CIRCULAR

 

Issuing national technical standards for waste incineration furnaces

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006 and the Law Amending and Supplementing Certain Provisions of the Law on Standards and Technical Regulations dated June 14, 2025;

Pursuant to the Environmental Protection Law dated November 17, 2020;

Pursuant to Decree No. 08/2022/NĐ-CP dated January 10, 2022 of the Government detailing certain provisions of the Environmental Protection Law and Decree No. 05/2025/NĐ-CP dated January 6, 2025 of the Government amending and supplementing certain provisions of Decree No. 08/2022/NĐ-CP dated January 10, 2022 of the Government detailing certain provisions of the Environmental Protection Law;

Pursuant to Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of certain provisions of the Law on Standards and Technical Regulations and Decree No. 78/2018/NĐ-CP dated May 16, 2018 of the Government amending and supplementing certain provisions of Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of certain provisions of the Law on Standards and Technical Regulations;

Pursuant to Decree No. 35/2025/NĐ-CP dated February 25, 2025 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

At the proposal of the Director of the Environment Department, the Head of the Science and Technology Department;

The Minister of Agriculture and Environment issues this Circular on national technical standards for waste incineration furnaces.

Article 1. Attached to this Circular is the National Technical Regulation on Waste Incineration Furnaces (QCVN 30:2025/BNNMT).

Article 2. Effective Date

1. This Circular takes effect from February 9, 2026.


2. Circular No. 27/2012/TT-BTNMT dated December 28, 2012 of the Minister of Natural Resources and Environment stipulating national environmental technical standards and Circular No. 03/2016/TT-BTNMT dated March 10, 2016 of the Minister of Natural Resources and Environment issuing national technical standards for the environment shall cease to be effective from the date this Circular takes effect, except as provided for in Article 3 of this Circular.

Article 3. Transitional Provisions

1. Facilities that have commenced operation, investment projects currently under implementation (including investment projects that have received approval decisions on environmental impact assessment reports or have been accepted by competent authorities with complete and valid files requesting review of environmental impact assessment reports, issuance of environmental permits before the effective date of this Circular) with medical waste incineration furnaces, industrial waste incineration furnaces, and municipal solid waste incineration furnaces shall continue to apply the technical regulations, operational requirements, and monitoring provisions set forth in the corresponding national technical standards: National Technical Standard on Medical Waste Incineration Furnaces (QCVN 02:2012/BTNMT), National Technical Standard on Industrial Waste Incineration Furnaces (QCVN 30:2012/BTNMT), National Technical Standard on Municipal Solid Waste Incineration Furnaces (QCVN 61-MT:2016/BTNMT) until December 31, 2031.

2. Facilities that have commenced operation, investment projects currently under implementation as specified in Clause 1 of this Article shall apply the permissible limit values for pollutant parameters in furnace emissions according to Circular No. 45/2024/TT-BTNMT dated December 30, 2024 of the Minister of Natural Resources and Environment promulgating National Technical Standards on Industrial Emissions.

3. Projects, facilities that have been issued environmental permits, including component environmental permits containing hazardous waste treatment processes marked as "NH" (listed in the Hazardous Waste List, Industrial Waste Subject to Control, and General Industrial Solid Waste List attached to Circular No. 02/2022/TT-BTNMT dated January 10, 2022 of the Minister of Natural Resources and Environment detailing certain provisions of the Environmental Protection Law) in waste incineration furnaces before the effective date of this Circular may continue to treat such types of waste until the expiration date of their environmental permits, including component environmental permits.

Article 4. Implementation Schedule

1. From the date this Circular takes effect, investment projects (including new investment projects, expanded scale investment projects, increased capacity investment projects submitting applications for environmental impact assessment reports, and environmental permits issued after the date this Circular takes effect) must comply with the provisions of QCVN 30:2025/BNNMT.

2. As of January 1, 2032, entities subject to Clause 1 of Article 3 of this Circular shall meet the requirements stipulated in QCVN 30:2025/BNNMT.

3. It is encouraged that operational facilities and ongoing investment projects apply the provisions of QCVN 30:2025/BNNMT from the date this Circular takes effect.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. Ministries, agencies equivalent to ministries, People's Committees at all levels, Departments of Agriculture and Rural Development of provinces and centrally governed cities, and related organizations and individuals are responsible for implementing this Circular.

2. During the implementation of this Circular, if any difficulties arise, relevant agencies, organizations, and individuals must promptly report in writing to the Ministry of Agriculture and Rural Development for consideration and resolution./.
