Decision No. 451/QD-TTg of the Government Chairman establishes the National Forensic Medical Institute under the Ministry of Health, stipulates its functions, tasks, and organizational structure. The Decision abolishes the previous Decision on the establishment of the Central Institute of Legal Medicine.

Regarding the establishment of the National Forensic Medicine Institute under the Ministry of Health

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Judicial Appraisal Ordinance dated September 29, 2004;

Pursuant to Decree No. 67/2005/NĐ-CP dated May 19, 2005 of the Government detailing the implementation of certain provisions of the Judicial Appraisal Ordinance;

Considering the proposal of the Minister of Justice and the Minister of Health,

Pursuant to …;

Article 1. Establish the National Forensic Medicine Institute based on the Central Institute of Legal Medicine under the Ministry of Health.

Article 2. The National Forensic Medicine Institute is a self-financing public service entity with legal personality, its own seal, separate accounts, and headquarters in Hanoi and a branch in Ho Chi Minh City.

Article 3. The National Forensic Medicine Institute shall conduct forensic medical examinations; develop professional standards for forensic medical examinations; develop programs and organize training for forensic medical examiners; provide guidance on forensic medical procedures to forensic examination organizations nationwide; and perform other functions and tasks as stipulated in Article 7 of Decree No. 67/2005/NĐ-CP dated May 19, 2005 of the Government detailing the implementation of certain provisions of the Judicial Appraisal Ordinance.

Article 4. The Ministry of Health shall take the lead and coordinate with the Ministry of Justice, the Ministry of Home Affairs, the Ministry of Defense, and the Ministry of Public Security to develop plans to enhance and strengthen the capacity of the National Forensic Medicine Institute; take the lead and coordinate with the Ministry of Planning and Investment and the Ministry of Finance to determine investment funds for equipment, infrastructure, and operational costs to ensure that the National Forensic Medicine Institute can fulfill its assigned functions and tasks.

Article 5. This Decision takes effect fifteen days from the date of signature.

Repeal Decision No. 11/2001/QĐ-TTg dated January 17, 2001 of the Prime Minister regarding the establishment of the Central Institute of Legal Medicine.

The Minister of Health, the Ministers, Heads of ministerial-level agencies, Heads of agencies attached to the Government, Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decision./.
