JOINT CIRCULAR

Regarding the treatment for trainees, overseas students, and research fellows who are state employees and workers selected to study abroad

________________________

In recent years, implementing the Central Committee's and Government's policy, the Ministries have sent many trainees, overseas students, and research fellows abroad to study in order to train cadres and workers to serve the socialist construction mission.

The majority of those selected to study and train are state employees and workers within the establishment of state agencies and enterprises. For the groups of trainees, there are also interpreters accompanying them to serve their training work.

Based on the Resolution of the Standing Meeting of the Council of Ministers at its session on September 9, 1959, the Joint Ministry of Interior-Finance-Education stipulates the following regulations for trainees, overseas students, research fellows, and interpreters to encourage them to study with peace of mind and enthusiasm:

- All trainees, overseas students, research fellows, including interpreters, are fully supported by the Government to ensure necessary living needs (including food, clothing, expenses...) according to the characteristics of each country and field of study throughout the time abroad.

- All trainees, overseas students, research fellows, including interpreters, who were previously in the establishment of agencies and enterprises before going abroad, will retain 100% of their basic salary grade assigned in 1958 and child allowances (if applicable) throughout their time abroad. If comparing 100% of the basic salary and child allowances (if applicable) with the living expenses or government scholarships abroad (calculated based on trade exchange rates) and if it is higher, they will enjoy the difference, if lower, the Government will subsidize the shortfall.

Specifically, for those with families consisting of parents and spouses and children still working in the country and directly supporting them, appropriate care will be provided but ensuring parity in benefits with cadres working in the country.

Based on the above two principles, the Joint Ministry specifies the following specific points:

Chapter I. BENEFITS ABROAD

1. All individuals selected to study and train abroad, including interpreters, are supported with travel expenses, work expenses, uniforms, and necessary baggage fees according to the current regulations.

2. Scholarships and living expenses for trainees, overseas students, and research fellows in the Soviet Union, Eastern European countries, and North Korea remain unchanged as currently provided.

3. For trainees in China, implementing the recently signed agreement between the Government of the Democratic Republic of Vietnam and the Government of the People's Republic of China, the living expenses are now set as follows:

a) 35 yuan per month for workers, administrative staff, junior technical officers, newly graduated middle-level technical officers, and interpreters, including:

- Workers from Grade 5/8 downwards.

- Administrative staff from Grade 8/21 downwards.

- Technical officers from Grade 5/14 downwards.

- Interpreters from Grade 6/12 downwards.

b) 40 yuan for enterprise leaders, engineers, long-serving middle-level officers, and equivalent types of officers, including:

- Workers from Grade 6/8 upwards.

- Administrative staff from Grade 9/21 upwards.

- Technical officers from Grade 6/14 upwards.

- Interpreters from Grade 7/12 upwards.

In addition to the monthly living expenses set out above, depending on the climate, high cost of living, and the field of study (such as mines, metallurgy, shipping, dance, film production...), the Vietnamese Embassy in China will propose additional monthly allowances based on actual conditions for the Joint Ministry to decide.

The managing ministries will arrange and clearly announce the living expenses for each individual before going abroad. For current trainees in China, those receiving 65 yuan and 55 yuan per month will now receive 40 yuan; those receiving 45 yuan per month will now receive 35 yuan per month, and interpreters will receive 35 yuan per month.

Chapter II. RIGHTS AND BENEFITS INSIDE THE COUNTRY

1. Preparatory trainees, research students, and overseas students before going abroad who were previously in the establishment of state agencies or enterprises and had salary grades established in 1958 and child allowances (if applicable) shall enjoy the difference amount (if any) between the total basic salary and child allowance (if applicable) and living expenses or scholarships, including the following persons:

- Those whose biological parents have jobs and do not need to directly support them.

- Those who are unmarried or married but without children.

- Those who are married with children but currently reside in the South.

- Those who are married with children, but their children are already supported by the government (scholarships for schools in the South, vocational schools...).

- Those who are married even though they have children, but work at agencies or enterprises and their own salaries are ranked from grade 8 on the 21-grade scale or equivalent and higher (in this case, if child allowances were previously provided to the husband, they will now be transferred to the wife. Each child is 5 dong, starting from the third child onwards from the month after the husband leaves the country).

- Those who are married with children in rural or urban areas where both spouses have jobs and can ensure their livelihood without needing to directly support them.

The above difference amount will be paid monthly to the person authorized by siblings or deposited into the Bank until they return home, when the siblings will claim it.

2. Persons with families (biological parents, spouse, and children) who must directly support them before going abroad, now due to family difficulties (parents being old and weak, losing labor capacity, wives being sick, many children...), if the Trade Union proposes and the agency head decides, they will only pay a fixed amount monthly to the public fund, while the rest will be retained as monthly assistance for the family:

- Those receiving salaries from grade 1 to grade 6 on the 21-grade scale, or equivalent levels, will pay 18 dong per month into the public fund.

- Those receiving salaries from grade 7 to grade 10 on the 21-grade scale, or equivalent levels, will pay 24 dong per month into the public fund.

- Those receiving salaries from grade 11 on the 21-grade scale or higher, or equivalent levels, will pay 30 dong per month into the public fund.

Some cadres, employees, and workers who studied and trained abroad previously and are still outside the country also benefit from this system; if anyone has not been assigned a 1958 salary grade, the relevant ministries will temporarily determine a salary grade based on their position before leaving to implement this.

For military personnel transferring to civilian positions and sent abroad for study, if they remain within a six-month period, up to nine months, the difference amount or the amount to be paid into the public fund, which will be retained as monthly assistance for the family, will be calculated based on their rank salary (for officers) or living expenses (for non-commissioned officers) depending on the specific cases mentioned above. After six or nine months, the relevant ministries will temporarily assign a 1958 salary grade to implement this uniformly like others.

The Joint Department reminds ministries when deciding on beneficiaries due to family circumstances that the principle should be maintained that going abroad for study should not result in the average family income increasing excessively compared to surrounding cadres and even compared to the normal average family income of the cadre when they were at home. Only then can the relative treatment and unity between those working inside the country and those studying abroad be ensured.

3. For interpreters accompanying preparatory trainee groups, although their lives are closely linked to the trainees, they are not distinguished by whether they have families to directly support, the using ministries will base on the current salary level of the individuals against the salary grades specified in point 2 above to collect 18 dong, 24 dong, or 30 dong into the public fund, while the rest will be paid to the family of the individual or deposited into the Bank for them to claim upon returning home.

The above is the specific content of the system for cadres, employees, and workers within the establishment selected to go abroad for study and training. For those outside the establishment, they only enjoy the rights and benefits defined outside the country (Section I).

Ministries are responsible for implementing the system for preparatory trainees chosen and sent abroad by themselves and managed by them, and the Ministry of Education is responsible for implementing the system for research students and overseas students. The above expenses will be settled into the cadre training fund of the ministries.

This Circular takes effect from October 1, 1959.
