation in Selection or Direct Assignment to Perform Ministry-Level Scientific and Technological Tasks

1. The application documents for participation in the selection or direct assignment of the ministry-level scientific and technological task include:

a) A document from the organization or individual registering to lead the implementation of the ministry-level scientific and technological task sent to the Institute of Banking Strategy to register the ministry-level scientific and technological task according to Model No. 01 attached as Appendix III to this Circular;

b) The description of the ministry-level scientific and technological task according to Model No. 02 attached as Appendix III to this Circular. The description of the ministry-level scientific and technological task must fully reflect the objectives, research content, and organizational methods as stipulated in the task ordering decision;

c) A summary of the scientific and technological activities of the organization registering to lead the implementation of the ministry-level scientific and technological task according to Model No. 03 attached as Appendix III to this Circular;

The scientific curriculum vitae of the individual registering to lead, secretary, and other individuals registering to primarily participate in the research of the ministry-level scientific and technological task, confirmed by the organization according to Model No. 04 attached as Appendix III to this Circular;

d) The scientific curriculum vitae of domestic experts according to Model No. 05 attached as Appendix III to this Circular; the scientific curriculum vitae of foreign experts according to Model No. 06 attached as Appendix III to this Circular (in case the task description includes hiring foreign scientific experts);

đ) A document confirming the agreement of the organizations and individuals registering to cooperate in implementing the ministry-level scientific and technological task according to Model No. 07 attached as Appendix III to this Circular;

e) Results of information searches about related ministry-level scientific and technological tasks according to Model No. 08 attached as Appendix III to this Circular (if applicable).

2. The application package for participation in the selection or direct assignment to perform the ministry-level scientific and technological task must be sealed and clearly marked on the outside with the name of the ministry-level scientific and technological task; the name and address of the organization or individual registering to lead the ministry-level scientific and technological task; and the list of documents and texts contained in the application package.

3. Number of application packages: One original package (with stamps and signatures), printed on A4 paper using Unicode Vietnamese font according to national standard TCVN 6909:2001, font size 14; one electronic copy (PDF format, without password protection); and ten copies.

4. The application package for participation in the selection or direct assignment to perform the ministry-level scientific and technological task must be submitted to the Institute of Banking Strategy fully and on time as announced. The receipt date of the application package is the date stamped by the post office (in case of mailing) or the stamp received by the Institute of Banking Strategy's archives department (in case of direct submission).

Article 18. Opening and verifying the validity of registration files for selection or direct assignment to perform ministry-level science and technology tasks

1. After the deadline for receiving registration files for selection has ended, within a maximum period of 15 days, the Institute of Banking Strategy shall carry out the opening, verification, and confirmation of the validity of the files with the participation of representatives from related organizations (if necessary), and representatives of organizations and individuals who have registered to participate in the selection process.

2. A valid file is a file that fully meets the contents stipulated in Article 17 of this Circular. Valid files will be submitted to the Advisory Board for Selection or Direct Assignment to Perform Ministry-Level Science and Technology Tasks for review and evaluation.

3. The results of opening the files shall be recorded in the Minutes according to Model No. 09 attached as Appendix III to this Circular.

Article 19. Advisory Board for Selection or Direct Assignment to Perform Ministry-Level Science and Technology Tasks

1. The Institute of Banking Strategy shall submit to the Governor for a decision to establish the Advisory Board for Selection or Direct Assignment to Perform Ministry-Level Science and Technology Tasks.

2. The Board shall consist of from 05 to 07 members and 01 administrative secretary. The members of the Board include: Chairman, 01 Deputy Chairman, 02 reviewing members, 01 secretary member, and other members. Members of the Board are scientists and managers with competence and expertise appropriate to the research field of the ministry-level science and technology task. Members participating in the Advisory Board to determine the ministry-level science and technology task are prioritized to be invited to join the Advisory Board for Selection or Direct Assignment for the corresponding ministry-level science and technology task.

3. At least 05 working days before the meeting of the Board, the Institute of Banking Strategy shall be responsible for sending the registration files for selection or direct assignment of the ministry-level science and technology task to the members of the Board. Each member shall comment on the registration files for selection or direct assignment according to Model No. 10 attached as Appendix III to this Circular and send it back to the Institute of Banking Strategy at least 01 working day before the meeting.

4. The person in charge of chairing the Board meeting shall convene the Board meeting and decide on the form of the meeting, either in person, online, or a combination of both. The Board shall only meet when at least 2/3 of the Board members participate, including the person in charge of chairing the Board meeting, 02 reviewing members, and the secretary member of the Board.

In case of necessity, the Board may invite representatives from related organizations to attend the Board meeting; opinions of the invited delegates are only for reference.

5. The Board meeting shall be conducted according to the procedure specified in Model No. 16 attached as Appendix III to this Circular.

6. The results of the Board meeting shall be communicated to the organizations and individuals who have registered for selection or direct assignment of the ministry-level science and technology task immediately after the conclusion of the meeting.

7. Organizations and individuals proposed for selection or direct assignment to perform the ministry-level science and technology task shall be responsible for completing the files according to the opinions of the Board within 07 working days after the meeting, with confirmation from the person in charge of chairing the Board meeting and the reviewing members according to Model No. 14 attached as Appendix III to this Circular, and send it back to the Institute of Banking Strategy.

Article 20. The Financial Review Team for Ministry-level Science and Technology Tasks

1. The Financial Review Team for Ministry-level Science and Technology Tasks shall be established by the Governor based on the proposal of the Institute of Banking Strategy (hereinafter referred to as the Review Team), consisting of 03 members and 01 administrative secretary, including:

a) The head of the Review Team is a leader of the Institute of Banking Strategy;

b) The deputy head of the Review Team is a leader of the Department of Finance and Accounting;

c) One member of the Review Team is the Chairman or Vice-Chairman or reviewer member of the Selection Council or directly assigned to implement the Ministry-level Science and Technology Task;

d) The Institute of Banking Strategy appoints one individual to serve as the administrative secretary for the Review Team. The administrative secretary is responsible for preparing documents and assisting the Review Team;

e) The head of the Review Team may invite representatives of organizations or individuals related to attend and express opinions at the Review Team's meeting.

2. The meeting file for reviewing financial estimates for Ministry-level Science and Technology Tasks includes:

a) Minutes of the Advisory Council's selection meeting or directly assigned to implement the Ministry-level Science and Technology Task;

b) A completed task description according to the Advisory Council's selection meeting or directly assigned to implement the Ministry-level Science and Technology Task, along with a report on completing the task description and detailed budget estimate of the main task holder of the Ministry-level Science and Technology Task.

3. Principles of operation of the Review Team:

a) Must have all three members participate;

b) The head of the Review Team chairs the session, decides to convene meetings in person, online, or a combination of both;

c) The Review Team operates on a consensus basis, conclusions of the Review Team are only passed when all members agree.

4. Responsibilities of the Review Team:

a) Members of the Review Team are individually responsible for their review results;

b) Review the budget estimate for implementing the Ministry-level Science and Technology Task with research contents consistent with the Advisory Council's selection meeting or directly assigned to implement the Ministry-level Science and Technology Task and current state economic-technical norms and expenditure standards; determine the total budget for implementing the Ministry-level Science and Technology Task (including state budget support and other sources), determine the final product cost budget, partial cost budget, and annual budget phase. The financial review result is recorded in the Review Minutes according to Model No. 15 attached as Appendix III of this Circular;

c) The review results are communicated to the organization or individual registering for the selection or directly assigned Ministry-level Science and Technology Task immediately after the review session ends.

5. In cases where Review Team members still have differing opinions, the Institute of Banking Strategy will propose and report to the Governor for consideration and decision.

Article 21. Approval of Tasks and Signing of Contracts to Implement Ministry-level Science and Technology Tasks

1. The organization or individual primarily responsible for the Ministry-level Science and Technology Task completes the file according to the Review Team's Minutes and sends it back to the Institute of Banking Strategy within a maximum of 15 days from receiving the review comments.

2. Within five working days from receiving the completed Ministry-level Science and Technology Task file according to the Review Team's opinion, the Institute of Banking Strategy submits to the Governor for signing the decision approving the Ministry-level Science and Technology Task assigned to the organization or individual primarily responsible for implementation, including: task name; organization or individual primarily responsible; implementation period; budget and method of cost allocation for task implementation.

If necessary, the Institute of Banking Strategy seeks additional independent expert advice before submitting to the Governor for approval of the Ministry-level Science and Technology Task assigned to the organization or individual primarily responsible for implementation.

3. Based on the Governor's approval decision, the Director of the Institute of Banking Strategy or the Institute's leadership (in case the Director is the primary task holder of the Science and Technology Task) signs the contract to implement the Science and Technology Task according to the model attached as Appendix V of this Circular. The approved task description and budget estimate form an inseparable part of the contract to implement the Science and Technology Task.

Article 22. Adjustment of Contracts for Implementing Ministry-Level Science and Technology Tasks

1. Extension of Time to Fulfill Ministry-Level Science and Technology Tasks:

a) The extension of time to fulfill ministry-level science and technology tasks shall be applied in the following cases:

(i) In case at least thirty days before the end of the contract period for implementing the ministry-level science and technology task, if it is necessary to extend the implementation time, the leading organization of the ministry-level science and technology task shall submit a written request for extension of the task to the Institute of Strategy, in which it reports on the situation of fulfilling the ministry-level science and technology task at the time of requesting the extension and specifies the specific reasons for the delay in task implementation;

(ii) In the case stipulated in point a, Clause 2, Article 27 of this Circular, and the leading organization of the ministry-level science and technology task submits a written request for extension of the task implementation time to the Institute of Strategy;

b) Within fifteen days from the date of receipt of the written request for extension of the task implementation, the Institute of Strategy shall have the responsibility to review and present to the Governor for consideration and decision on the extension of the task implementation;

c) In case the ministry-level science and technology task is agreed to be extended by the Governor, the extension period will be calculated from the end date of the contract for implementing the task and will be specifically stipulated in the decision extending the time to implement the ministry-level science and technology task. The maximum extension period is twelve months for tasks with an implementation period exceeding twenty-four months, six months for tasks with an implementation period not exceeding twenty-four months, and three months for tasks with an implementation period not exceeding twelve months. In special cases, the extension period will be decided by the Governor;

d) In case the ministry-level science and technology task is not granted an extension of the implementation time, the Institute of Strategy shall notify the organization or individual responsible for implementing the ministry-level science and technology task;

2. Change of Principal and Members of the Ministry-Level Science and Technology Task:

a) In case the principal of the ministry-level science and technology task cannot continue to perform the contract for implementing the task, the leading organization of the ministry-level science and technology task shall submit a written explanation and appoint a replacement officer to take over as the principal, and send it to the Institute of Strategy;

b) In case it is necessary to change members of the ministry-level science and technology task compared to the signed contract for implementing the task, the principal of the ministry-level science and technology task shall submit a written explanation, obtain confirmation from the leading organization, and send it to the Institute of Strategy;

c) Within fifteen days from the date of receipt of the written explanation regarding the change of the principal or members of the ministry-level science and technology task, the Institute of Strategy shall have the responsibility to review and present to the Governor for consideration and decision on the change of the principal or members of the ministry-level science and technology task, and notify in writing the organization or individual responsible for implementing the ministry-level science and technology task;

3. Adjustment of Funding for Ministry-Level Science and Technology Tasks shall be carried out in accordance with relevant laws concerning the allocation of funds for implementing ministry-level science and technology tasks using state budget and funds from the State Bank;

4. Documents related to the adjustment of contracts for implementing ministry-level science and technology tasks are integral parts of the contract for implementing ministry-level science and technology tasks;

 

Section 3

INSPECTION, EVALUATION, ACCEPTANCE AND TERMINATION OF CONTRACTS FOR IMPLEMENTING MINISTRY-LEVEL SCIENCE AND TECHNOLOGY TASKS

 

Article 23. Inspection and Evaluation of the Implementation of Ministry-Level Science and Technology Tasks

1. Every six months from the date of signing the contract to implement science and technology tasks, the leading organization shall be responsible for submitting a report according to Model No. 01 attached as Appendix IV of this Circular to the Institute of Banking Strategy.

2. In cases where necessary, the Institute of Banking Strategy may establish an inspection team to examine the implementation of ministry-level science and technology tasks (including progress, results, and disbursement of funds) at organizations leading such tasks. The inspection record will be prepared according to Model No. 02 attached as Appendix IV of this Circular. The inspection results serve as the basis for the Institute of Banking Strategy to submit to the Governor for consideration regarding suspension, adjustment, or continuation of the contract implementation.

3. The inspection and evaluation expenses shall be sourced from the budget allocated for the banking sector's science and technology activities according to the annual plan and budget approved by the State Bank leadership.

Article 24. Submission of Research Results for Ministry-Level Science and Technology Tasks

By the end of the research period specified in the contract for implementing science and technology tasks, the leading organization or individual must submit the research products and a self-assessment report on the implementation of the science and technology tasks according to Model No. 04 attached as Appendix IV of this Circular to the Institute of Banking Strategy for evaluation and acceptance.

Article 25. Documentation for Evaluation and Acceptance of the Implementation of Ministry-Level Science and Technology Tasks

The documentation for evaluation and acceptance of the implementation of ministry-level science and technology tasks includes:

1. A request for evaluation and acceptance of the ministry-level science and technology tasks from the leading individual according to Model No. 03 attached as Appendix IV of this Circular.

2. A comprehensive report and a summary report of the task results following the guidance provided in Model No. 12 attached as Appendix IV of this Circular.

3. Products of the ministry-level science and technology tasks.

4. A copy of the contract and task description.

5. Confirmation documents and related materials concerning the publication, dissemination, training, reception, and utilization of research results (if applicable).

6. A report on the use of funds for the task according to Model No. 05 attached as Appendix IV of this Circular.

7. A self-assessment report on the implementation of the task.

8. Other relevant documents (if applicable).

Article 26. Advisory Council for Evaluation and Acceptance of the Implementation of Ministry-Level Science and Technology Tasks

1. Within seven working days from the date of receiving valid documentation for evaluation and acceptance of the implementation of ministry-level science and technology tasks, the Institute of Banking Strategy shall submit to the Governor for the establishment of an Advisory Council for Evaluation and Acceptance of the Implementation of Ministry-Level Science and Technology Tasks.

2. The Council shall consist of between seven and nine members and one administrative secretary. Members include: Chairperson, one Deputy Chairperson, two opposing members, one secretary member, and other members. Council members are scientists and managers with expertise and capabilities matching the research field of the ministry-level science and technology tasks. Members participating in the selection or direct assignment of ministry-level science and technology tasks are prioritized for inclusion in the Advisory Council for Evaluation and Acceptance of the Implementation of Ministry-Level Science and Technology Tasks. Representatives of the leading organization of the task may not serve as Chairperson, Deputy Chairperson, opposing member, or secretary member of the Council.

3. At least five working days before the meeting of the Council, the Institute of Banking Strategy shall send the documentation for evaluation and acceptance of the implementation of ministry-level science and technology tasks as stipulated in Article 25 of this Circular to each Council member. Each member shall provide comments on the registration form according to Model No. 06 attached as Appendix IV of this Circular and return it to the Institute of Banking Strategy at least one working day before the meeting.

4. The Council meeting shall be held within thirty days from the date of the decision to establish the Council. The person in charge of convening the Council meeting shall decide whether the meeting will be held in person, online, or a combination of both. The Council shall only convene if at least two-thirds of the Council members participate, including the person in charge of convening the Council meeting, two opposing members, and the secretary member.

In case of necessity, the Board may invite representatives from related organizations to attend the Board meeting; opinions of the invited delegates are only for reference.

5. The Council meeting shall follow the procedures outlined in Model No. 17 attached as Appendix III of this Circular.

6. Principles of Evaluation by the Council:

a) The evaluation of the implementation of ministry-level science and technology tasks is conducted through an evaluation form bearing the stamp of the State Bank located in the upper left corner of the first page.

b) Council members evaluate independently.

c) An evaluation form is valid if it complies with the regulations for each evaluation content.

d) An invalid evaluation form is one that has been left blank or does not comply with the regulations.

đ) The overall classification of the ministry-level science and technology task is based on the evaluation results of each member according to the regulations.

7. Content of Evaluation of Products of Ministry-Level Science and Technology Tasks:

a) Evaluation of the comprehensive report: Assessing the completeness, clarity, authenticity, and logical consistency of the comprehensive report and accompanying necessary documents (design documents, technical documents, intermediate products, cited documents).

b) Evaluation of the task product against the order, including: Quantity and volume of products; quality of products; types of products; features and technical specifications of products.

8. Evaluation and Classification of Ministry-Level Science and Technology Tasks

The implementation results of the task are evaluated and classified into five levels based on the average score of valid evaluation forms as follows:

a) Excellent: average score of 95 points or higher;

b) Good: average score from 85 to under 95 points;

c) Fair: average score from 75 to under 85 points;

d) Satisfactory: average score from 50 to under 75 points;

đ) Unsatisfactory: average score below 50 points.

Article 27. Handling the Results of Acceptance of Ministry-Level Science and Technology Tasks

1. For ministry-level science and technology tasks rated "Achieved" or higher:

Within thirty days from the date of the Advisory Council's meeting to evaluate and accept the results of the implementation of ministry-level science and technology tasks, the organization or individual primarily responsible shall be responsible for:

a) Completing the dossier of the ministry-level science and technology task according to the conclusion of the Advisory Council;

b) Preparing a Completion Report on the products of the ministry-level science and technology task according to Model No. 10 attached at Appendix IV of this Circular and sending it to the Institute of Banking Strategy;

c) The Institute of Banking Strategy will cooperate with the Chairman of the Council to inspect and supervise the completion of the evaluation dossier of the task.

2. For ministry-level science and technology tasks rated "Not Achieved":

a) In cases where the results of the ministry-level science and technology task are rated "Not Achieved", if the task has not been extended and the Advisory Council recommends an extension, the organization or individual primarily responsible for the ministry-level science and technology task shall proceed with the extension procedures to continue completing the task. The extension period must comply with the provisions set out in point a, Clause 1, Article 22 of this Circular.

After the extension period, the evaluation and acceptance will be carried out according to the provisions of this Circular. All costs for completing the contents recorded in the contract for implementing the ministry-level science and technology task and re-evaluating the results shall be borne by the organization and individual primarily responsible for the ministry-level science and technology task.

b) In cases where the results of the ministry-level science and technology task are rated "Not Achieved" and are not extended according to the provisions of point a of this clause or the second acceptance still does not achieve, the Institute of Banking Strategy will base on the conclusion of the Advisory Council to submit to the Governor for consideration to terminate the contract according to the terms stipulated in the contract. If necessary, the Governor may request the Institute of Banking Strategy to seek additional opinions from independent experts before making a decision.

Article 28. Registration, Retention, and Publication of the Results of Implementation of Ministry-Level Science and Technology Tasks

1. Within forty days from the date of the Advisory Council's meeting to evaluate and accept the results of the implementation of ministry-level science and technology tasks, for tasks rated "Achieved" or higher, the organization or individual primarily responsible for the ministry-level science and technology task shall be responsible for submitting the dossier of the results of the implementation of the ministry-level science and technology task to the Institute of Banking Strategy, and registering the results of the implementation of the task at the National Science and Technology Information Center under the Ministry of Science and Technology.

2. The registration dossier of the results of the implementation of the ministry-level science and technology task shall be established in six hard copies and electronic files (in MS Word and PDF formats, retaining all products). The hard copy includes:

a) Summary report;

b) Summary report of research results in Vietnamese;

c) Two pages of summary report of research results in English;

d) Recommendation report (completed after formal acceptance).

The reports shall be bound together, with a hard cover, square spine, and information on the cover according to Model No. 12 attached at Appendix IV of this Circular.

Article 29. Recognition of Results, Termination of Contracts for Implementation of Ministry-Level Science and Technology Tasks, and Transfer of Research Results

1. The dossier for recognizing the results of the implementation of ministry-level science and technology tasks includes:

a) Minutes of the Advisory Council's meeting to evaluate and accept the results of the implementation of the ministry-level science and technology tasks;

b) Report on the completion of the products of the ministry-level science and technology task according to Model No. 10 attached at Appendix IV of this Circular;

c) Opinions of independent consulting experts (if any).

2. Recognition of the results of the implementation of ministry-level science and technology tasks:

Within fifteen days from the date of receiving the complete dossier as stipulated in Clause 1 of this Article, the Institute of Banking Strategy shall submit to the Governor for signing the Decision recognizing the results of the implementation of the task according to Model No. 11 attached at Appendix IV of this Circular.

3. Termination of contracts for implementation of ministry-level science and technology tasks:

a) When the ministry-level science and technology task ends, the organization or individual primarily responsible for the task must submit the final settlement report to the Institute of Banking Strategy;

b) After the Governor's decision recognizing the results of the implementation of the ministry-level science and technology task takes effect, the Institute of Banking Strategy will conduct an inventory and submit to the Governor for deciding on the handling of assets purchased using the funds for implementing the ministry-level science and technology task (if any);

c) The termination of the contract for implementation of the ministry-level science and technology task between the parties involved will be conducted after the final settlement and asset inventory (if any) of the ministry-level science and technology task according to the model attached at Appendix VI of this Circular.

4. Transfer of research results:

a) Within fifteen days from the date the Decision recognizing the results of the implementation of the ministry-level science and technology task becomes effective, the Institute of Banking Strategy shall be responsible for coordinating with the organization primarily responsible for transferring the research results to the approved addresses;

b) Heads of organizations receiving the transfer of research results of ministry-level science and technology tasks shall be responsible for coordinating with the individual primarily responsible for the task to prepare the Application Information Form for the results of the implementation of the ministry-level science and technology task according to Model 12 of Circular No. 14/2014/TT-BKHCN of the Ministry of Science and Technology regarding the collection, registration, retention, and publication of information on science and technology tasks (amended and supplemented), to be submitted to the Institute of Banking Strategy before October 15 each year for five consecutive years to compile a report for the Governor (except in cases where the use and application of the results have already been completed);

c) The funding for the transfer work, evaluation of the application and use of research results shall come from the budget allocated for scientific and technological activities in the banking sector according to the annual plan and budget approved by the State Bank leadership.

 

Chapter III

SCIENCE AND TECHNOLOGY TASKS AT THE LOCAL LEVEL

 

Article 30. Principles for Management and Implementation of Basic Level Science and Technology Tasks

1. The management and implementation of basic level science and technology tasks shall be carried out in accordance with the provisions of this Chapter. In cases where this Chapter does not provide specific regulations, corresponding provisions of Chapter II of this Circular shall apply.

2. Forms and templates for basic level science and technology tasks shall be applied according to the forms and templates of central-level science and technology tasks issued together with this Circular.

Article 31. Requirements for Basic Level Science and Technology Tasks

Basic level science and technology tasks must simultaneously meet the following requirements:

1. Addressing scientific and technological issues at the basic level and research results that have the potential to be applied in handling specialized work of the implementing unit.

2. Not overlapping in content with approved science and technology tasks of the State Bank within a five-year period from the time of proposing the research task. In case of overlap, it must be proven that continued research is necessary.

3. At the time of final acceptance procedures, there must be at least one article on related contents of the research topic published in the proceedings of scientific seminars or one scientific article published in a specialized scientific journal or posted on the Science and Technology Portal of the Banking Industry.

Article 32. Individuals Leading Basic Level Science and Technology Tasks

1. Individuals meeting the conditions stipulated in Article 33 of this Circular may register to lead basic level science and technology tasks.

2. Annually, the Institute of Banking Strategy submits to the Governor for approval the number and structure of basic level science and technology tasks to be led by individuals from the Institute of Banking Strategy and other organizations and individuals who intend to lead such tasks.

Article 33. Conditions for Participation in Selection or Direct Assignment to Implement Basic Level Science and Technology Tasks

Individuals registering to lead basic level science and technology tasks must simultaneously meet the following requirements and not fall under the category specified in point d, Clause 2, Article 15 of this Circular:

1. Hold a bachelor's degree or higher.

2. Have at least two years of work experience in fields related to the research content up to the date of submitting the application registration.

3. Be the principal or main participant in drafting the description of basic level science and technology tasks.

4. Possess the ability to directly organize and ensure sufficient time to lead the implementation of the research work of basic level science and technology tasks.

Article 34. Basis for Proposing Basic Level Science and Technology Tasks

1. Annual orientation of science and technology tasks of the banking industry.

2. Requirements for advisory functions in state management, research, and specialized activities according to the functions and responsibilities of the unit.

3. Plan for drafting regulatory legal documents and proposals for projects in areas managed by the State Bank proposed by the unit.

4. Scientific issues requiring research to serve as a basis for proposing central-level tasks or directly serving the operation of the unit.

Article 35. Proposing Basic Level Science and Technology Tasks

Individuals submit proposals for basic level science and technology tasks through their respective organizations using Form No. 02 attached as Appendix I of this Circular. Organizations are responsible for reviewing, selecting, and consolidating proposals for basic level science and technology tasks from individuals within their organization and submitting them to the Institute of Banking Strategy using Form No. 03 attached as Appendix I of this Circular.

Article 36. Determination and Approval of the List of Scientific and Technological Tasks Ordered at the Basic Level

1. Determination of the List of Scientific and Technological Tasks Ordered at the Basic Level

a) The Director of the Institute of Banking Strategy signs the decision to establish the Advisory Council for determining scientific and technological tasks at the basic level;

b) The structure, tasks, methods, and content of work of the Council shall be carried out in accordance with the provisions of Article 12 of this Circular.

2. Approval of the List of Scientific and Technological Tasks Ordered at the Basic Level:

The Director of the Institute of Banking Strategy approves the list of scientific and technological tasks ordered at the basic level based on the approval of the Governor regarding the quantity and structure of scientific and technological tasks at the basic level, and the advisory opinion of the Advisory Council for determining scientific and technological tasks at the basic level.

Article 37. Selection or Direct Assignment to Implement Basic Level Science and Technology Tasks

1. After approving the list of scientific and technological tasks ordered at the basic level, the Institute of Banking Strategy sends notifications to organizations meeting the conditions to register for selection or assigns directly. Organizations registering to lead scientific and technological tasks at the basic level notify individuals within their own units.

2. The Director of the Institute of Banking Strategy establishes the Advisory Council for selection or assigns directly to implement scientific and technological tasks at the basic level. The Council consists of from five to seven members including representatives of proposing organizations, scientists, and managers with the capacity and expertise appropriate to the scientific and technological tasks at the basic level. The Council's task is to review and evaluate registration files for implementing tasks in accordance with the provisions of Article 19 of this Circular.

Article 38. Financial Review Team for Scientific and Technological Tasks at the Basic Level

1. The Financial Review Team for Scientific and Technological Tasks at the Basic Level is established by the Director of the Institute of Banking Strategy.

2. The composition of the Financial Review Team, principles of operation, responsibilities of the Financial Review Team, and the file for the review session are implemented in accordance with the provisions of Article 20 of this Circular.

Article 39. Approval of Tasks, Signing of Contracts, and Adjustment of Contracts for Implementing Scientific and Technological Tasks at the Basic Level

1. The Director of the Institute of Banking Strategy approves scientific and technological tasks at the basic level and signs contracts with organizations and individuals leading scientific and technological tasks at the basic level.

2. The Director of the Institute of Banking Strategy decides on adjustments to the implementation time, leading individual, members, and budget of scientific and technological tasks at the basic level.

Article 40. Evaluation, Acceptance, and Handling of Acceptance Results of Scientific and Technological Tasks at the Basic Level

1. By the latest date specified in the contract for the completion period of research for scientific and technological tasks at the basic level, the leading individual of the scientific and technological tasks at the basic level submits the research product to the Institute of Banking Strategy for evaluation and acceptance organization.

2. The Advisory Council for evaluating and accepting the results of implementing scientific and technological tasks at the basic level, established by the Director of the Institute of Banking Strategy, has the task of reviewing, evaluating, and accepting the content and research results of scientific and technological tasks at the basic level in accordance with the provisions of Article 26 of this Circular.

3. Handling of Acceptance Results:

a) For scientific and technological tasks at the basic level classified as "Achieved" or higher:

Within fifteen days from the date of the Advisory Council meeting to evaluate and accept the results of implementing scientific and technological tasks at the basic level, the leading organization and individual are responsible for:

(i) Completing the file of scientific and technological tasks at the basic level according to the Council's conclusion;

(ii) Preparing a Completion Report on the Product of Scientific and Technological Tasks at the Basic Level according to Model No. 10 attached as Appendix IV to this Circular and sending it to the Institute of Banking Strategy;

b) For scientific and technological tasks at the basic level classified as "Not Achieved":

If the task has not been extended during the implementation process, it may be considered for an extension of up to two months. The second evaluation will be conducted in accordance with the provisions of this Circular but not more than once for each task. All costs for completing the contents recorded in the contract and re-evaluation are borne by the leading individual and organization of the scientific and technological task.

The Institute of Banking Strategy bases its decision to terminate the contract on the conclusions of the Council.

Article 41. Recognition, retention, publication of results, and liquidation of contracts

1. The dossier for recognizing the results of implementing grassroots scientific and technological tasks includes:

a) Minutes of the Advisory Board meeting to evaluate and accept the results of implementing grassroots scientific and technological tasks;

b) Report on completing scientific and technological products according to the Advisory Board's evaluation and acceptance opinions on the implementation of grassroots scientific and technological tasks;

c) Summary report; research result report; report on completing the evaluation and acceptance dossier; soft file (in MS Word and PDF format, fully retaining all products).

2. Recognition of the results of implementing grassroots scientific and technological tasks:

Within fifteen days from the date of receiving the complete dossier as stipulated in Clause 1 of this Article, the Director of the Institute of Banking Strategy shall examine and issue a Decision recognizing the results of implementing grassroots scientific and technological tasks.

3. Retention of the results of implementing grassroots scientific and technological tasks:

a) After being recognized for the results of implementing grassroots scientific and technological tasks, the head of the task must submit for retention at:

(i) Institute of Banking Strategy: one set;

(ii) Task organizing entity: one set (retained at the unit’s archive like other administrative documents);

b) The retention dossier includes: summary report; brief report; soft file (in MS Word and PDF format, fully retaining all products).

4. Within fifteen days from the date of receiving the retention dossier of the results of implementing grassroots scientific and technological tasks, the Institute of Banking Strategy shall publish the results of implementing grassroots scientific and technological tasks on the Central Bank's electronic portal and the banking industry's science and technology information portal.

5. Liquidation of the contract for implementing grassroots scientific and technological tasks:

a) When the grassroots scientific and technological task ends, the task organizing entity or individual must submit a final settlement report to the Institute of Banking Strategy;

b) After the Decision recognizing the results of implementing grassroots scientific and technological tasks becomes effective, the Institute of Banking Strategy shall inventory assets purchased with the task implementation funds (if any);

c) Within fifteen days from the date of receiving the final settlement report and asset inventory as stipulated in points a and b of this clause, the Director of the Institute of Banking Strategy shall sign off on the liquidation of the contract for implementing grassroots scientific and technological tasks.

 

 

Chapter IV

RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS INVOLVED

 

Article 42. Responsibilities of units under 1. Ministry-level scientific and technological tasks:

1. Institute of Banking Strategy:

a) Advising and assisting the Governor in managing the implementation of scientific and technological tasks within the banking sector;

b) Reporting to the Governor the results of selecting or directly assigning organizations or individuals to be the heads of grassroots scientific and technological tasks before approving grassroots scientific and technological tasks;

c) Managing the banking sector's science and technology information portal, updating databases on the results of implementing scientific and technological tasks by the State Bank, and implementing regulations on publishing information on the results of scientific and technological tasks as prescribed;

d) Guiding organizations and individuals in disbursing, settling accounts, and finalizing financial matters related to scientific and technological tasks in accordance with regulations;

đ) Taking the lead and coordinating with the Department of Finance and Accounting to inspect disbursement, usage, and settlement of financial matters for scientific and technological tasks when requested.

2. Department of Finance and Accounting:

a) Advising the Governor to promulgate regulations or guidelines for managing and using funds for scientific and technological tasks;

b) Implementing the duties of a first-level budgetary unit as prescribed by the State Budget Law for scientific and technological tasks funded by the state budget;

c) Managing finances within its authority for scientific and technological tasks funded by allocated budgets from the State Bank.

3. Other units:

a) Cooperating with the Institute of Banking Strategy to develop annual scientific and technological task orientations for the banking sector;

b) Researching, identifying, and proposing scientific and technological tasks;

c) Organizing the implementation of scientific and technological tasks assigned by the Governor to be the main organizers;

d) Conducting reporting and statistical work on scientific and technological activities, participating in providing comments on scientific and technological issues within their professional fields according to their functions and tasks;

đ) Organizing the application of scientific and technological task results in practice: (i) assigned by the Governor as the main organizer, or (ii) proposed for transfer and application by the Advisory Board evaluating and accepting the results of implementing scientific and technological tasks.

Article 43. Responsibilities of the organization in charge of scientific and technological tasks

1. Create conditions regarding human resources, time, and other necessary conditions for implementing scientific and technological tasks, while monitoring, supervising, and correcting errors that affect the objectives, contents, progress, and results of the assigned scientific and technological tasks.

2. Be responsible for the content of the explanatory notes and budget estimates of the scientific and technological tasks to meet the objectives and produce products according to the contract for implementing scientific and technological tasks.

3. Be responsible for the rationality and legality of the results of implementing scientific and technological tasks.

4. Select individuals with sufficient professional qualifications and organizational capabilities to lead the tasks when assigning tasks directly.

5. Sign contracts for implementing scientific and technological tasks, fulfill all responsibilities of the contracting party, and submit the results of the implementation of the scientific and technological tasks according to the contract for implementing scientific and technological tasks.

6. Sign job assignment contracts and specialized service contracts with organizations and individuals participating in the implementation of the contents of the scientific and technological tasks (if necessary). Fulfill all commitments of the contracting party with the leading individual and organizations and individuals participating in the implementation of the scientific and technological tasks.

7. Urge, monitor, supervise, and create favorable conditions for the leading individual to implement the tasks according to the content and schedule stipulated in the contract for implementing scientific and technological tasks and the explanatory notes on scientific and technological tasks.

8. Coordinate with the leading individual of the scientific and technological tasks to compile reports to the Governor (through the Institute of Banking Strategy) on the implementation of scientific and technological tasks regularly and urgently. Create favorable conditions and provide full information to management agencies, inspection, and audit bodies regarding the implementation of the tasks.

9. Use the allocated funds effectively to implement scientific and technological tasks according to the signed contract for implementing scientific and technological tasks; provide adequate and timely funding from committed sources in the contract for implementing scientific and technological tasks to the leading individual and organizations and individuals participating in the implementation of the tasks; carry out procedures for settlement of accounts according to current regulations.

10. Organize registration of intellectual property rights protection from the results of the tasks for organizations and individuals in accordance with the provisions of the law.

11. Organize management, exploitation, and transfer of the results of the tasks, enjoy the benefits and be responsible for distributing the interests from such activities according to the provisions of the law and the contract for implementing scientific and technological tasks.

Article 44. Responsibilities of the leading individual of scientific and technological tasks

1. Implement the assigned scientific and technological tasks, use funds in accordance with current state regulations and the signed contract for implementing scientific and technological tasks.

2. Propose to the organization in charge of scientific and technological tasks to create conditions regarding time and other support for implementing the scientific and technological tasks.

3. Select members to participate in the implementation of scientific and technological tasks; sign job assignment contracts and specialized service contracts with organizations and individuals inside and outside the unit (if necessary) to implement research contents in accordance with current regulations.

4. Report on time about the content, progress, products created, and the use of funds for the scientific and technological tasks to the organization in charge and the Institute of Banking Strategy.

5. Prepare financial statements according to current regulations and be responsible for providing complete documentation for inspection, auditing, and auditing when required.

6. Be responsible for the records and vouchers for income and expenditure during the implementation of scientific and technological tasks, the use of funds, and the repayment of funds for implementing scientific and technological tasks in cases where the activities are suspended or accepted at the level of "Not Achieved" and the contract for implementing scientific and technological tasks is terminated.

7. Implement registration, preservation of the results of implementing scientific and technological tasks, and current regulations on the publication, use, and transfer of research results of scientific and technological tasks using state budget funds according to the provisions of the law.

 

Chapter V

IMPLEMENTING PROVISIONS

Article 45. Effective Date

1. This Circular takes effect from October 16, 2024, and replaces Circular No. 37/2015/TT-NHNN dated December 31, 2015, issued by the Governor on the management and organization of implementing scientific and technological tasks using state budget funds under the responsibility of the State Bank.

2. Contracts for implementing scientific and technological tasks signed before this Circular takes effect shall continue to be implemented according to the content of the signed contracts.

Article 46. Implementation organization

The Director of the Office, the Head of the Legal Department, the Director of the Institute of Banking Strategy, the Heads of units under the State Bank of Vietnam, relevant organizations and individuals shall be responsible for organizing the implementation of this Circular.
