Issuing Standards for Surveying Investment in Construction of Radio Frequency Control Systems

Pursuant to the Law on Telecommunications dated November 23, 2009;

Pursuant to the Law on Construction promulgated on June 18, 2014;

Pursuant to the Law Amending and Supplementing Certain Provisions of the Construction Law on January 17 May 14, 2016 Government Decree detailing some provisions and measures to implement the Law on Legislative Regulatory Documents;

Pursuant to Decree No. 17/2017/NĐ-CP dated February 17, 2017, issued by the Government, on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

At the proposal of the Director of the Department of Planning and Finance;

The Minister of Information and Communications issues this Circular on issuing Standards for Surveying Investment in Construction of Radio Frequency Control Systems.

Article 1. Accompanying this Circular are the Standards for Surveying Investment in Construction of Radio Frequency Control Systems.

Article 2. Scope of Regulation

The Standards for Surveying Investment in Construction of Radio Frequency Control Systems stipulate direct costs related to labor, materials, and construction machinery used as a basis for determining expenses in surveying investment in construction of radio frequency control systems.

Article 3. Applicability

This Circular applies to agencies, organizations, and individuals involved in managing investment costs for projects constructing radio frequency control systems using public funds, state capital outside of public investment, and projects constructed under Public-Private Partnership (PPP) models.

Article 4. Transitional Provisions

1. In cases where the total investment amount or construction budget has been reviewed or approved before the effective date of this Circular, such amounts must be updated with the standards at the next cost management stage, such as the construction budget based on technical design or construction drawings, or updating the tender price.

2. For construction tenders belonging to investment projects that have issued tender documents or request documents but have not yet closed bids before the effective date of this Circular, the investment decision-maker shall consider and decide on the application of the provisions of this Circular.

3. In cases where construction tenders have already closed bids, or contractors have been selected, or contracts have been signed before the effective date of this Circular, they shall be implemented according to the tender documents, request documents, bid documents, proposal documents, and signed contracts.

Article 5. Effective Date

1. This Circular takes effect from March 1, 2021.

2. During implementation, if there are difficulties or obstacles, agencies and units are requested to report to the Ministry of Information and Communications for consideration and resolution./.
