DECREE NO. 45-CP OF THE GOVERNMENT ON JUNE 2, 1994 REGARDING THE ESTABLISHMENT OF THE CITY OF BA RIA, TAN THANH DISTRICT, AND CHAU DOC DISTRICT UNDER BA RIA-VUNG TAU PROVINCE

THE GOVERNMENT

Pursuant to the Government Organization Law dated September 30, 1992;

At the request of the People's Committee of Ba Ria-Vung Tau Province and the Government Organization and Cadre Board,

DECREE:

Article 1. - The new city and districts under Ba Ria-Vung Tau Province shall be established as follows:

I. Establishment of the City of Ba Ria based on the town of Ba Ria (excluding 800 hectares of natural area of Phuoc Tan village merged with Chau Pha commune of Tan Thanh district), Long Huong commune, Hoa Long commune (excluding Ap Song Cau and 990 hectares of natural area merged with Nghia Thanh commune of Chau Duc district), Long Phuoc commune (excluding Ap Phuoc Trung and 1,463 hectares of natural area merged with Da Bac new economic zone of Chau Duc district) and 100 hectares of natural area with 700 inhabitants of Long An ap of Long Dien town (Long Dat district).

The City of Ba Ria has a total natural area of 8,724 hectares and a population of 67,289. New communes and wards will be established as follows:

1. Phuoc Hung Ward: Established based on Phuoc Hung, Phuoc Chanh, and Phuoc Tan villages of the town of Ba Ria and 200 hectares of natural area of Hoa Long commune; it has a total natural area of 595 hectares and a population of 9,421.

Boundaries of Phuoc Hung Ward: East borders Hoa Long commune and Long Toan ward; West borders Long Huong commune; South borders Phuoc Nguyen and Phuoc Trung wards and Phuoc Hiep ward; North borders Chau Pha commune (Tan Thanh district).

2. Phuoc Hiep Ward: Established based on Phuoc Hiep and Phuoc Lien villages of the town of Ba Ria; it has a total natural area of 35 hectares and a population of 7,086.

Boundaries of Phuoc Hiep Ward: East borders Phuoc Trung ward; West and South border Long Huong commune; North borders Phuoc Hung ward.

3. Phuoc Nguyen Ward: Established based on Phuoc Nguyen, Phuoc Duc, and Phuoc Thanh villages; it has a total natural area of 190 hectares and a population of 7,971.

Boundaries of Phuoc Nguyen Ward: East borders Long Toan ward; West and North border Phuoc Hung ward; South borders Phuoc Trung ward.

4. Long Toan Ward: Established based on Long Toan, Long Tan, Phuoc Hạnh villages and 100 hectares of natural area of Long An ap transferred from Long Dien district; it has a total natural area of 692 hectares and a population of 7,139.

Boundaries of Long Toan Ward: East and North border Hoa Long commune; West borders Phuoc Nguyen, Phuoc Trung, and Phuoc Hung wards; South borders Long Dien town (Long Dat district).

5. Phuoc Trung Ward: Established based on Phuoc Trung and Ben Xuc villages of the town of Ba Ria; it has a total natural area of 648 hectares and a population of 7,073.

Boundaries of Phuoc Trung Ward: East borders Long Toan ward and Long Dat district; West borders Phuoc Hiep ward and Long Huong commune; South borders Vung Tau city; North borders Phuoc Hung and Phuoc Nguyen wards.

6. Long Phuoc Commune: After adjusting boundaries, it has a total natural area of 1,488 hectares and a population of 7,369 (excluding Ap Phuoc Trung).

7. Hoa Long Commune: After adjusting boundaries, it has a total natural area of 1,786 hectares and a population of 9,502 (excluding Ap Song Cau).

Boundaries of the City of Ba Ria: East borders Long Dat district; West borders Hoi Bai commune (Tan Thanh district); South borders Vung Tau city; North borders Tan Thanh and Chau Duc districts.

The City of Ba Ria consists of 8 administrative units: Phuoc Hung ward, Phuoc Hiep ward, Phuoc Nguyen ward, Long Toan ward, Phuoc Trung ward, Long Phuoc commune, Hoa Long commune, and Long Huong commune.

II. Establishment of Tan Thanh District based on Phu My, Hoi Bai, Phuoc Hoa, Xuan My, Hac Dich, Chau Pha communes, Toc Tien new economic zone, and 800 hectares of natural area of Phuoc Tan village of the old town of Ba Ria of Chau Thanh district.

Tan Thanh District has a total natural area of 30,619 hectares and a population of 73,004. New towns and communes will be established as follows:

1. Phu My Town (district capital): Established based on Phu My commune; it has a total natural area of 3,100 hectares and a population of 7,765.

Boundaries of Phu My Town: East borders Phuoc Hoa commune; West borders My Xuan commune; North borders Toc Tien commune; South borders Can Gio district and Ho Chi Minh city.

2. Song Xoai Commune: Established based on 2,620 hectares of natural area and a population of 7,361 of Hac Dich commune, including Ap Song Xoai 1, Ap Song Xoai 2, and Ap 3.

Boundaries of Song Xoai Commune: East and North border Lang Lon commune; West border Hac Dich commune; South border Chau Pha commune.

3. Hac Dich Commune: After adjusting boundaries, it retains a total natural area of 3,436 hectares and a population of 6,752, including Ap 1, Ap 2, Ap 4, Trai Cat, and Trai Lon.

4. Chau Pha Commune: (After receiving 800 hectares of natural area of Phuoc Tan village of the old town of Ba Ria) it has a total natural area of 3,448 hectares and a population of 6,082.

5. Toc Tien Commune: Established based on Toc Tien new economic zone; it has a total natural area of 3,447 hectares and a population of 2,253.

Boundaries of Toc Tien Commune: East borders Chau Pha commune; West borders Phuoc Hoa, My Xuan, and Phu My towns; South borders Hoi Bai commune.

Boundaries of Tan Thanh District: East borders Chau Duc district; West borders Long Thanh district (Dong Nai province) and Duyen Hai district (Ho Chi Minh city); South borders Vung Tau city; North borders Long Khanh and Long Thanh districts (Dong Nai province).

Tan Thanh District consists of 8 administrative units: Phu My town, Hoi Bai commune, Phuoc Hoa commune, My Xuan commune, Song Xoai commune, Hac Dich commune, Chau Pha commune, and Toc Tien commune.

III. Establishment of Chau Duc District based on Ngai Giao, Nghia Thanh, Binh Ba, Suoi Nghê, Xuan Son, Binh Gia, Kim Long, Xa Bang, Lang Lon communes, Suoi Rao and Da Bac new economic zones, and 990 hectares of natural area with 1,700 inhabitants of Song Cau ap of Hoa Long commune; 1,463 hectares of natural area with 800 inhabitants of Phuoc Trung ap of Long Phuoc commune.

Chau Duc District has a total natural area of 42,104 hectares and a population of 132,806. New towns and communes will be established as follows:

1. Ngai Giao Town (district capital): Established based on Ngai Giao commune; it has a total natural area of 3,240 hectares and a population of 16,934.

Boundaries of Ngai Giao Town: East borders Suoi Ray commune; West borders Hac Dich commune; South borders Binh Ba commune; North borders Kim Long commune.

2. Quang Thanh Commune: Established based on Hau Can, Tien Long, Dat Long villages of Kim Long commune; it has a total natural area of 2,828 hectares and a population of 8,086.

Article 1: The eastern boundary of Quảng Thành commune borders Xuân Lộc district (Đồng Nai province); the western boundary borders Kim Long commune; the southern boundary borders Bình Giã and Xuân Sơn communes; the northern boundary borders Xà Bang commune.

3. Kim Long commune: After adjusting the boundaries, it retains a natural area of 3,015 hectares with a population of 12,646, including Thạch Long, Lạc Long, Quảng Long, Tam Long, and Tân Long villages.

4. Suối Rao commune: Established based on the new economic zone Suối Rao; it has a natural area of 2,938 hectares with a population of 1,381.

Article 1: The eastern boundary of Suối Rao commune borders Xuyên Mộc district; the western boundary borders Đá Bạc commune; the southern boundary borders Long Đất district; the northern boundary borders Xuân Sơn commune.

5. Đá Bạc commune: Established based on the new economic zone Đá Bạc; it has a natural area of 4,710 hectares with a population of 3,139.

Article 1: The eastern boundary of Đá Bạc commune borders Xuân Sơn and Suối Rao communes; the western boundary borders Bình Ba commune; the southern boundary borders Long Đất district and Bà Rịa city; the northern boundary borders Bình Giã commune.

6. Nghĩa Thành commune: After receiving 990 hectares of natural area and 1,700 people from Sông Cầu hamlet of Hòa Long commune; it has a natural area of 2,810 hectares with a population of 12,197.

The eastern boundary of Châu Đức district borders Xuân Lộc district (Đồng Nai province) and Xuyên Mộc district; the western boundary borders Tân Thành district; the southern boundary borders Bà Rịa city and Long Đất district; the northern boundary borders Long Khánh district (Đồng Nai province).

Châu Đức district has 12 administrative units which are Ngãi Giao town, Bình Ba commune, Suối Nghệ commune, Xuân Sơn commune, Bình Giã commune, Xà Bung commune, Láng Lớn commune, Quảng Thành commune, Kim Long commune, Suối Rao commune, Đá Bạc commune, and Nghĩa Thành commune.

After adjusting the administrative boundaries:

Bà Rịa - Vũng Tàu province has 7 directly subordinate administrative units which are Vũng Tàu city, Bà Rịa town, and Xuyên Mộc, Long Đất, Châu Đức, Tân Thành, and Côn Đảo districts.

Article 2.- The People's Committee of Bà Rịa - Vũng Tàu province and the Organization and Cadre Department of the Government are responsible for implementing this Decree./.
