DECREE
Regulations on Administrative Sanctions for Violations in the Field of Sports

Pursuant toLaw on the Organization of the Government June 19, 2015;

Pursuant toLaw on Handling Administrative ViolationsJune 20, 2012;

Pursuant toLaw on Physical Culture and SportsNovember 29, 2006 andLaw Amending and Supplementing Certain Provisions of the Law on Physical Culture and SportsJune 14, 2018;

At the proposal of the Minister of Culture, Sports and Tourism;

The Government issues this Decree to regulate administrative sanctions for violations in the field of sports.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

1. This Decree stipulates acts of violation, forms of sanction, levels of sanction, measures to remedy consequences for acts of administrative violation; authority to impose sanctions and authority to issue administrative violation records in the field of sports.

2. Other acts of administrative violation in the field of sports not provided for in this Decree shall be subject to regulations set forth in other decrees of the Government regulating administrative sanctions in other fields of state management related thereto.

Article 2. Applicability

Organizations and individuals of Vietnam engaging in sports activities within the territory of Vietnam and abroad. Foreign organizations and individuals engaging in sports activities within the territory of Vietnam.

2. Organizations referred to in Clause 1 of this Article include:

a) State agencies committing acts of administrative violation that are not part of their assigned state management tasks;

b) Enterprises established and operating under Vietnamese law; representative offices and branch offices of foreign enterprises operating in Vietnam;

c) Representative offices in Vietnam of foreign agencies and international organizations;

d) Sports public service units;

đ) Sports social-professional organizations;

e) Sports clubs;

g) Legal entities according to civil law or other organizations established in accordance with the law.

3. Subjects committing administrative violations in the field of sports not covered by Clause 2 of this Article shall be sanctioned as if they were individuals.

4. Persons authorized to issue administrative violation records; persons authorized to impose administrative sanctions in the field of sports.

5. Other agencies, organizations, and individuals related to sports activities.

Article 3. Forms of Sanction

1. Principal forms of sanction

For each act of administrative violation in the field of sports, the violating organization or individual must bear one of the following principal forms of sanction:

a) Warning;

b) Fine.

2. Supplementary forms of sanction

Depending on the nature and degree of violation, organizations and individuals committing administrative violations in the field of sports may also be subject to one or more of the following supplementary forms of sanction:

a) Suspension of the right to use certificates of eligibility for business operations in sports for a period of from one month to six months;

b) Confiscation of materials, equipment, and tools used for training, performance, and competition in sports that were used to commit administrative violations;

c) Suspension of sports activities for a period of from one month to three months;

d) Suspension of sports activities for a period of from three months to six months;

đ) Suspension of participation in sports competitions for a period of from one month to three months;

e) Suspension of participation in sports competitions for a period of from three months to six months;

g) Suspension of organizing sports competitions for a period of from one month to three months;

h) Suspension of organizing sports competitions for a period of from three months to six months.

Article 4. Measures to Remedy Consequences

For each act of administrative violation, in addition to being subject to a form of sanction, organizations and individuals committing administrative violations in the field of sports may also be subject to one or more of the following measures to remedy consequences:

1. Compel the return of illegal profits obtained through the implementation of the act of administrative violation.

2. Compel the cancellation of results of awarding athlete, coach, and referee titles in competitive sports.

3. Compel the cancellation of sports competition results; results of selecting athletes for sports teams, sports talent schools; sports achievements.

4. Compel the destruction of instructional materials using prohibited methods in training and competition in sports.

5. Compel public apology.

Article 5. Amount of fines and authority to impose fines for administrative violations in the field of sports

1. The maximum amount of fine in the field of sports prescribed in this Decree is VND 50,000,000 for individuals and VND 100,000,000 for organizations.

2. The amount of fine prescribed in this Decree applies to individuals except in cases stipulated in Clause 2, Article 10, Clause 2, Article 11, Articles 13, 14, 16, Clause 2, Article 17, and Clause 2, Article 20 of this Decree. For the same administrative violation, the amount of fine for organizations is twice that for individuals.

3. The authority to impose fines of officials with the power to impose penalties prescribed in Chapter III of this Decree is the authority to apply to individual administrative violations; the authority to impose fines on organizational administrative violations is twice the authority to impose fines on individuals.

Chapter II

ACTS OF ADMINISTRATIVE VIOLATION, FORMS OF ADMINISTRATIVE PENALTY AND MEASURES TO REMEDY CONSEQUENCES

Article 6. Violations of regulations on the use of stimulants in training and sports competitions

1. A fine of from VND 10,000,000 to VND 15,000,000 for the act of using stimulants listed in the Prohibited List in training and sports competitions.

2. A fine of from VND 15,000,000 to VND 20,000,000 for the act of covering up, organizing for athletes to use stimulants listed in the Prohibited List in training and sports competitions.

3. Additional forms of punishment:

a) Suspension from participating in sports competition events for a period of from one month to three months for the violation prescribed in Clause 1 of this Article;

b) Suspension from participating in sports competition events for a period of from three months to six months for the violation prescribed in Clause 2 of this Article.

4. Measures to remedy consequences:

Compel the cancellation of results of sports competitions, results of selecting athletes for sports teams, sports schools, and sports achievements for the violations prescribed in Clause 1 and Clause 2 of this Article.

Article 7. Violations of regulations on the use of prohibited methods in training and sports competitions

1. A fine of from VND 5,000,000 to VND 10,000,000 for the act of using exercises, sports disciplines, or training and competition methods that have pornographic, obscene, violent, immoral, and contrary to social ethics, customs, and national cultural identity characteristics.

2. A fine of from VND 10,000,000 to VND 15,000,000 for the act of using exercises, sports disciplines, or training and competition methods that pose danger to the lives and health of trainees and competitors, except those exercises, sports disciplines, and training and competition methods permitted by law.

3. Additional forms of punishment:

a) Confiscation of training, performance, and competition materials, equipment, and tools for the violations prescribed in Clause 1 and Clause 2 of this Article;

b) Suspension from participating in sports competition events for a period of from three months to six months for the violations prescribed in Clause 1 and Clause 2 of this Article.

4. Measures to remedy consequences:

Compel the destruction of instructional materials on the use of prohibited methods in training and sports competitions for the violations prescribed in Clause 1 and Clause 2 of this Article.

Article 8. Violations of regulations prohibiting fraud in sports activities

1. A fine of from VND 5,000,000 to VND 10,000,000 for the act of fraud regarding name, age, gender, and achievement to be selected for sports teams, sports schools, or participate in sports competitions.

2. A fine of from VND 10,000,000 to VND 15,000,000 for the act of covering up, enticing, or forcing others to commit fraud in sports activities.

3. A fine of from VND 15,000,000 to VND 20,000,000 for the act of falsifying the results of sports competitions.

4. Additional forms of administrative punishment:

a) Suspension from participating in sports competition events for a period of from one month to three months for the violation prescribed in Clause 1 of this Article;

b) Suspension from participating in sports competition events for a period of from three months to six months for the violation prescribed in Clause 3 of this Article.

5. Measures to remedy consequences:

a) Compel the cancellation of results of sports competitions, results of selecting athletes for sports teams, sports schools, and sports achievements for the violations prescribed in Clause 1 and Clause 3 of this Article;

b) Compel the return of illegal profits obtained through the implementation of the violations prescribed in Clause 1 and Clause 3 of this Article.

Article 9. Violation of the prohibition on violence in sports activities

1. A fine of VND 15,000,000 to VND 20,000,000 shall be imposed for acts of insulting, verbally abusing, defaming the dignity and reputation; threatening to harm health and life; reacting inappropriately to moral standards, customs, and cultural traditions of Vietnam when participating in sports activities.

2. A fine of VND 20,000,000 to VND 25,000,000 shall be imposed for intentional acts causing injury, playing violently affecting others' health during training and competition in sports.

3. Additional forms of punishment:

Suspension from participating in sports competitions for a period of three to six months for violations stipulated in Clause 2 of this Article.

4. Measures to remedy consequences:

Public apology shall be ordered for acts of insulting, verbally abusing, defaming the dignity and reputation as stipulated in Clause 1 of this Article.

Article 10. Violation of the rights and obligations of high-performance athletes

1. Violation of the obligations of high-performance athletes:

a) Warning shall be imposed for acts of not properly or fully implementing the training program and lesson plans of coaches.

b) A fine of VND 500,000 to VND 1,000,000 shall be imposed for acts of not implementing the training program and lesson plans of coaches.

c) A fine of VND 1,000,000 to VND 5,000,000 shall be imposed for acts of not complying with the rules of the sport and tournament regulations.

2. Violation of the rights of high-performance athletes:

a) A fine of VND 1,000,000 to VND 5,000,000 shall be imposed for acts of not conducting health checks for athletes as prescribed.

b) A fine of VND 5,000,000 to VND 10,000,000 shall be imposed for acts of not providing timely first aid or emergency care for athletes or failing to ensure adequate equipment, means, and safety measures for athletes during training and competition as prescribed.

Article 11. Violation of the rights and obligations of high-performance sports coaches

1. Violation of the obligations of high-performance sports coaches:

a) A fine of VND 1,000,000 to VND 5,000,000 shall be imposed for acts of not developing a training plan and program for submission to the athlete's employing agency for approval or not implementing the approved training plan and program.

b) A fine of VND 5,000,000 to VND 10,000,000 shall be imposed for acts of not ensuring safety measures for athletes during training and competition or not complying with the rules of the sport and tournament regulations.

2. Violation of the rights of high-performance sports coaches:

a) A fine of VND 5,000,000 to VND 10,000,000 shall be imposed for acts of not providing training equipment for coaches.

b) A fine of VND 10,000,000 to VND 15,000,000 shall be imposed for acts of not implementing safety measures for coaches during training.

Article 12. Violation of the obligations of high-performance sports referees

A fine of VND 15,000,000 to VND 20,000,000 shall be imposed for acts of being dishonest and impartial in managing sports competitions.

Article 13. Violation of regulations on awarding ranks to athletes, coaches, and referees in high-performance sports

1. A fine of from VND 1,000,000 to VND 5,000,000 shall be imposed for the act of awarding ranks to athletes without meeting the required standards.

2. A fine of from VND 5,000,000 to VND 10,000,000 shall be imposed for the act of awarding ranks to coaches and referees without meeting the required standards.

3. Measures to remedy consequences:

The results of rank awards shall be nullified for acts violating the provisions of Clause 1 and Clause 2 of this Article.

Article 14. Violation of regulations on organizing mass sports competitions

1. A fine of from VND 500,000 to VND 1,000,000 shall be imposed for the act of reporting in writing to the competent state agency about organizing a sports competition lacking one of the following contents: name of the competition, time, location, schedule, security conditions, public order, medical care, technical equipment meeting the requirements for organizing the competition.

2. A fine ranging from 1,000,000 VND to 5,000,000 VND for one of the following actions:

a) Not establishing an Organizing Committee for the competition;

b) Not having Competition Regulations;

c) Not reporting in writing to the competent state agency about organizing and the results of the competition.

3. A fine of from VND 5,000,000 to VND 10,000,000 shall be imposed for the act of organizing a sports competition beyond authority.

4. Additional forms of administrative punishment:

a) Suspension of organizing a sports competition for a period of from one month to three months for violations of the provisions of Clause 2 of this Article;

b) Suspension of organizing a sports competition for a period of from three months to six months for violations of the provisions of Clause 3 of this Article.

5. Measures to remedy consequences:

The illegal gains obtained from implementing the violations stipulated in Clause 2 and Clause 3 of this Article shall be confiscated.

Article 15. Violation of regulations on conditions for operating dangerous sports activities and compulsory sports activities with coaching

A fine of from VND 20,000,000 to VND 30,000,000 shall be imposed for the act of operating dangerous sports activities and compulsory sports activities with coaching without registering to establish a business.

Article 16. Violation of regulations on Business Registration Certificate for Operating Sports Activities

1. A fine of from VND 1,000,000 to VND 5,000,000 shall be imposed for the act of not processing the reissue of the Business Registration Certificate for Operating Sports Activities as prescribed.

2. A fine of VND 5,000,000 to VND 10,000,000 shall be imposed for any of the following acts:

a) Operating sports activities without a Business Registration Certificate for Operating Sports Activities;

b) Lending or renting the Business Registration Certificate for Operating Sports Activities to other organizations;

c) Operating sports activities after the Decision revoking the Business Registration Certificate for Operating Sports Activities of the enterprise has taken effect.

3. The provisions of Clause 1 and Clause 2 of this Article also apply to Professional Sports Clubs.

4. Additional forms of administrative punishment:

Revocation of the right to use the Business Registration Certificate for Operating Sports Activities for a period of from one month to six months for acts violating the provisions of point b Clause 2 of this Article.

5. Measures to remedy consequences:

The illegal gains obtained from implementing the violations stipulated in Clause 2 of this Article shall be confiscated.

Article 17. Violation of regulations on conditions for operating in professional sports activities

1. Imposing a fine from VND 1,000,000 to VND 5,000,000 for any of the following acts:

a) Professional coaches without a bachelor's degree in physical education and sports in a relevant field corresponding to the professional sport activity and completion of the national sports federation's professional coach training program, and without a professional coach certificate as prescribed;

b) Professional athletes without a labor contract with a professional sports club; not recognized by the national sports federation; foreign athletes participating in professional sports competitions in Vietnam without an international transfer certificate;

c) Medical staff without a professional qualification at least at the college level in health care.

2. A fine of VND 5,000,000 to VND 10,000,000 shall be imposed for any of the following acts:

a) Using professional coaches, professional athletes, and medical staff in professional sports activities that do not meet the prescribed conditions;

b) Using facilities, training and competition equipment for professional sports that do not comply with national technical standards, Vietnamese standards, or international standards and are consistent with the regulations of international professional sports organizations.

3. Additional forms of punishment:

Suspension of sports activities for a period of from one month to three months for violations of the provisions of point b Clause 2 of this Article.

Article 18. Violations concerning physical infrastructure conditions in sports business operations

1. Imposing a fine from VND 1,000,000 to VND 5,000,000 for any of the following acts:

a) Failing to meet requirements for rules boards, guidance boards, instruction boards, signs, and markers specific to each sport;

b) Failing to meet requirements for mooring buoys, positioning flags, navigation buoys, signal flags, lifebuoys, life jackets, rescue ropes, rescue poles, rescue chairs, and other safety equipment specific to each sport;

c) Failing to meet requirements for changing rooms, personal item storage areas, shower facilities, foot washing areas, restrooms, parking and landing zones, starting zones, equipment assembly and anchorage zones, and firearm and ammunition storage zones specific to each sport;

d) Failing to meet sound and lighting requirements specific to each sport;

đ) Failing to meet requirements for first aid kits, emergency medical equipment, and initial medical care specific to each sport;

e) Failing to meet requirements for exercise and service usage logs, and firearm and ammunition usage logs specific to each sport;

g) Failing to meet requirements for fences, protective nets, safety nets, barriers, and enclosures specific to each sport.

2. A fine of VND 5,000,000 to VND 10,000,000 shall be imposed for any of the following acts:

a) Failing to meet area and size requirements for training and competition venues specific to each sport;

b) Failing to meet requirements for surface levels, floor surfaces, depth, depth variations, slope, curve radius, height, and coverings specific to each sport;

c) Failing to meet water quality requirements for swimming pools;

d) Failing to meet training density, coaching density, and rescue personnel density requirements specific to each sport;

đ) Failing to meet spacing requirements between training and competition equipment specific to each sport;

3. A fine of from VND 10,000,000 to VND 15,000,000 shall be imposed for any of the following violations:

a) Failing to meet activity zone requirements specific to each sport;

b) Failing to meet entry and exit door requirements for each docking and anchorage area specific to each sport;

4. The provisions of Clause 1, Clause 2, and Clause 3 of this Article shall also apply to businesses engaged in sports activities that require coaching, dangerous sports activities, and aquatic sports activities.

5. Additional forms of punishment:

Suspension of sports activities for a period of from one to three months for violations stipulated in Clause 3 of this Article.

Article 19. Violations concerning equipment in sports business operations

1. A fine of from VND 1,000,000 to VND 5,000,000 shall be imposed for failing to meet equipment requirements for training and competition as prescribed.

2. A fine of VND 5,000,000 to VND 10,000,000 shall be imposed for any of the following acts:

a) Failing to meet communication and rescue requirements as prescribed;

b) Failing to meet observation station requirements as prescribed by law;

c) Using water scooters that do not meet technical safety and environmental protection standards.

3. A fine of from VND 10,000,000 to VND 15,000,000 shall be imposed for conducting sports activities on rivers, seas, lakes, or large streams without a motorized rescue boat as prescribed.

4. The provisions of Clause 1, Clause 2, and Clause 3 of this Article shall also apply to businesses engaged in sports activities that require coaching, dangerous sports activities, and aquatic sports activities.

5. Additional forms of punishment:

Suspension of sports activities for a period of from one to three months for violations stipulated in Clause 3 of this Article.

Article 20. Violations concerning professional staff in sports business operations

1. A fine of from VND 1,000,000 to VND 5,000,000 shall be imposed for coaches, rescue personnel, and medical staff who do not meet prescribed conditions.

2. A fine of VND 5,000,000 to VND 10,000,000 shall be imposed for any of the following acts:

a) Failing to meet coaching and rescue personnel quantity requirements as prescribed;

b) Not having a permanent medical staff member or not having an agreement with the nearest healthcare facility regarding medical staff for emergency treatment of participants in dangerous sports activities when necessary;

c) Using professional staff who do not meet prescribed conditions.

3. The provisions of Clause 1 and Clause 2 of this Article shall also apply to businesses engaged in sports activities that require coaching, dangerous sports activities, and aquatic sports activities.

4. Additional forms of punishment

Suspension of sports activities for a period of from one to three months for violations stipulated in Clause 2 of this Article.

Article 21. Violations of other provisions in sports activities

1. A fine of from five million dong to ten million dong shall be imposed on acts intentionally obstructing lawful sports activities of organizations and individuals.

2. A fine of from ten million dong to fifteen million dong shall be imposed on acts taking advantage of sports activities to infringe upon the lawful interests of other organizations and individuals.

3. A fine of from fifteen million dong to twenty million dong shall be imposed on acts conducting sports activities contrary to social morals, customs, and the national cultural identity of Vietnam.

4. A fine of from twenty million dong to thirty million dong shall be imposed on acts conducting sports activities causing damage to the reputation, dignity, and credibility of persons.

5. A fine of from thirty million dong to forty million dong shall be imposed on acts conducting sports activities causing damage to health.

6. Additional forms of punishment:

Suspension of sports activities for a period of from three months to six months shall be imposed on violations stipulated in Clauses 2, 3, 4, and 5 of this Article.

7. Measures to remedy consequences:

Public apology shall be ordered for violations stipulated in Clause 4 of this Article.

Chapter III

AUTHORITY TO IMPOSE ADMINISTRATIVE SANCTIONS AND AUTHORITY TO ISSUE VIOLATION RECORDS

Article 22. Authority to impose administrative sanctions of specialized inspection agencies

1. Inspectors and persons assigned to perform specialized inspection functions while performing their duties have the right:

a) To issue warnings;

b) Impose a fine up to 500,000 VND;

c) To confiscate sports training, performance, and competition materials, equipment, and tools that do not comply with regulations and are valued at no more than five hundred thousand dong.

2. The Chief Inspector and the Head of the specialized inspection team under the provincial management agency for sports have the right:

a) To issue warnings;

b) To impose fines up to VND 25,000,000;

c) To confiscate sports training, performance, and competition materials, equipment, and tools that do not comply with regulations and are valued at no more than twenty-five million dong;

d) To apply supplementary administrative sanctions prescribed in Clause 2 of Article 3 of this Decree;

đ) To apply measures to remedy consequences prescribed in Article 4 of this Decree.

3. The Head of the specialized inspection team under the Ministry of Culture, Sports and Tourism has the right:

a) To issue warnings;

b) Impose a fine up to thirty-five million dong;

c) To confiscate sports training, performance, and competition materials, equipment, and tools that do not comply with regulations and are valued at no more than thirty-five million dong;

d) To apply supplementary administrative sanctions prescribed in Clause 2 of Article 3 of this Decree;

đ) To apply measures to remedy consequences prescribed in Article 4 of this Decree.

4. The Chief Inspector of ministries, the Director of the Directorate of Inland Waterways (Ministry of Transport), the Director of the Drug Administration, the Director of the Department of Medical Examination and Treatment, and the Director of the Preventive Health Department (Ministry of Health) have the right:

a) To issue warnings;

b) To impose fines up to VND 50,000,000;

c) To confiscate sports training, performance, and competition materials, equipment, and tools that do not comply with regulations and are valued at no more than fifty million dong;

d) To apply supplementary administrative sanctions prescribed in Clause 2 of Article 3 of this Decree;

đ) To apply measures to remedy consequences prescribed in Article 4 of this Decree.

Article 23. Authority to impose administrative sanctions of Chairpersons of People's Committees at all levels

1. The Chairperson of the People's Committee at the commune level has the right to:

a) To issue warnings;

b) To impose a fine up to five million dong;

c) To confiscate sports training, performance, and competition materials, equipment, and tools that do not comply with regulations and are valued at no more than five million dong.

2. The Chairperson of the People's Committee at the district level has the right to:

a) To issue warnings;

b) To impose fines up to VND 25,000,000;

c) To confiscate sports training, performance, and competition materials, equipment, and tools that do not comply with regulations and are valued at no more than twenty-five million dong;

d) To apply supplementary administrative sanctions prescribed in Clause 2 of Article 3 of this Decree;

đ) To apply measures to remedy consequences prescribed in Article 4 of this Decree.

3. The Chairman of the Provincial People's Committee has the authority to:

a) To issue warnings;

b) To impose fines up to VND 50,000,000;

c) To confiscate sports training, performance, and competition materials, equipment, and tools that do not comply with regulations and are valued at no more than fifty million dong;

d) To apply supplementary administrative sanctions prescribed in Clause 2 of Article 3 of this Decree;

đ) To apply measures to remedy consequences prescribed in Article 4 of this Decree.

Article 24. Authority to impose administrative sanctions of the People's Public Security

The authority to impose administrative sanctions, apply supplementary sanctions, and take remedial measures of the People's Public Security shall be implemented in accordance with the provisions of Article 39 of the Law on Handling Administrative Violations.

Article 25. Competence to impose penalties of the Border Guard Force

1. Border Guard soldiers performing official duties have the right:

a) To issue warnings;

b) Impose a fine up to 500,000 VND.

2. The Station Commander, Team Leader as provided for in Clause 1 of this Article shall have the authority: has the right to:

a) To issue warnings;

b) Impose a fine up to 2,500,000 VND.

3. The Head of a Border Guard Post, the Commander of a Border Guard Squadron, the Commander of a Border Guard District, and the Commander of a Border Gate Port Border Guard shall have the authority:

a) To issue warnings;

b) To impose fines up to VND 25,000,000;

c) Suspension of sports activities for a period of from one month to three months;

d) To suspend sports activities for a period of from three months to six months.

4. The Commander of the Border Guard Force at provincial level, the Commander of the Coastal Border Guard Squadron subordinate to the Border Guard Command shall have the authority:

a) To issue warnings;

b) To impose fines up to VND 50,000,000;

c) Suspension of sports activities for a period of from one month to three months;

d) To suspend sports activities for a period of from three months to six months.

Article 26. Competence to impose penalties of the Coast Guard

1. Coast Guard officers performing their duties have the right to:

a) To issue warnings;

b) To impose fines up to VND 1,000,000.

2. The head of the Coast Guard business affairs team have the right to:

a) To issue warnings;

b) Impose a fine up to 2,500,000 VND.

3. The Head of the Maritime Police Operational Team, the Head of the Maritime Police Station have the right to:

a) To issue warnings;

b) Impose a fine up to 5,000,000 VND.

4. The maritime squadron commander have the right to:

a) To issue warnings;

b) A fine up to VND 10,000,000.

5. Chiefs of coast guard fleets have the authority to:

a) To issue warnings;

b) To impose fines up to fifteen million dong.

6. The Commander of the Coast Guard Zone shall have the authority:

a) To issue warnings;

b) To impose fines up to twenty-five million dong.

7. The Commander of the Coast Guard shall have the authority:

a) To issue warnings;

b) To impose fines up to VND 50,000,000;

c) Suspension of sports activities for a period of from one month to three months;

d) To suspend sports activities for a period of from three months to six months.

Article 27. Allocation of Competence to Impose Administrative Penalties

1. The Chairpersons of People's Committees at all levels shall have the authority to issue administrative violation records, impose administrative penalties, and apply measures to remedy consequences for acts of administrative violations stipulated in Articles 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, and 21 of this Decree according to the competence prescribed in Article 23 of this Decree and their assigned functions, tasks, and powers.

2. Those with the authority to impose penalties of the People's Public Security shall have the authority to issue administrative violation records, impose administrative penalties, and apply measures to remedy consequences for acts of administrative violations stipulated in Articles 6, 7, 8, 9, 12, 14, 15, 16, 17, Clause 3 of Article 18, Clause 3 of Article 19, Article 20, and Article 21 of this Decree according to the competence prescribed in Article 24 of this Decree and their assigned functions, tasks, and powers.

3. Those with the authority to impose penalties of specialized inspection agencies shall be allocated as follows:

a) Cultural, Sports, and Tourism Inspectors (including Inspectors of the specialized bodies on physical culture and sports under the provincial People's Committee) shall have the authority to issue administrative violation records, impose administrative penalties, and apply measures to remedy consequences for acts of administrative violations stipulated in Articles 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, and 21 of this Decree according to the competence prescribed in Article 22 of this Decree and their assigned functions, tasks, and powers;

b) Transport Inspectors shall have the authority to issue administrative violation records, impose administrative penalties, and apply measures to remedy consequences for acts of administrative violations stipulated in Clause 3 of Article 18 and Point b Clause 2 of Article 19 of this Decree according to the competence prescribed in Article 22 of this Decree and their assigned functions, tasks, and powers;

c) Health Inspectors shall have the authority to issue administrative violation records, impose administrative penalties, and apply measures to remedy consequences for acts of administrative violations stipulated in Article 6; Point đ Clause 1 and Point c Clause 2 of Article 18 of this Decree according to the competence prescribed in Article 22 of this Decree and their assigned functions, tasks, and powers.

4. Those with the authority to impose penalties of the Border Guard Force shall have the authority to issue administrative violation records, impose administrative penalties, and apply measures to remedy consequences for acts of administrative violations stipulated in Clause 3 of Article 18 and Clause 3 of Article 19 of this Decree according to the competence prescribed in Article 25 of this Decree and their assigned functions, tasks, and powers.

5. Those with the authority to impose penalties of the Coast Guard shall have the authority to issue administrative violation records, impose administrative penalties, and apply measures to remedy consequences for acts of administrative violations stipulated in Clause 3 of Article 18 and Clause 3 of Article 19 of this Decree according to the competence prescribed in Article 26 of this Decree and their assigned functions, tasks, and powers.

Article 28. Competence to draw up administrative violation records

The positions specified in Articles 22, 23, 24, 25, and 26 of this Decree and civil servants and officials from the culture, sports, and tourism sector performing inspection and supervision duties who discover acts of administrative violations in the field of sports shall have the authority to draw up administrative violation records in accordance with the provisions.

IMPLEMENTING PROVISIONS

Chapter IV

Article 29. Transitional Provisions

For acts of administrative violations in the field of sports that occur before the effective date of this Decree but are discovered later or are under consideration for resolution, the most favorable provisions shall be applied to the individuals or organizations that violated the law.

Article 30. Effective Date

1. This Decree takes effect from August 1, 2019.

2. From the date this Decree takes effect, Section 2 of Chapter II of Decree No. 158/2013/NĐ-CP dated November 12, 2013 of the Government on administrative penalties in the fields of culture, sports, tourism, and advertising, Clause 2 of Article 2 of Decree No. 28/2017/NĐ-CP dated March 20, 2017 of the Government amending and supplementing certain articles of Decree No. 131/2013/NĐ-CP dated October 16, 2013 of the Government on administrative penalties concerning copyright and related rights, and Decree No. 158/2013/NĐ-CP dated November 12, 2013 of the Government on administrative penalties in the fields of culture, sports, tourism, and advertising shall cease to be effective.

Article 31. Implementation and Guidance on Enforcement

1. The Minister of Culture, Sports and Tourism shall be responsible for organizing the implementation of this Decree.

2. Ministers, heads of ministerial-level agencies, heads of government agencies, and chairpersons of provincial people's committees directly under the central government are responsible for implementing this Decree./.
