Pursuant to Decree No. 49/2003/NĐ-CP dated May 15, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
Pursuant to the proposal of the Director of the Personnel Department, the Director of the Treatment Department;

Article 1. Now hereby promulgates with this Decision the Regulations on the Organization and Operations of the Second Central Psychiatric Hospital.

Article 2. This Decision takes effect from the date of signing and issuance. All previous regulations contrary to the provisions of this Decision are abolished.

Article 3. The following officials are responsible for implementing this Decision: the Director of the Office, the Director of the Personnel Department, the Director of the Treatment Department, the Directors of relevant Departments under the Ministry of Health, the Director of the Second Central Psychiatric Hospital, and the Heads of related units.

 

 

CHARTER

ORGANIZATION AND OPERATIONS OF THE SECOND CENTRAL PSYCHIATRIC HOSPITAL
(Issued together with Decision No. 4606/QĐ-BYT dated December 23, 2004 of the Minister of Health)

Chapter 1.

GENERAL PROVISIONS

Article 1. The Second Central Psychiatric Hospital is a public service unit directly under the Ministry of Health, established in 1914 and redefined according to Decree No. 49/2003/NĐ-CP dated May 15, 2003 of the Government, having legal personality, its own seal, separate bank accounts, and located at Tan Phong Ward, Bien Hoa City, Dong Nai Province.

Article 2. Party and Mass Organizations within the hospital:

a. The Communist Party organization within the hospital leads the hospital's activities according to its functions, tasks, directives, and resolutions of the Party and state laws.

b. Political and social organizations, occupational associations within the hospital are established and operate in accordance with the law, and are responsible for coordinating with the administration to fulfill the hospital's political tasks and perform the functions and tasks of mass organizations as determined.

Chapter 2.

FUNCTIONS, TASKS, AND LIMITS OF THE HOSPITAL

Article 3. The Second Central Psychiatric Hospital has the following functions:

a. To examine, treat, prevent, and rehabilitate mental patients in the southern region at the highest level;

b. To be a training base for mental health professionals and to provide guidance to lower levels.

c. To conduct scientific research, apply modern science, technology, and techniques at par with regional and international standards to serve the health needs of the people.

Article 4. The hospital has the following tasks:

I. EXAMINATION, TREATMENT, PREVENTION, AND REHABILITATION FOR PATIENTS FROM PROVINCES AND CITIES SOUTH OF DANANG AT THE HIGHEST LEVEL:

a. Directly examine, provide emergency care, and treat mental patients referred from provincial and city levels and equivalent facilities in the assigned area, including compulsory and voluntary patients.

b. Examine and assess mental health, participate in forensic psychiatric assessments upon request of legal authorities.

c. Examine, provide emergency care, and treat general and specialized diseases for residents in the region as required and within the hospital's capacity.

d. Perform other tasks as directed and assigned by the Ministry of Health.

II. TRAINING STAFF

a. Serve as a practical training site for mental health specialties for universities and secondary schools.

b. Participate in training mental health professionals at postgraduate, undergraduate, and secondary levels.

c. Retrain and upgrade the skills of staff within the hospital and in the network system.

d. Accept foreign trainees for study and research at the hospital.

III. SCIENTIFIC RESEARCH:

a. Conduct and participate in scientific research in the field of psychiatry to support examination, treatment, prevention, rehabilitation, and training.

b. Lead and participate in scientific research projects at various levels.

c. Organize domestic and international scientific conferences as prescribed.

d. Organize joint research programs domestically and internationally.

IV. TECHNICAL GUIDANCE TO LOWER LEVELS:

a. Directly provide technical guidance to provinces south of Danang.

b. Transfer and support technical methods to lower levels.

c. Advise, monitor, and supervise the activities of lower levels in the assigned area.

d. Implement health programs and projects approved by competent authorities.

e. Coordinate with health and non-health agencies to implement mental health education and mental illness prevention campaigns in the community.

V. INTERNATIONAL COOPERATION:

a. Develop international cooperation plans mainly in the areas of staff training, new technology adoption, financial and equipment support for the hospital from foreign organizations and individuals in accordance with the law.

b. Develop plans for outbound and inbound delegations under the international cooperation program with the hospital; send staff and students to study, research, and work abroad; accept foreign lecturers, students to study, exchange experiences, and learn at the hospital; manage outbound and inbound delegations within the hospital's scope of operation as stipulated by the Ministry of Health.

c. Organize international conferences, seminars, and courses in fields managed by the hospital according to the Prime Minister's regulations on organizing and managing international conferences and seminars in Vietnam. The hospital complies with legal provisions when signing international cooperation agreements.

VI. HOSPITAL MANAGEMENT:

a. Manage and utilize hospital resources effectively: human resources, finance, infrastructure, and equipment.

b. Strictly implement state regulations on hospital budget revenue and expenditure, gradually improve accounting revenue in accordance with new state regulations.

c. Generate additional funding for the hospital from healthcare services: hospital fees, health insurance, domestic and international investment projects.

Article 5. The hospital has autonomy within the scope of its assigned functions, tasks, and limits as delegated by the Ministry of Health, and is responsible to the Ministry of Health and the law for its operations.

Article 6. Service recipients of the hospital:

a. Mental patients referred from lower levels

b. Mental patients or those requiring specialized care

c. Foreign patients

d. Subjects coming for study, research areas in scientific studies, forensic psychiatric examination...

Chapter 3.

||| STAFF AND ORGANIZATION OF THE HOSPITAL

Article 7. The number of hospital beds is adjusted according to actual needs.

Article 8. Hospital leadership includes the Director and Deputy Directors.

a. The Director and Deputy Directors of the hospital are appointed and relieved of their positions by the Minister of Health in accordance with the procedures and regulations of the Ministry of Health.

b. The Director of the hospital is responsible to the Minister and the law for all activities of the hospital.

c. Deputy Directors assist the Director with assigned tasks and are accountable to the Director for the work delegated to them.

Article 9. Councils within the hospital:

a. The hospital is permitted to establish councils to serve political tasks in accordance with state regulations, rules, and laws.

- Scientific and Technological Council of the hospital

- Medicine and Treatment Council

- Other councils established based on actual needs.

b. The operations of these councils are carried out in accordance with current regulations.

Other Departments and Offices: Will be decided by the Minister of Health to establish when there is a need based on the proposal of the hospital director.

Article 11. Hospital staff are recruited and appointed to ranks based on the hospital's mission requirements according to state regulations. The number of personnel positions is supplemented and adjusted annually based on actual needs and the capacity of the Ministry of Health.

Article 12. Hospital staff must meet the rank standards set forth by the state, complete assigned tasks, respect patients, protect the legitimate rights and interests of patients, and have a responsibility to participate in hospital activities; they must continuously study and improve their moral qualities and professional skills; and be protected by law when performing their duties and responsibilities. If they meet the conditions and criteria, medical personnel may be awarded titles and rewards as stipulated by law.

Article 13. Hospital staff have the right to ensure conditions for professional activities, to be arranged to work in their specialty according to their ability and expertise, to choose treatment methods for patients, to receive training to enhance their professional knowledge and skills, to take examinations to advance their rank when qualified, and to enjoy benefits as prescribed by law; they are protected by law when performing their duties and responsibilities. If they meet the conditions and criteria, medical personnel may be awarded titles and rewards as stipulated by law.

Chapter 4.

FINANCE AND ASSETS OF THE HOSPITAL

Article 14.

a. The hospital is a level 2 budget unit, receiving operational funds according to the regulations for public health institutions, managing finances independently, and having its own account. The hospital has the responsibility to manage and use assets and financial resources effectively, and to comply with state regulations on finance and accounting.

b. When changing the financial management mechanism, it must be approved by the Ministry of Health and implemented in accordance with state and legal provisions.

Article 15. Sources of income for the hospital include:

a. State budget allocation

b. Income from health insurance and service fees for medical examinations and treatments.

c. Income from scientific and technical services, training of cadres, experimental production, cooperation, and other service activities as prescribed by law.

d. Donations, grants, support, gifts from organizations and individuals both domestically and internationally, and other sources of income permitted by the state.

e. Other income (if any) as prescribed by law.

Article 16. Expenditures of the hospital include:

a. Professional and vocational activities

b. Salaries and allowances, social insurance...

c. Regular expenses

d. Expenses for commendation and awards

e. Construction, procurement, and repair of medical equipment

f. Training and scientific research expenses

g. Other expenses as prescribed by law.

Article 17. MANAGEMENT OF ASSETS, EQUIPMENT, AND BASIC CONSTRUCTION:

a. Conduct annual asset inventory as prescribed. Assets, equipment, and investment funds from any source must be managed and used in accordance with financial and asset management regulations.

b. Implement depreciation of fixed assets as prescribed. Depreciation and liquidation proceeds are recorded and accounted for according to prescribed regulations.

c. Monitor asset surplus, shortage, and damage to dispose of or reallocate according to state regulations. Develop regular maintenance and warranty plans.

d. Investment funds, procurement of equipment, and basic construction projects must be developed into proposals and comply with state regulations.

Article 18. MANAGEMENT OF FINANCIAL INCOME AND EXPENSES:

a. Annually, the hospital must prepare a budget for income and expenses, tracking each source of funding to make timely and reasonable adjustments.

b. Settle accounts quarterly and annually with the Ministry of Health as prescribed.

c. Implement reserve fund management as prescribed.

d. Provide monthly explanations and analyses of income and expenditure situations.

e. Publicize financial information as prescribed.

Chapter 5.

RELATIONSHIPS WITH OTHER AGENCIES AND UNITS INSIDE AND OUTSIDE THE HEALTH SECTOR

Article 19. The hospital is under comprehensive management by the Ministry of Health and is solely responsible for its own operations.

Article 20. The hospital is the highest direct authority for professional and technical guidance in the specialized field for mental health hospitals and facilities in provinces from Da Nang southward.

The hospital cooperates with agencies, units, and individuals both within and outside the healthcare sector, from central to local levels, to carry out assigned functions and tasks. The hospital has the responsibility to create favorable conditions for teachers and students of health training institutions to work and study.

Article 21. The hospital collaborates with foreign organizations and individuals in the technical fields specified in its functions and tasks and must comply strictly with state regulations and laws.

Article 22. The hospital is subject to territorial management by the People's Committee of Dong Nai Province in accordance with the law and has the responsibility to proactively coordinate with local authorities and social organizations to effectively implement the strategy for caring for and protecting people's health.

Chapter 6.

INSPECTION AND SUPERVISION

Article 23.

The hospital organizes self-inspection and supervision according to分级授权和国家法律的规定。

The hospital is subject to inspection, audit, and supervision by the Ministry of Health and other competent state agencies.

Chapter 7.

REWARD AND DISCIPLINE

Article 24. Collectives and individuals within the hospital who perform this Charter well and make significant contributions to the hospital will be rewarded in accordance with state regulations.

Article 25. Organizations and individuals who violate the provisions of this Charter shall be disciplined, administratively sanctioned, or criminally prosecuted depending on the nature and severity of their actions, and if damage is caused, they must compensate according to the law.

Chapter 8.

FINAL PROVISIONS

Article 26. This Charter consists of 8 chapters and 26 Articles.

During the implementation of this Charter, the Hospital Director may propose to the Minister of Health for review and amendment to suit practical circumstances./.
