THE MINISTER OF HEALTH

Pursuant to Decree No. 49/2003/NĐ-CP dated May 15, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
Pursuant to the proposal of the Director of the Department of Personnel and Organization, the Director of the Treatment Department;

Article 1. Now hereby promulgates with this Decision the Regulations on the Organization and Operations of the National Mental Hospital Number One.

Article 2. This Decision takes effect from the date of signing and issuance. All previous regulations contrary to those stipulated in this Decision are abolished.

Article 3. The following officials are responsible for implementing this Decision: the Director of the Office, the Director of the Department of Personnel and Organization, the Director of the Treatment Department, the Directors of relevant Departments under the Ministry of Health, the Director of the National Mental Hospital Number One, and the Heads of related units.

 

 

CHARTER

ORGANIZATION AND OPERATIONS OF THE NATIONAL MENTAL HOSPITAL NUMBER ONE

Chapter 1.

GENERAL PROVISIONS

Article 1. The National Mental Hospital Number One is a public service unit directly under the Ministry of Health, established pursuant to Decision No. 519/QĐ-BYT dated June 7, 1963 of the Minister of Health and Decision No. 429/TTg dated October 28, 1976 of the Prime Minister, redefined according to Decree No. 49/2003/NĐ-CP dated May 15, 2003 of the Government, having legal personality, its own seal, separate bank account, located at Hoa Binh Commune, Thanh Xuan District, Ha Tay Province.

Article 2. Party and Mass Organizations within the hospital:

a. The Communist Party of Vietnam organization within the hospital leads the hospital's activities according to its functions, tasks, directives, and resolutions of the Party and state laws.

b. Political and social organizations, occupational associations within the hospital are established and operate in accordance with the law, and are responsible for coordinating with the administration to fulfill the hospital's political tasks and perform the functions and tasks of mass organizations as determined.

Chapter 2.

FUNCTIONS, TASKS, AND LIMITS OF THE HOSPITAL

Article 3. The National Mental Hospital Number One has the function:

a. To provide medical examination, treatment, prevention, and rehabilitation services for mental patients at the highest level;

b. To be a training base for mental health professionals and to lead the lower levels.

c. To conduct scientific research, apply modern science and technology at par with regional and international standards to serve the health of the people.

Article 4. The hospital has the following tasks:

I. DIRECTLY PROVIDE MEDICAL EXAMINATION, TREATMENT, PREVENTION, AND REHABILITATION SERVICES FOR MENTAL PATIENTS IN PROVINCES AND CITIES FROM HUE NORTHWARDS AT THE HIGHEST LEVEL;

a. Directly provide medical examination, emergency care, and treatment for mental patients at the provincial and city level and equivalent areas assigned, compulsory and voluntary mental patients.

b. Conduct medical examinations and mental health assessments, participate in forensic mental health assessments when requested by legal authorities.

c. Provide emergency care, treatment for general and specialized diseases for residents in the area according to requirements and within the hospital's capacity.

d. Fulfill other tasks as directed and assigned by the Ministry of Health.

II. TRAINING OF STAFF

a. Serve as the main practical training center for mental health specialties for universities, colleges, and secondary health schools.

b. Participate in training health staff at postgraduate, undergraduate, and secondary levels.

c. Retrain and upgrade the qualifications of staff within the hospital and in the specialized network system.

d. Accept foreign trainees to study and research at the hospital.

III. SCIENTIFIC RESEARCH:

a. Conduct and participate in scientific research in the field of mental health to support medical examination, treatment, prevention, rehabilitation, and training.

b. Lead and participate in scientific research projects at various levels.

c. Organize national and international scientific conferences as prescribed.

d. Organize joint scientific research programs domestically and internationally.

IV. LEADERSHIP OF LOWER LEVELS IN SPECIALIZED TECHNICAL AREAS:

a. Serve as an advisory body to assist the Minister of Health in organizing the specialized mental health network system and developing strategies for mental health development nationwide.

b. Directly lead specialized technical areas for provinces from Hue northwards.

c. Transfer and support specialized technical methods to lower levels.

d. Monitor and supervise specialized activities of lower levels in the assigned region.

e. Implement and organize health programs and projects.

f. Coordinate with internal and external health agencies to implement mental health education and prevention programs in the community.

g. Participate in disaster relief and mitigation efforts.

V. INTERNATIONAL COOPERATION:

a. Develop international cooperation plans mainly in the fields of staff training, new technology and technique reception, financial and working equipment support for the hospital from foreign organizations and individuals in accordance with the law.

b. Develop outbound and inbound delegation plans according to the international cooperation program with the hospital; send staff and students to study, research, and work abroad; accept foreign lecturers, students to study, exchange experiences, and learn at the hospital; manage outbound and inbound delegations within the hospital's scope of operation as prescribed by the Ministry of Health.

c. Organize international conferences, seminars, and courses in fields managed by the hospital according to the regulations on organizing and managing international conferences and seminars in Vietnam issued by the Prime Minister. The hospital complies with legal provisions when signing international cooperation agreements.

VI. HOSPITAL MANAGEMENT:

a. Manage and utilize hospital resources effectively: human resources, finance, infrastructure, and equipment.

b. Strictly implement state regulations on hospital budget revenue and expenditure, gradually improve accounting revenue collection according to new state regulations.

c. Generate additional hospital funds from healthcare services: hospital fees, health insurance, domestic and international investment projects.

Article 5. The hospital has autonomy within the scope of its functions, tasks, and authorities assigned according to the分级制度由卫生部规定，对卫生部负责，并对其活动承担法律责任。

Article 6. The target population served by the hospital:

a. Patients with Mental Disorders referred from the previous level

b. Patients with Mental Disorders or other specialized departments with specific needs.

c. Foreign patients

d. Individuals coming for study, scientific research, forensic psychiatric examination requests...

Chapter 3.

ORGANIZATION AND STAFF OF THE HOSPITAL

Article 7. The number of beds is adjusted based on actual demand.

Article 8. Hospital leadership includes the Director and Deputy Directors.

a. The Director and Deputy Directors of the hospital are appointed by the Minister of Health, and their appointment and dismissal procedures follow the regulations of the Ministry of Health.

b. The Director of the hospital is responsible before the Minister and the law for all activities of the hospital.

c. Deputy Directors assist the Director with assigned tasks and are accountable to the Director for the work they are given.

Article 9. Councils within the hospital:

a. The hospital is permitted to establish councils to serve political tasks according to state regulations, rules, and laws.

- Scientific and Technological Council of the hospital

- Drug and Treatment Council

- Other councils established based on actual needs.

b. The operation of these councils follows current regulations.

Other Departments and Offices: Will be established by the Minister of Health upon request of the hospital director when there is a need.

Article 11. Hospital staff are recruited and appointed to positions based on the hospital's requirements according to state regulations. The number of positions is supplemented and adjusted annually based on actual needs and the capacity of the Ministry of Health.

Article 12. Hospital staff must meet the qualifications specified for their positions, complete assigned tasks, respect patients, protect the legitimate rights and interests of patients, and participate in hospital activities; they must continuously study and improve their moral qualities and professional skills. Staff have the right to ensure conditions for professional activities, be assigned to work according to their abilities and specialties, choose treatment methods, receive training to enhance their professional skills, take examinations to advance in rank when qualified, and enjoy benefits stipulated by law; they are protected by law when performing their duties and responsibilities. If qualified, medical personnel may be awarded titles and honors according to legal provisions.

Article 13. Hospital staff have the right to ensure conditions for professional activities, be assigned to work according to their abilities and specialties, choose treatment methods, receive training to enhance their professional skills, take examinations to advance in rank when qualified, and enjoy benefits stipulated by law; they are protected by law when performing their duties and responsibilities. If qualified, medical personnel may be awarded titles and honors according to legal provisions.

Chapter 4.

FINANCE AND ASSETS OF THE HOSPITAL

Article 14.

a. The hospital is a second-level budget unit, receiving operational funds according to health service institutions, managing finances independently, and having its own account. The hospital is responsible for managing and using assets and financial resources effectively, complying with state regulations on finance and accounting.

b. Any change in financial management mechanisms must be approved by the Ministry of Health and comply with state and legal provisions.

Article 15. Sources of income for the hospital include:

a. State budget allocation

b. Income from health insurance and service fees for medical examinations and treatments.

c. Revenue from scientific and technical services, training of cadres, experimental production, cooperation, and other service activities as prescribed by law.

d. Donations, grants, support, gifts from organizations and individuals both domestically and internationally, and other sources of income permitted by the state.

e. Other income (if any) as prescribed by law.

Article 16. Expenditures of the hospital include:

a. Professional and business activities

b. Salaries and allowances, social insurance...

c. Regular expenses

d. Expenses for commendation and awards

e. Construction, procurement, and repair of medical equipment

f. Training and scientific research expenses

g. Other expenses as prescribed by law.

Article 17. Management of assets, equipment, and basic construction:

a. Conduct annual asset inventory as prescribed. Assets, equipment, and investment funds from any source must be managed and used in accordance with financial and asset management regulations.

b. Depreciation of fixed assets is recorded and accounted for according to prescribed regulations.

c. Monitor asset surplus, shortage, damage, and dispose or reallocate them according to state regulations. Develop regular maintenance and warranty plans.

d. Investment, procurement of equipment, and basic construction funds must be planned as projects and comply with state regulations.

Article 18. Management of financial revenues and expenditures:

a. Annually, the hospital must prepare revenue and expenditure budgets and monitor each source of funding to make timely adjustments.

b. Quarterly and annual settlements with the Ministry of Health as prescribed.

c. Maintain reserve funds as prescribed.

d. Monthly statements and analysis of revenue and expenditure situations.

e. Financial transparency as prescribed.

Chapter 5.

RELATIONSHIPS WITH OTHER HEALTH AND NON-HEALTH AGENCIES

Article 19. The hospital is under comprehensive management by the Ministry of Health and is solely responsible for its operations.

Article 20. The Hospital is an advisory body assisting the Minister in directing the national network system of Mental Health specialty.

The Hospital is the highest direct authority in charge of professional technical matters for mental health hospitals and treatment facilities located in provinces from Hue and beyond.

The Hospital collaborates with agencies, units, and individuals both within and outside the healthcare sector, from central to local levels, to fulfill assigned functions and tasks. The Hospital has the responsibility to create favorable conditions for medical teachers and students from healthcare training institutions to work and study.

Article 21. The Hospital collaborates with foreign organizations and individuals in the field of professional technical matters as defined in its functions and tasks and must comply with state regulations and laws.

Article 22. The Hospital is subject to territorial management by the People's Committee of Ha Tay Province according to the law and has the responsibility to proactively coordinate with local authorities and social organizations to effectively implement strategies for caring for and protecting public health.

Chapter 6.

INSPECTION AND SUPERVISION

The hospital is subject to inspection, audit, and supervision by the Ministry of Health and other competent state agencies.

Chapter 7.

REWARD AND DISCIPLINE

Article 24. Collectives and individuals within the hospital who implement this Charter well and make significant contributions to the hospital will be rewarded according to state regulations.

Article 25. Organizations and individuals who violate the provisions of this Charter shall be subject to disciplinary action, administrative penalties, or criminal prosecution depending on the nature and severity of their actions, and if damage is caused, they must compensate according to the law.

Chapter 8.

FINAL PROVISIONS

Article 26. This Charter consists of 8 chapters and 26 Articles.

During the implementation of this Charter, the Hospital Director may propose to the Minister of Health for review and amendment to suit the actual situation./.
