CIRCULAR

Regulations on the construction of administrative boundary database

Pursuant to Decree No. 36/2017/NĐ-CP dated April 4, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

Pursuant to Decree No. 45/2015/NĐ-CP dated May 6, 2015 of the Government on surveying and mapping activities;

At the proposal of the Director of the Vietnam National Mapping Agency, the Head of the Science and Technology Department, and the Head of the Legal Department;

The Minister of Natural Resources and Environment promulgates this Circular on the construction of administrative boundary databases.

Article 1. Scope of Regulation

This Circular stipulates technical standards and procedures for constructing and updating administrative boundary databases.

Article 2. Applicability

This Circular applies to state agencies, organizations, and individuals involved in the work of constructing and updating administrative boundary databases.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Administrative boundary database: is a structured collection of administrative boundary data.

2. Administrative boundary data: is data regarding the location, shape, and attribute information of administrative boundary objects.

Article 4. Construction of administrative boundary database

1. The administrative boundary database is constructed from the files of administrative boundaries at all levels that have been reviewed and approved by competent authorities for storage and use.

2. The procedure for constructing the administrative boundary database is specified in Appendix 1 attached hereto.

3. Technical standards for the administrative boundary database include:

a) The model structure and content of the administrative boundary database are specified in Appendix 2 attached hereto.

b) The quality assessment of the administrative boundary database is specified in Appendix 3 attached hereto.

c) Metadata for the administrative boundary database is specified in Appendix 4 attached hereto.

Article 5. Updating the administrative boundary database

1. The updating of the administrative boundary database shall only be carried out when there are changes to administrative boundaries due to the establishment, division, merger, or dissolution of administrative units pursuant to resolutions of the National Assembly and the Standing Committee of the National Assembly.

2. The updating of the administrative boundary database must be completed within thirty days from the date of receipt of the adjusted administrative boundary file that has been reviewed and approved by competent authorities for storage and use.

3. The updating of the administrative boundary database shall be conducted according to the principle of replacement update, with historical records kept for changed administrative units at all levels, and metadata updates must also be performed.

4. The procedure for updating the administrative boundary database is specified in Appendix 1 attached hereto. In particular:

a) Scope of replacement update: corresponds only to the administrative boundary file of the established, divided, merged, or dissolved administrative unit;

b) For adjacent administrative units to the established, divided, merged, or dissolved administrative unit: must synchronously update related administrative boundary objects and geographic objects.

5. The process of updating the administrative boundary database must comply with the technical standards stipulated in Clause 3 of Article 4 of this Circular.

Article 6. Effectiveness

This Circular takes effect from December 1, 2017.

Article 7. Implementation Organization

1. Ministries, ministerial-level agencies, government-affiliated agencies, provincial People's Committees, and relevant organizations are responsible for implementing this Circular.

2. The Vietnam National Mapping Agency is responsible for organizing the construction and updating of administrative boundary databases at all levels; guiding and supervising the implementation of this Circular.

3. During the implementation process, if there are any difficulties, agencies and organizations shall promptly report to the Ministry of Natural Resources and Environment for consideration and decision./.
