PRIME MINISTER
Pursuant to the Government Organization Law dated September 30, 1992;
At the proposal of the Minister, Chairman of the State Planning Committee, the Minister of Construction, and the Minister of Finance,
DECISION:
Article 1. Projects completed in 1993 and 1994 shall not be reviewed again for the total budget estimate but only recorded for payment of the volume of work already carried out, and shall be funded according to the approved unit project budget estimates, in accordance with the quantity consistent with the design, confirmed by the price certificate of the basic bank.
For ongoing projects that will be completed in 1994 and 1995, if construction has been extended over many years and started before 1992 but did not meet the conditions to prepare a total budget estimate, they shall only be reviewed for the construction cost estimate from 1994 until completion for management purposes and must be reviewed for economic and technical justification (if exceeding the budget as prescribed).
Article 2. For special large-scale projects (with a total investment of 100 billion VND, equivalent to 10 million USD or more) in certain sectors such as water resources, transportation, etc., which are under construction and have been underway for many years, the economic and technical justification already approved in stages according to investment targets (as stipulated in the economic and technical justification) shall serve as the basis for approving the design and budget estimate for construction, recording plans, and funding payments.
Small projects (with a total investment of less than one billion VND), although only requiring a brief economic and technical report, a concise explanation about the scale and requirements for approval of the policy, and the application of standard designs, still must be reviewed for the construction and installation budget estimate due to differences in foundation and construction material prices between locations.
Article 3. New projects initiated in 1994 must necessarily have complete economic and technical justification files, design files, and approved total budget estimates. If these projects have been allocated funds in the 1994 plan but have not yet met the above conditions, but there is an urgent need for investment, relevant ministries and localities may register some funds to conduct survey and design work and prepare the total budget estimate for construction to start in 1995.
Important ongoing projects of ministries and localities assigned plans according to Decision No. 62-TTg dated February 8, 1994, must still comply with the procedures as prescribed. In cases where necessary procedures have not been supplemented in time but urgent needs require continued construction in 1994, permission must be sought.
Article 4. For other projects registered in the 1994 plan of ministries and localities, by July 30, 1994, if they have supplemented all necessary procedures or submitted documentation to the state appraisal agency, the State Planning Committee will announce the final agreement on the plan in August 1994. Projects that have not completed their procedures are considered not included in the 1994 construction plan, and ministries and localities must continue to complete all procedures as the basis for recording the 1995 plan. These projects, if required, may be recorded for some funds for survey, design, and preparation of the total budget estimate for construction.
