NOTICE NO. 5
ON THE USE OF COMPOSITIONS CREATED BEFORE 1975 IN PROVINCES IN THE SOUTH
To implement Decision No. 961/VH-QĐ dated July 4, 1989 of the Ministry of Culture on rectifying performance, publication, and dissemination activities to build a healthy cultural life for the people and contribute to building new socialist individuals, the Ministry of Culture and Information hereby issues Notice No. 5 regarding the procedures for reviewing and approving the use of compositions created before 1975 in provinces in the South outside the lists of Notices Nos. 1, 2, 3, and 4 issued by the Ministry of Culture and Information as follows:
Article 1: Conditions for review:
1. The author of the composition requesting review must be a person currently residing and working in Vietnam (including those who have passed away) and strictly adhering to the laws of the Socialist Republic of Vietnam.
2. The composition requested for use must have wholesome content and artistic value.
3. For authors currently residing abroad with good intentions and a desire to contribute their works for use and dissemination within the country, including compositions created both before and after 1975, they should send their works to the Performing Arts Department, 32 Nguyen Thai Hoc Street, Hanoi, Fax 84.4.231.222 to request consideration.
- For authors currently residing abroad whose political stance is unclear, their works will not be used temporarily.
- It is strictly prohibited to use compositions by authors who left the country and have attitudes and actions opposing the revolutionary cause of the people.
Article 2: The application for review includes:
- A letter requesting review from the agency.
- The compositions requested for review and approval for use must be photocopies of the original score without erasures or alterations.
Applications should be sent to the Performing Arts Department, 32 Nguyen Thai Hoc Street, Hanoi.
Upon receiving complete applications meeting the conditions set forth in Article 1 and 2, the Performing Arts Department will issue a response letter within 10 days (as evidenced by postal service stamps).
Article 3: All agencies responsible for producing, trading in audiovisual tapes, music discs, karaoke tapes, publishing musical publications, organizing musical performances, radio and television stations, professional and non-professional art troupes, and singers nationwide must strictly comply with this notice. Any violations will be subject to administrative penalties up to prosecution under the law depending on the severity.
