CIRCULAR

Regulations on Reporting in Surveying and Mapping Activities

Pursuant to the Decree No. 21/2013/NĐ-CP dated March 4, 2013 of the Government stipulating functions, tasks, powers, and responsibilitiesvề nhiệm vụ và cơ cấu tổ chức của Bộ Tài nguyên và Môi trường;

Pursuant to Decree No. 45/2015/NĐ-CP dated May 6, 2015 of the Government on surveying and mapping activities;

AT THE SUGGESTION OF THE DIRECTOR OF VIETNAM SURVEYING AND MAPPING AGENCY AND THE HEAD OF THE LEGAL AFFAIRS DEPARTMENT;

issues this Circular detailing the activities and work relationships of Medical Expert Boards at all levels.ng Minister of Natural Resources and Environment promulgates this Circular on reporting regulations in surveying and mapping activities.o cáo1. Chapter 1

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

2. This Circular applies to state management agencies for surveying and mapping activities according to the Government's classification, and organizations granted licenses for surveying and mapping activities.

Article 2. Reporting in Surveying and Mapping Activities

Reporting in surveying and mapping activities shall be established according to the Appendices attached to this Circular, including:

1. Appendix No. 01: Report on the situation of surveying and mapping activities.

2. Appendix No. 02: Report on the situation of specialized surveying and mapping activities.

3. Appendix No. 03: Report on the situation of surveying and mapping activities in provinces and centrally governed cities.

4. Appendix No. 04: Report on the situation of management, use, and protection of construction surveying and mapping works.

Article 3. Reporting System, Responsibilities for Establishing and Submitting Reports on the Situation of Surveying and Mapping Activities

1. Reports in surveying and mapping activities shall be established annually, from January 1 to December 31 each year.

In addition to the regular reporting system, when requested by state management agencies for surveying and mapping activities, organizations granted licenses for surveying and mapping activities have the responsibility to submit ad hoc reports on the situation of surveying and mapping activities as required.

2. The responsibilities for establishing and submitting reports in surveying and mapping activities are as follows:

a) Organizations granted licenses for surveying and mapping activities under the management of provincial and centrally governed city People's Committees have the responsibility to establish reports according to Appendix No. 01 attached to this Circular. The report must be submitted to the Department of Natural Resources and Environment no later than ten (10) days after the end of the reporting period.

b) Organizations granted licenses for surveying and mapping activities not falling within the scope defined in Point a Clause of this Article have the responsibility to establish reports according to Appendix No. 01 attached to this Circular. The report must be submitted to the competent authority and the Vietnam National Survey and Mapping Center no later than ten (10) days after the end of the reporting period.

c) Ministries and sectors responsible for state management of surveying and mapping activities according to the Government's classification have the responsibility to establish reports according to Appendix No. 02 attached to this Circular. The report must be submitted to the Ministry of Natural Resources and Environment (through the Vietnam National Survey and Mapping Center) no later than fifteen (15) days after the end of the reporting period.

d) Departments of Natural Resources and Environment have the responsibility to establish reports according to Appendix No. 03 attached to this Circular. The report must be submitted to the provincial and centrally governed city People's Committees and the Vietnam National Survey and Mapping Center no later than twenty (20) days after the end of the reporting period.

đ) Commune People's Committees, District Natural Resources and Environment Departments report the current status of construction surveying works in their jurisdiction according to Appendix 04. The report must be submitted to the Department of Natural Resources and Environment no later than fifteen (15) days after the end of the reporting period.

3. Agencies and organizations that establish and submit reports are responsible for the accuracy of data and information in the reports.

The Director of the Vietnam National Survey and Mapping Center is responsible for guiding the implementation of this Circular;

Chapter 2

IMPLEMENTING PROVISIONS

Article 4. Organization of Implementation

The Director of the Vietnam National Survey and Mapping Center, the Heads of Provincial and Centrally Governed City Departments of Natural Resources and Environment are responsible for urging and inspecting the implementation of this Circular;

Any difficulties encountered during implementation should be reported promptly to the Ministry of Natural Resources and Environment for consideration and decision.

1. This Circular takes effect from December 15, 2015.

Article 5. Effective Date

This Circular replaces Decision No. 04/2007/QĐ-BTNMT dated February 27, 2007 of the Minister of Natural Resources and Environment on reporting regulations in surveying and mapping activities.

2. Ministries, ministerial-level agencies, government agencies responsible for managing specialized surveying and mapping activities; provincial and centrally governed city People's Committees, Directors of the Vietnam National Survey and Mapping Center, Heads of Provincial Departments of Natural Resources and Environment; organizations granted licenses for surveying and mapping activities are responsible for implementing this Circular./.

2. The ministries, ministerial-level agencies, and agencies under the Government shall be responsible for managing specialized surveying and mapping activities; the People's Committees of provinces and centrally governed cities, the Director of the Vietnam National Survey and Mapping Agency, the Directors of the Departments of Natural Resources and Environment; and organizations licensed to conduct surveying and mapping activities shall be responsible for implementing this Circular./.
