Regulations on the functions, tasks, powers, and organizational structure of the Department of Medical Equipment and Health Facilities under the Ministry of Health

THE MINISTER OF HEALTH

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 188/2007/NĐ-CP dated December 27, 2007 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Health;

Considering the proposals of the Director of the Personnel Department and the Director of the Department of Medical Equipment and Health Facilities, Ministry of Health.

DECISION:

Article 1. Position and Functions

The Department of Medical Equipment and Health Facilities is a specialized department under the Ministry of Health, with the function of advising the Minister of Health on state management in the field of medical equipment and construction investment for health facilities.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Field of medical equipment management

a) Taking the lead in drafting and submitting to the Minister for promulgation legal normative documents guiding the implementation of procurement, management, use, storage, repair, and inspection of medical equipment;

b) Taking the lead in drafting and submitting to the Minister for promulgation legal normative documents guiding production, business, and technical services related to medical equipment;

c) Taking the lead in drafting and submitting to the Minister for promulgation a list of standards for medical equipment for healthcare facilities according to the technical tiering of the Ministry of Health;

d) Taking the lead in drafting national standards on medical equipment for submission to the competent authority for publication; drafting and submitting to the Minister of Health for promulgation national technical regulations on medical equipment;

đ) Guiding the implementation of the objectives of the National Policy on Medical Equipment and the Research and Production Program for Medical Equipment approved by the Prime Minister;

e) Taking the lead in receiving and organizing the review of import registration files, production registration files, product standard announcement files, and advertising information registration files for medical equipment;

g) Taking the lead in organizing the review of the list, configuration, and technical standards of medical equipment for projects using state budget funds. Reviewing and submitting to the Minister of Health for approval the bidding plans, tender invitation documents, and bidding results for the procurement of medical equipment funded by development investment from units directly under the Ministry of Health in accordance with the provisions of the law;

h) Serving as the permanent member of the Advisory Council on Medical Equipment of the Ministry of Health;

i) Participating in building programs, contents, and training plans to enhance the qualifications of technical and management staff in medical equipment;

k) Participating in implementing socialization activities in the field of medical equipment, and handling the mobilization and disposal of medical equipment at units directly under the Ministry;

l) Acting as the focal point for organizing inspections and evaluations of activities related to investment procurement, management, and use of medical equipment at healthcare facilities.

2. Field of construction investment management

a) Taking the lead in drafting and submitting to the Minister for promulgation the Investment Management Procedures and legal normative documents to guide and instruct the management of construction investment for health facilities nationwide;

b) Taking the lead in drafting and submitting to the competent authority for promulgation national standards on design and design models for health facilities. Guiding the application of design models for health facilities within the authority of the Ministry of Health;

c) Guiding subordinate public service units in preparing and announcing investment construction volume plans after the Ministry of Health allocates capital to these units;

d) Guiding and supervising the implementation of construction investment projects for facilities within the authority of the Ministry of Health;

đ) Taking the lead in reviewing, assessing, and submitting to the Minister of Health for promulgation decisions on investment preparation, project approval decisions for construction and renovation of facilities within the management authority of the Ministry of Health;

e) Taking the lead in reviewing and submitting to the Minister for approval bidding plans, tender invitation documents, and bidding results for construction and renovation packages of facilities funded by state budget within the authority of the Ministry of Health;

g) Cooperating with the Planning and Finance Department in developing annual capital investment allocation plans, and submitting them to the Minister of Health for approval;

h) Participating with the Planning and Finance Department in reviewing final accounts of investment and construction in accordance with current legal provisions;

3. Other tasks

a) Acting as the focal point for organizing and coordinating the implementation of research topics applying scientific and technological advancements in the fields of medical equipment and health facilities;

b) Acting as the focal point for assisting the Minister in managing specialized activities in the fields of medical equipment and health facilities of relevant units (Vietnam Medical Equipment Corporation, Institute of Medical Equipment and Health Facilities, the system of Medical Equipment Technical Schools, Vietnam Medical Equipment Association);

c) Cooperating in implementing international integration and cooperation activities in the fields of medical equipment and health facilities;

d) Performing other tasks assigned by the Minister of Health.

Article 3. Organizational Structure and Operations

1. Leadership of the Department

The Director and Deputy Directors of the Department are appointed and relieved of their duties by the Minister of Health. The Director is responsible to the Minister of Health and to the law for all activities of the Department. The Deputy Directors assist the Director and are responsible to the Director and to the law for the tasks assigned to them.

2. Quota

The staffing of the Department is determined by the decision of the Minister of Health and is adjusted annually based on work needs and the proposal of the Director.

3. Operation Mechanism

The Medical Equipment and Health Infrastructure Department operates under a specialist system. Civil servants in the Department are responsible to the Department's leadership for the tasks assigned to them.

Article 4. Effective date

This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 5. Responsibilities for Implementation

The Heads of the Ministry’s Office, the Inspector General of the Ministry, the Department Directors, the Bureau Chiefs, the General Bureau Chiefs under the Ministry of Health, and the Heads of relevant agencies, units, and individuals are responsible for implementing this Decision./.
