AMENDMENT AND SUPPLEMENT TO THE MILITARY SERVICE OBLIGATION LAW
At the proposal of the Government Council, the following amendments and supplements to the Military Service Obligation Law dated April 15, 1960 (amended and supplemented for the first time by the Law on October 26, 1962) are hereby promulgated.
Article 1
The following provisions shall replace Articles 8 and 10 of the Military Service Obligation Law:
1. Article 8 (new) - Soldiers serving under voluntary enlistment will gradually be discharged or transferred to reserve status, or released from military service obligations. However, in order to meet special requirements for army building and combat operations, the Ministry of National Defense may implement voluntary enlistment for certain non-commissioned officers and soldiers.
2. Article 10 (new) - The period of active duty for non-commissioned officers and soldiers in the Army is four years.
The period of active duty for non-commissioned officers and soldiers in the Air Defense-Air Force, non-commissioned officers and soldiers in the Navy, technical non-commissioned officers and technical soldiers in the Army is five years.
The period of active duty for non-commissioned officers and soldiers belonging to technical branches within the People's Armed Public Security Forces shall be equivalent to that of military branches and services within the Vietnam People's Army.
In cases of necessity, the Minister of National Defense and the Minister of Public Security may extend the period of active duty for servicemen under their jurisdiction; each extension shall not exceed one year.
Article 2
The following provision is hereby added to Article 34b of the Military Service Obligation Law as Article 34c:
Article 34c - In peacetime, when there are urgent situations but no mobilization order has been issued, in order to promptly strengthen armed forces and ensure that they are combat-ready, upon decision by the Government Council, the Minister of National Defense may call up a number of discharged servicemen, certain cadres, male and female technical workers for active duty.
This Law was adopted at the second session of the third term of the National Assembly of the Democratic Republic of Vietnam on April 10, 1965.
