Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, duties, authorities, and organizational structure of ministries and ministerial-level agencies;
BASED ON THE GOVERNMENT DECREE NO. 187/2007/NĐ-CP OF DECEMBER 25, 2007 ON THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS;
At the proposal of the Director of the Cadre and Civil Servant Organization Department and the Head of the Ministry's Representative Office in Da Nang City,
DECISION:
Article 1. Position and Functions
The Ministry's Representative Office in Da Nang City (hereinafter referred to as the Representative Office) is an entity assisting the Minister in overseeing and summarizing the situation of activities within the scope of the Ministry of Information and Communications' administrative management in the assigned provinces and centrally governed cities including: Quang Binh, Quang Tri, Thua Thien-Hue, Da Nang, Quang Nam, Quang Ngai, Binh Dinh, Phu Yen, Khanh Hoa, Lam Dong, Gia Lai, Kon Tum, Dak Lak, and Dak Nong (collectively referred to as the Central Highlands-Western Highlands region); serving activities according to the program of work of the Ministry in the assigned area.
The Ministry's Representative Office in Da Nang City has its own seal and separate bank account for transactions.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The Ministry's Representative Office in Da Nang City has the following duties and authorities:
1. Submitting to the Minister the long-term and annual plans on the organization of activities of the Representative Office and implementing such activities after approval;
2. Collecting, monitoring, receiving information, and reporting to the Ministry's leadership on specialized activities under the Ministry's administrative management in the assigned provinces and centrally governed cities;
3. Receiving, conveying, and urging the implementation of policies, programs, plans, and key tasks of the Ministry towards units under the Ministry and related organizations and individuals in the area;
4. Cooperating with Departments, Bureaus, Offices, and Inspectors General of the Ministry, as delegated by the Minister, in directing, guiding, and inspecting the administrative management activities of Provincial Information and Communications Departments in the Central Highlands-Western Highlands region;
5. Cooperating with relevant units in providing news and information about the Ministry's activities and specialized activities under the Ministry's administrative management in the area to mass media outlets, organizations, and individuals;
6. Cooperating with related agencies under the Ministry in organizing and serving meetings, working sessions, conferences, seminars, training sessions, and briefings of the Ministry and subordinate agencies in the area; managing minutes of these meetings, sessions, and working sessions;
7. Implementing reception, ceremonial, and funeral-related tasks within the Ministry's responsibilities in the area;
8. Cooperating with central and local agencies in the area as relevant; attending meetings convened by other ministries, sectors, and localities as assigned by the Minister;
9. Participating in directing information services for urgent national security, natural disaster, enemy threat, and other emergency situations in the area;
10. Serving as the Standing Sub-committee for Flood and Storm Prevention in the Central Highlands-Western Highlands region;
11. Proposing the examination and awarding of annual and exceptional achievements based on recommendations from units operating in postal, telecommunications, information technology, press, and publishing fields in the area;
12. Organizing and managing accounting and financial operations; managing operational funds of the unit in accordance with state regulations and the Minister's delegation;
13. Implementing personnel management systems, civil servant records, and labor contracts in compliance with laws and the Minister's delegation;
14. Managing assets and facilities provided by the Ministry in accordance with state regulations and the Ministry; researching and proposing basic construction investment plans, renovations, upgrades, new constructions, and repairs of office premises;
15. Implementing personnel management systems, civil servant records, and labor contracts in compliance with laws and the Minister's delegation;
16. Cooperating with related agencies in implementing personnel policies and caring for the lives of current and retired officials, civil servants, and employees under the Representative Office's responsibility;
17. Performing other tasks assigned by the Minister.
đ) Based on the regulations on the delegation of organizational and cadre management, the Director of the Department decides or submits to the competent authority for decisions regarding the appointment and dismissal of heads and deputy heads of units under the Department according to the position standards set by the provincial people's committee;
1. Leadership of the Ministry's Representative Office in Da Nang City:
The Ministry's Representative Office in Da Nang City has a Head and Deputy Heads.
The Head of the Representative Office is responsible to the Minister and the law for organizing and implementing the assigned functions, duties, and authorities.
Deputy Heads assist the Head of the Representative Office and are responsible to the Head for their assigned tasks.
2. Organizational Structure and Staffing:
- Administrative and Organization Department
- Planning and Finance Department
- Management Department
The staffing of the Ministry's Representative Office in Da Nang City is established by the Head of the Representative Office, submitted to the Minister of Information and Communications for decision. Based on work requirements, the Head of the Representative Office may enter into general labor contracts.
The Head of the Representative Office specifies the specific tasks and working relationships between departments and the staffing of each unit.
Article 4. Effective date
This Decision takes effect fifteen (15) days from the date of publication in the Official Gazette. Decree No. 1068/QĐ-BBCVT dated December 21, 2004 of the Minister of Posts and Telecommunications regarding the functions, duties, authorities, and organizational structure of the Representative Office in the Central Highlands-Western Highlands region is hereby abolished.
Article 5. Responsibilities for Implementation
The Chief of the Office, Directors of the Cadre and Civil Servant Organization Department, Heads of agencies and units under the Ministry of Information and Communications, and the Head of the Ministry's Representative Office in Da Nang City are responsible for implementing this Decision./.
