Announcing the port waters area belonging to An Giang province and the management area of An Giang Maritime Port Office

MINISTER OF TRANSPORT

Pursuant to the Maritime Code of Vietnam dated June 14, 2005;
Pursuant to Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to Decree No. 71/2006/NĐ-CP dated July 25, 2006 of the Government on port management and maritime shipping channels;
Based on the opinion of the People's Committee of An Giang Province at Circular No. 3382/UBND-KT dated October 23, 2006;
At the proposal of the Director of the Legal Department and the Director of the Vietnam Maritime Administration,

DECISION:

Article 1.

1. Now announcing the port waters area belonging to An Giang province, including:

a) The waters before My Thoi Bridge;

b) The waters of the port channel, branch port channel, pilot reception zone, quarantine zone, anchorage area, transshipment area, and storm shelter area within the port as specified in point a, clause 1 of this Decision.

2. Other waters before bridge, wharf, anchorage area, transshipment area, and storm shelter area shall be announced in accordance with the provisions of the law.

Article 2. The extent of the port waters area belonging to An Giang province is measured according to the highest tidal level and is limited by a straight line across the Hau River 500 meters upstream from the edge of My Thoi Bridge, running along the riverbank and the outer boundary of the national inland waterway channel to another straight line across the Hau River 500 meters downstream from the edge of My Thoi Bridge.

Article 3.

The pilot reception zone, quarantine zone, anchorage area, transshipment area, and storm shelter for vessels entering and leaving the port waters area belonging to An Giang province are specified as follows:

1. Pilot reception zone and quarantine zone: these are the pilot reception zone and quarantine zone as stipulated in the Decision of the Minister of Transport announcing the port waters area belonging to Can Tho city and Vinh Long province and the management area of Can Tho Maritime Port Office.

2. Anchorage area, transshipment area, and storm shelter:

a) Anchorage area and transshipment area:

- Wharf MT01: for vessels with up to 10,000 DWT anchored by mooring buoys R1 and R2 with the following coordinates:

R1: 10°20’21” N, 105°29’04” E;

R2: 10°20’25” N, 105°28’59” E.

- Wharf MT02: for vessels with up to 10,000 DWT anchored by mooring buoys R2 mentioned above and R3. R3 has the following coordinates:

R3: 10°20’30” N, 105°28’54” E.

- Wharf MT03: for vessels with up to 7,000 DWT anchored by mooring buoys R3 mentioned above and R4. R4 has the following coordinates:

R4: 10°20’35” N, 105°28’48” E.

- Wharf MT04: for vessels with up to 5,000 DWT anchored by mooring buoys R5 and R6 with the following coordinates:

R5: 10°20’27” N, 105°28’37” E;

R6: 10°20’31” N, 105°29’04” E.

- Wharf MT05: for vessels with up to 5,000 DWT anchored by mooring buoys R6 mentioned above and R7. R7 has the following coordinates:

R7: 10°20’35” N, 105°28’33” E.

b) Upper and lower anchorage areas of My Thoi Bridge: at positions with the following coordinates:

A1: 10°19’43” N, 105°29’43” E;

A2: 10°19’49” N, 105°29’37” E;

A3: 10°20’52” N, 105°28’32” E;

A4: 10°20’59” N, 105°28’27” E;

A5: 10°21’05” N, 105°28’22” E;

A6: 10°21’12” N, 105°28’17” E.

c) Other anchorage areas, transshipment areas, and storm shelters as decided by the Minister of Transport based on the proposal of the Director General of Vietnam Maritime Administration.

d) For vessels entering and leaving the port waters area belonging to An Giang province but must anchor and take shelter in the port waters area belonging to Can Tho city, the Director of Can Tho Maritime Port Office will designate the position according to the Decision of the Minister of Transport announcing the port waters area belonging to Can Tho city, Vinh Long province, and the management area of Can Tho Maritime Port Office.

Article 4.

1. An Giang Maritime Port Office is responsible for:

a) Implementing the tasks and powers as prescribed by the Vietnam Maritime Code and related laws concerning maritime activities in the port waters area belonging to An Giang province.

b) Based on actual conditions regarding weather, waves, draft, and vessel tonnage, designate specific positions for vessels to anchor, transship, and take shelter in the waters specified in points a, b, and c of Clause 2, Article 3 of this Decision, ensuring maritime safety, maritime security, and environmental protection.

2. Responsibilities for coordinated management between An Giang Maritime Port Office and Can Tho Maritime Port Office for vessels entering and leaving the port waters area belonging to An Giang province:

a) An Giang Maritime Port Office is responsible for:

- Notifying Can Tho Maritime Port Office of the name, nationality, main technical specifications, and necessary information of vessels entering and leaving the port waters area belonging to An Giang province, at least two hours before the vessels reach the port waters area belonging to Can Tho city.

- Notifying Can Tho Maritime Port Office that vessels entering the port waters area belonging to An Giang province but must anchor and take shelter in the port waters area belonging to Can Tho city, at least two hours before the vessels reach the port waters area belonging to Can Tho city.

- Processing procedures for vessels entering and leaving the port waters area belonging to An Giang province.

b) Can Tho Maritime Port Office is responsible for designating specific positions for vessels to receive pilots, undergo quarantine, anchor, and take shelter based on actual conditions regarding weather, waves, draft, and vessel tonnage entering and leaving the port waters area belonging to An Giang province; notify An Giang Maritime Port Office within one hour from receiving notification from An Giang Maritime Port Office.

Article 5.

1. This Decision takes effect fifteen days after its publication in the Official Gazette.

2. Abolishing Decision No. 1401/QĐ-PCVT dated July 12, 1993 of the Minister of Transport on the port waters area of My Thoi and the responsibility area of My Thoi Port Office, and any previous regulations contrary to this Decision.

Article 6. The Head of the Ministry’s Office, the Inspector General of the Ministry, Heads of Departments under the Ministry, Directors of the Vietnam Maritime Administration, Directors of the Vietnam Inland Waterways Administration, Directors of the Department of Transport of An Giang Province, Directors of the Department of Transport and Public Works of Can Tho City, Directors of An Giang Maritime Port Office, Directors of Can Tho Maritime Port Office, Heads of relevant agencies, organizations, and individuals are responsible for implementing this Decision./.
