No.: 45-TT-LB

JOINT CIRCULAR

Regulations on the Format for Paying Costs for Making Artificial Limbs for War Invalids, Militia, Partisans, and Volunteer Youth Injured

civilian militia, partisans, voluntary youth corps who are injured or disabled

________________________

MINISTER OF HOME AFFAIRS - MINISTER OF FINANCE

Respectfully submitted to:

- Administrative Committees of Provinces, Cities
- Financial Departments

In Circular No. 52-TT-LB dated August 22, 1956, the Ministry of War Invalids and the Ministry of Finance stipulated that the cost of making artificial limbs would be covered by the Ministry of War Invalids (later renamed the Ministry of Home Affairs). This regulation is no longer suitable for the current management levels of war invalids and martyrs' affairs in general, and for local management of the distribution of artificial limbs in particular. Therefore, the Ministries revise the format for paying costs for making artificial limbs for war invalids, militia, partisans, and volunteer youth injured from January 1, 1963, as follows:

1. Coverage of Expenses:

a) For war invalids, military personnel, partisans, and volunteer youth injured who have returned to their localities for production or recuperation.

Each expense such as the cost of making artificial limbs, repair costs, shoe-making fees, crutch-making fees, food expenses, and travel expenses (round trip) during the time spent making artificial limbs at the workshop... shall be covered by the Provincial or City Administrative Committee (recorded in the local budget under the category of expenses for war invalids and martyrs' affairs).

b) For war invalids, militia, partisans, and volunteer youth injured working in agencies or enterprises.

- If they work in central or local administrative or public service agencies, then the agency will budget and cover all expenses related to making and repairing artificial limbs, shoe-making fees, crutch-making fees, and travel expenses for the comrades;

- If they work in business agencies (such as companies, enterprises, agricultural-industrial-lumber cooperatives...) then the agency will advance and pay these expenses, then prepare a list attached with payment vouchers to settle accounts with the local financial agency (including local companies and enterprises and central companies and enterprises located in that locality);

- The food expenses at the workshop shall be settled directly by the comrades themselves;

c) For war invalids, militia, partisans, and volunteer youth injured still serving in the military.

The Ministry of Home Affairs will cover all expenses related to making and repairing artificial limbs, shoe-making fees, and crutch-making fees for the comrades, and will directly settle accounts with the artificial limb workshop. Travel expenses will be provided by the unit, and food expenses at the workshop shall be settled directly by the comrades themselves.

d) For war invalids, militia, partisans, and volunteer youth injured residing in War Invalids' Rehabilitation Centers.

The War Invalids' Rehabilitation Center will cover all expenses and will directly settle accounts with the artificial limb workshop. Food expenses at the workshop shall be settled directly by the comrades themselves.

Expenses for making artificial limbs, etc., shall be recorded under Category 2, Item 40, Sub-item 3, Point 6.

2. Payment Format and Introduction to the Artificial Limb Workshop:

To prevent capital from being tied up in production at the artificial limb workshop, starting from January 1, 1963, localities, agencies, and enterprises will immediately pay the costs when introducing comrades to make artificial limbs at the workshop, and must advance and transfer the costs to the workshop via a money transfer receipt. After completing the artificial limbs, the workshop will calculate the total costs and settle accounts with the locality, agency, or enterprise that introduced the comrades (if there is excess, it will be refunded, if there is a shortage, additional payment will be required).

Localities, agencies, and enterprises must ensure that comrades introduced to make artificial limbs have been approved. Comrades coming to the workshop must bring complete documents such as: artificial limb making voucher, introduction letter from the locality or agency, enterprise, certificate of artificial limb making issued by the workshop (for comrades who have already had artificial limbs and now need new ones), certificate of war invalids, militia, partisans, and volunteer youth injured, and comrades must also bring old artificial limbs to return to the workshop for reuse of materials.

The Ministry of Home Affairs will provide detailed guidance on budget preparation and settlement of artificial limb costs after reaching consensus with the Ministry of Health and the artificial limb workshop.
