Circular No. 46/2024/TT-BCA Amending and Supplementing Certain Provisions of Circular No. 67/2019/TT-BCA on Implementing Democracy in Traffic Order and Safety Assurance Work

CIRCULAR

Amending and supplementing certain Articles of Circular No. 67/2019/TT-BCA dated November 28, 2019 of the Minister of Public Security on implementing democracy in traffic safety assurance work

Pursuant to the Law on Access to Information dated April 6, 2016;

Pursuant to the Law on the Public Security Organs dated November 20, 2018; the Law Amending and Supplementing Certain Articles of the Law on the Public Security Organs dated June 22, 2023;

Pursuant to the Law on Implementing Democracy at the Grassroots Level dated November 10, 2022;

Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the Traffic Police Corps;

The Minister of Public Security issues this Circular amending and supplementing certain Articles of Circular No. 67/2019/TT-BCA dated November 28, 2019 on implementing democracy in traffic safety assurance work.

Article 1. Amending and supplementing certain Articles of Circular No. 67/2019/TT-BCA dated November 28, 2019 of the Minister of Public Security on implementing democracy in traffic safety assurance work

1. Amending and supplementing Clause 2, Clause 3 Article 4 as follows:

a) Amending and supplementing Clause 2 of Article 4 as follows:

"2. The area of duty performance is a zone delimited by cone-shaped posts or yellow ropes for police officers to perform tasks ensuring traffic safety and public order. The area of duty performance must comply with other relevant laws."

b) Amend and supplement Clause 3 of Article 4 as follows:

"3. Yellow rope is a rope with a red base and a yellow border, width from 5 cm to 10 cm; printed on the rope in yellow reflective letters are the words "POLICE LINE. DO NOT CROSS - HÀNG RÀO CẢNH SÁT. CẤM VƯỢT QUA" with reflective properties."

2. Amending and supplementing Point b, Point c Clause 1, Point b, Point d Clause 2 and adding Point d after Point c Clause 4 Article 5 as follows:

a) Amending and supplementing Point b Clause 1 Article 5 as follows:

"b) Name, address, direct phone number, suggestion box, social media account, time for receiving citizens to handle administrative violations of the public security agency responsible for patrol, inspection, and handling administrative violations;"

b) Amending and supplementing Point c Clause 1 Article 5 as follows:

"c) Technical equipment used to detect administrative violations according to the Law on Handling Administrative Violations;"

c) Amending and supplementing Point b Clause 2 Article 5 as follows:

"b) Name, address, working hours, direct phone number, suggestion box, social media account of the public security agency responsible for registering and issuing vehicle license plates;"

d) Amending and supplementing Point d Clause 2 Article 5 as follows:

"d) Vehicle license plates put up for auction, registration fees;"

e) Adding Point d after Point c Clause 4 Article 5 as follows:

"d) Name, address, direct phone number, suggestion box, social media account of the public security agency responsible for investigating and resolving traffic accidents."

3. Amending and supplementing Clause 1 of Article 6 as follows:

"1. Posting on the Portal of Electronic Information; Website, social media accounts of the public security agency."

"3. In special administrative-economic zones without local government levels, the People's Committee of the special zone shall perform the responsibilities of the Standing Body of the People's Council at the commune level as stipulated in Clauses 1 and 2 of this Article."

"3. Through the Portal of Electronic Information; Website; social media accounts and applications on electronic devices managed by the public security agency."

5. Amending and supplementing Clause 5 Article 9 as follows:

"5. Reporting to the nearest public security agency or People's Committee incidents of traffic accidents, traffic jams; illegal racing, disrupting public order, criminal offenses affecting traffic safety; placing obstacles on roads hindering traffic; throwing earth, stones, or other objects at vehicles or traffic participants; illegally transporting flammable, explosive, narcotic substances, or other goods; impersonating people's police; resisting public officials and other traffic safety violations."

6. Amending and supplementing Article 11 as follows:

"Article 11. Forms of supervision by the people

1. The people can supervise through the following forms:

a) Accessing publicly available information of the public security force and mass media;

b) Through supervisory subjects as prescribed by law;

c) Direct interaction and resolution of matters with police officers;

d) Results of case resolutions, complaints, petitions, suggestions, and reports;

e) Direct observation of traffic safety assurance work.

2. People's supervision must meet the following conditions:

a) Not interfering with the activities of police officers while performing their duties;

b) Not entering the duty performance area defined in Clause 2 Article 4 of this Circular, except for those with related rights and obligations;

c) Complying with other relevant laws."

Article 2. Repeal certain provisions of Circular No. 67/2019/TT-BCA dated November 28, 2019, issued by the Minister of Public Security on implementing democracy in traffic order and safety assurance work.

Repeal Point d Clause 1, Point c Clause 2, and Point b Clause 3 of Article 5 of Circular No. 67/2019/TT-BCA dated November 28, 2019, issued by the Minister of Public Security on implementing democracy in traffic order and safety assurance work.

Article 3. Implementation Provisions

1. This Circular takes effect from November 15, 2024.

2. Ropes distributed before this Circular takes effect shall continue to be used until December 31, 2025.
