of the Ministry's Representative Office in Ho Chi Minh City
MINISTER OF INFORMATION AND COMMUNICATIONS
Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry and agencies at the ministerial level;
Pursuant to Decree No. 187/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications.
At the proposal of the Director of the Organization and Cadres Department and the Head of the Ministry's Representative Office in Ho Chi Minh City,
DECISION:
Article 1. Position and Functions
The Ministry's Representative Office in Ho Chi Minh City (hereinafter referred to as the Representative Office) is an agency assisting the Minister in overseeing, summarizing the situation of activities within the scope of state management of the Ministry of Information and Communications in the provinces and centrally-run cities including: Ho Chi Minh City, Binh Phuoc, Tay Ninh, Binh Duong, Dong Nai, Ba Ria-Vung Tau, Long An, Dong Thap, An Giang, Tien Giang, Ben Tre, Vinh Long, Kien Giang, Hau Giang, Can Tho City, Tra Vinh, Soc Trang, Bac Lieu, and Ca Mau (collectively referred to as the Southern Region); serving activities according to the program of work of the Ministry on the assigned territory.
The Ministry's Representative Office in Ho Chi Minh City has its own seal and separate account for transactions.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The Ministry's Representative Office in Ho Chi Minh City shall have the following tasks and powers:
1. Submitting to the Minister the long-term and annual plans regarding the organization of activities of the Representative Office and implementing such activities after approval;
2. Summarizing, monitoring, receiving information, and reporting to the leadership of the Ministry about specialized activities under the Ministry’s jurisdiction in the provinces and centrally-run cities within the assigned area;
3. Receiving, conveying, urging the implementation of policies, programs, plans, and key tasks of the Ministry towards units and organizations under the Ministry and individuals related in the assigned area;
4. Cooperating with Departments, Bureaus, Offices, and the Inspectorate of the Ministry according to the delegation of the Minister in directing, guiding, and inspecting the activities of provincial-level Information and Communications Departments in the Southern Region;
5. Cooperating with relevant units in providing news and supplying information about the activities of the Ministry and specialized activities under the Ministry’s jurisdiction in the assigned area to mass media outlets, organizations, and individuals;
6. Cooperating with relevant agencies under the Ministry in organizing and serving meetings, working sessions, conferences, seminars, training sessions, and regular briefings of the Ministry and subordinate agencies in the assigned area; managing minutes of these meetings, sessions, and working sessions;
7. Organizing the implementation of reception, ceremonial, and funeral duties related to the responsibilities of the Ministry in the assigned area;
8. Cooperating with central and local agencies in the assigned area that are related; attending meetings convened by other ministries, sectors, and localities according to the assignment of the Minister;
9. Participating in directing information services for urgent cases concerning national security, natural disasters, enemy attacks, and other urgent information in the assigned area;
10. Serving as the Standing Sub-committee for Flood and Storm Prevention in the Southern Region;
11. Proposing the examination and awarding of annual and exceptional achievements based on the proposals from units operating in the postal, telecommunications, information technology, press, and publishing sectors in the assigned area;
12. Organizing and managing accounting and financial work; managing the operational funds of the unit according to state regulations and the delegation of the Minister;
13. Implementing security and safety measures, fire prevention, and ensuring public order and safety of the office; implementing policies and obligations of the unit towards the locality;
14. Managing and utilizing assets and facilities allocated by the Ministry according to state regulations and those of the Ministry; researching and proposing investment plans for basic construction, renovation, upgrading, new construction, and repair of the office premises;
15. Implementing personnel management systems for civil servants, employees, and contractual workers according to laws and the delegation of management by the Minister;
16. Cooperating with relevant agencies to implement personnel policies and care for the living conditions of current and retired staff under the responsibility of the Representative Office;
17. Performing other tasks assigned by the Minister.
đ) Based on the regulations on the delegation of organizational and cadre management, the Director of the Department decides or submits to the competent authority for decisions regarding the appointment and dismissal of heads and deputy heads of units under the Department according to the position standards set by the provincial people's committee;
1. Leadership of the Ministry's Representative Office in Ho Chi Minh City:
The Ministry's Representative Office in Ho Chi Minh City has a Head and Deputy Heads.
The Head of the Representative Office is responsible before the Minister and the law for organizing the implementation of the assigned functions, tasks, and powers.
The Deputy Heads assist the Head of the Representative Office and are responsible to the Head of the Representative Office for the tasks delegated to them.
2. Organizational Structure and Staffing:
- Administrative and Human Resources Department
- Planning and Finance Department
- Management Department
The staffing of the Ministry's Representative Office in Ho Chi Minh City is established by the Head of the Representative Office and submitted to the Minister of Information and Communications for decision. Based on work requirements, the Head of the Representative Office may enter into general labor contracts.
The Head of the Representative Office specifies the tasks and working relationships between departments and the staffing of each unit.
Article 4. Effective date
This Decision takes effect fifteen (15) days from the date of publication in the Official Gazette. It abolishes Decision No. 1063/QĐ-BBCVT dated December 21, 2004 of the Minister of Posts and Telecommunications on the functions, tasks, powers, and organizational structure of the Southern Representative Office.
Article 5. Responsibilities for Implementation
The Chief of the General Office, Directors of the Organization and Cadres Department, Heads of agencies and units under the Ministry of Information and Communications, and the Head of the Ministry's Representative Office in Ho Chi Minh City are responsible for implementing this Decision./.
