Article 1. Approve the "Comprehensive Program on Basic Survey and Management of Marine Resources and Environment until 2010, with a vision to 2020" with the main contents as follows:
Part I
GUIDING PRINCIPLES AND OBJECTIVES OF THE PROGRAM
I. GUIDING PRINCIPLES
1. The work of basic survey and management of marine resources and environment shall be carried out to clarify the geographical and political position of Vietnam's maritime zone and clearly identify natural resources in the marine area.
2. The work of basic survey and management of marine resources and environment must precede one step to ensure scientific and practical foundations for formulating policies for sustainable development, ensuring national defense and security in the maritime zone.
3. The work of basic survey and management of marine resources and environment must be conducted based on a unified system of state policies and laws, with continuity and direct comprehensive guidance from the Government and People's Committees of coastal localities. In the work of basic survey and management of marine resources and environment, advanced science and technology, traditional technology, and contributions from scientists in professional associations and coastal communities should be effectively applied to accurately determine priority tasks, pilot models, and coordinate guidance to create necessary conditions to complete the program's goals, timeframes, quality, and effectiveness.
4. It is necessary to take advantage of investment capital from all economic sectors, while expanding and diversifying international relations but with focused choices to attract investment from countries and international organizations, enhance the capacity of cadres, adopt modern technology, contribute to enhancing the country's reputation and position, strengthen trust and cooperation among nations in the South China Sea.
II. OBJECTIVES
1. General Objective
Strengthen the work of basic survey of natural conditions, natural resources, and the environment in the country's maritime zone; establish scientific grounds and legal bases to strengthen state management, fully utilize the potential and advantages of the sea and coastal areas; implement the task of sustainable development of the maritime, coastal, and island regions, enhance national defense and security, ensure national sovereignty, and gradually and firmly make the country a strong maritime nation.
Develop policies, improve the legal system and organizational structure, enhance the level of management, cadre qualifications, and technical infrastructure for the work of basic survey and management of marine resources and environment to reach a moderate level in Southeast Asia by 2020.
2. Specific objectives
a) Period 2006 - 2010
- Establish and improve the basic policy and legal framework to ensure human resources and investment capital, complete the basic database and data management mechanism for basic survey and management of marine resources and environment;
- Directly address urgent tasks to ensure national sovereignty, national defense, and security, and serve the practical needs of socio-economic development in the coastal maritime region;
- Build material and technical infrastructure, improve the state management machinery for marine resources and environment to be synchronized, effective, with coordinated collaboration and specific division of responsibilities to fulfill state management tasks at sea;
- Develop priority content, pilot models, and regular tasks clearly defined in the List of Tasks to Implement the "Comprehensive Program on Basic Survey and Management of Marine Resources and Environment until 2010, with a vision to 2020" issued with this Decision; organize a coordinated action program between ministries, sectors, and coastal localities to implement the Program.
b) Period 2011 - 2020
- Complete the legal basis for basic survey and management of marine resources and environment;
- Complete the database on marine resources and environment of Vietnam, ensuring systematicity, synchronization, modernization, and high reliability.
- Improve material and technical infrastructure, organizational systems, management, and cadre qualifications to reach a moderate level in Southeast Asia.
Part II
SCOPE AND CONTENT OF THE PROGRAM
I. SCOPE OF THE PROGRAM
The Program will be implemented until 2020 in the maritime zones of the country, prioritizing immediate targets to be realized from 2006 to 2010.
II. TASKS OF THE PROGRAM
1. The tasks of the Program are divided into groups, including:
a) Marine resource and environmental management policies;
b) Basic survey of natural conditions and marine resources and environment;
c) Protection of marine resources and environment;
d) Training of human resources and enhancement of material and technical infrastructure to serve the tasks of basic survey and management of marine resources and environment;
e) International cooperation in basic survey and management of marine resources and environment.
2. The list of tasks, lead agencies, coordinating agencies, estimated budget, implementation time, and priority order within the period 2006 - 2010 for each project is recorded in the List of Tasks of the "Comprehensive Program on Basic Survey and Management of Marine Resources and Environment until 2010, with a vision to 2020," issued with this Decision.
3. The total estimated budget for implementing the "Comprehensive Program on Basic Survey and Management of Marine Resources and Environment until 2010, with a vision to 2020" is 2,916 billion VND. The implementation budget will be determined specifically based on the approval of feasible projects of the Program according to the law.
Part III
MAJOR SOLUTIONS TO IMPLEMENT THE PROGRAM
1. Enhance awareness about the marine economy and marine resources and environment; improve regulatory legal documents on basic survey and management of marine resources and environment, mobilize experts from various ministries, sectors, and research institutes to develop detailed plans in accordance with schedules, and implement the Program.
2. Strengthen the organizational structure of state management bodies for marine resources and environment; review the division of basic survey tasks among ministries, sectors, and coastal localities; enhance the role and position of local authorities in managing coastal areas.
3. Diversify forms of cooperation with developed countries in the field of marine resources and environment to receive technology transfers, while organizing retraining, new training, and forming a team of experts, particularly leading scientists and high-level state managers on marine resources and environment.
4. Ensure financial resources for implementing the Project from the state budget, while mobilizing ODA funds, funds from international cooperation programs, revenue from environmental fees, and other contributions from organizations and individuals both within and outside the country across all economic sectors...
5. Ensure inspection, audit, supervision, and periodic evaluation of the degree of completion of objectives and tasks of the Project.
Article 2. Implementation
1. Establish a National Steering Committee for Basic Survey of Marine Resources and Environment headed by a Deputy Prime Minister, Chairman of the National Steering Committee for the East Sea and Islands, directly serving as the Chairman; the Minister of Natural Resources and Environment serves as the Vice Chairman in charge of day-to-day operations.
Other members of the Steering Committee include representatives from the leadership of the Ministries of Planning and Investment, Finance, Government Office, Central Economic Commission, and related ministries and sectors, as well as leaders of People's Committees of some coastal provinces and cities.
The Office of the National Steering Committee for Basic Survey of Marine Resources and Environment shall be located at the Ministry of Natural Resources and Environment.
2. The Minister of Natural Resources and Environment assists the Deputy Prime Minister, Chairman of the National Steering Committee for Basic Survey of Marine Resources and Environment, in performing the following tasks:
a) Take the lead and coordinate with Ministers of the Ministries of Planning and Investment, Finance, and related ministries, and Chairmen of People's Committees of coastal provinces and cities to implement the "Comprehensive Program on Basic Survey and Management of Marine Resources and Environment until 2010, with a vision to 2020" approved by the Prime Minister;
b) Submit to the Prime Minister for approval the functions, tasks, and membership of the National Steering Committee for Basic Survey of Marine Resources and Environment;
c) Take the lead and coordinate with the Ministry of Finance and relevant agencies to develop and implement financial regulations for the use of Project funds to ensure strict and effective management;
d) Approve the organizational structure and operational regulations of the Office of the National Steering Committee for Basic Survey of Marine Resources and Environment;
đ) Organize the implementation of projects assigned in this Decision;
e) Timely report to the Prime Minister on new issues arising beyond the authority of the Ministry; propose changes in the lead agency for the project when it fails to meet the objectives and schedule.
3. The Ministers of Planning and Investment, and Finance perform the following tasks:
a) Review projects under the Program in accordance with the provisions of the law;
b) Balance and allocate funds to implement the Program.
4. Ministers, Heads of equivalent ministries, Heads of government agencies, and Chairmen of People's Committees of coastal provinces and centrally-administered municipalities organize the implementation of projects assigned in this Decision.
This Decision shall take effect fifteen days from the date of publication in the Official Gazette.
The Ministers, Heads of ministerial-level agencies, Heads of government agencies, and Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decision./.
